AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH CENTRAL MISSOURI
PLUMBING SERVICES FOR CITY PLUMBING SERVICES.
WHEREAS, Central Missouri Plumbing Services has become the apparent lowest and
best bidder on the City Plumbing Services project;
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The bid of Central Missouri Plumbing Services is declared to be the
lowest and best bid and is hereby accepted.
Section 2.The Mayor and City Clerk are hereby authorized to execute an agreement
with Central Missouri Plumbing Services for City Plumbing Services.
Section 3. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A,
Section 4. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

AMENDMENT TO .P.T.,UMBING SERVICE,S AGRE EMENT
WHEREAS, the City of Jefferson, Missouri, a inunicipal corporation, with offices lit; 320 East
McCarty Street, Jefferson City, Missouri, 65101., herein"lf`ter designated "City," entered into
an Agreement with Central Missouri Pltimbiilg. Inc.,with offices at 5508 Business 50 West,
Jefferson City, Missouri, 65101., hereinafter referred to ris "Contractor," oil July 7, 2004;
WHEREAS,the Agreement,wais for the pertlormaiic,e of.authori.ze(I plumbing work within City
buildings, which may involve nia ill tena nce,, r(lpairs, and replacement services; and
WHEREAS,both parties wish to extend the agreement, for the first year of two additional one
year renewal periods as stipulil.tecl in Item 2 of the Agreement dated July 7, 2004.
NOW, THEREFORE, be it (agreed by the parties that the ,lgreoment is hereby renewed for
the first year of the two additional one-year periods to end June 30, 2006.

• 4. Indemnity.
To the fullest extent permitted by law, file CunU'netor will indemnify and hold harmless the City, its elected and
appointed officials, employees, and agents from and against any and all claims, damages, losses, and expenses
including attorncys'Pecs,wising out ofor resulting from the perfornuulce ofthe work,provided that any such claim,
damage,loss or expense(I)is attributable to bodily injury,sickness,discase,or death,or to injury to or destruction
of tangible property(other than the Work itsell) including the loss of(1se resulting therefrom and(2)is caused in
whole or in part by any negligent act or omission of contactor, any subcontractor. anyone directly or indirectly
employed by.lily of thcm or anyone for whose acts any of them may he liable• regardless of whether or not it is
caused in part by a party indemnified hereunder. Such obligation shall not be construed to negate, ,abridge, or
otherwise reduce any other right or obligalion of indemnity which would otherwise exist a%to any party or person
described in this Paragraph.

G. Prevailing Wam!e I.a«_.
To the extent that the work performed by Contractor is subject lu prevailing wage law,C'ont•actor shall pay a wage
of no less than the"prevailing hourly rate of wages" liar work of a similar character in this locality, as established
by Department of Labor and Industrial Relations of the State of Missouri. and as established by the Federal
Employment Standards ofthe Department of Labor. Contractor acknowic(Iges Ihat Contractor knows the prevailing
hourly rate of wages for this project because Contractor has obtained the prevailing hourly rate of wages from the
contents of Annual Wage Order No.10 Section 026 in which the rate of wages is set forth.Contractor further agrees

Specifications were sent to nine additional bidders with no response.
FISCAL NOTE:
A number of accounts are charged as services are required. A total of$ 13, 154.42 was
expended for all city departments during the past year. A breakdown ofexpenditures for the
period June 1, 2003 through May 31, 2004 is attached. The average annual expenditure during
the past four years has been $ 21,156.48
PAST PERFORMANCE:
This vendor has performed services for the City for the past tour years under bid
agreements. Staff believes they will continue to perform satisfactorily.
RECOMMENDATION:

Central Missouri Plumbing Services was awarded a three year bid for plumbing services on
an hourly basis. That agreement has been completed and the current bid was initiated. The public
notice advertisement requesting bids !or this services was printed in the News Tribune on April 21,
2004 with an opening date of May 6, 2004. Eleven bid packets were sent to prospective bidders as
sown at the bottom of the tabulation of bids. Only two bids were returned.
Central Missouri Plumbing Services has performed services for the past six years under two
bid awards of three years each. Although expenditures for the period June 1, 2003 through May
31, 2004 were $13,154.42; expenditures for the previous three one year periods have been
$25,406.10, $22,928.67 and $23,136.73. Central Missouri Plumbing Services has performed
services for the past three years at the same maintenance rate for regular hours of' $35.50. This bid
lists a maintenance rate for regular hours at $41.50. 'The new rate is an increase of approximately
16% but it is substantially lower than the only other bid received. The bid lists two additional one
year renewal periods which were bid at the same hourly rates as year one.

AMENDMENT TO PLUMBING SERVICES AGREEMENT
WHEREAS,the City of Jefferson,Missouri, a municipal corporation,with offices at 320 East McCarty
Street,Jefferson City,Missouri, 65101,hereinafter designated"City,"entered into an Agreement with
Central Missouri Plumbing,Inc.,with offices at 5508 Business 50 West,Jefferson City,Missouri,65 10 1,
hereinafter referred to as "Contractor," on July 7, 2004, and amended on June 9, 2005;
WHEREAS, the Agreement was for the performance of authorized plumbing work within City
buildings, which may involve maintenance, repairs, and replacement services; and
WHEREAS, both parties wish to extend the agreement for the final year of two additional one year
renewal periods as stipulated in Item 2 of the agreement dated July 7, 2004, and amended June 9,
2005;
NOW, THEREFORE,be it agreed by the parties that the agreement is hereby renewed for the final
year of the two additional one-year periods to end June 30, 2007; and
Amending Item 3. Payment is hereby amended thread as follows:
3. Payment.
Payment shall be made to Contract by City on a monthly basis following the
submission by the Contractor for an itemized, detailed statement of services
rendered,which shall be presented to the Finance Department of the City no later
than the fifth (5th) day of the month following rendition of the services. The
total amount of this contract shall not exceed Twenty-Five Thousand
Dollars ($25,000.)
IN TESTIMONYWHEREOF,the parties have hereunto set their hands and seals this
day of April, 2006.
