ORDINANCE NO.
AN ORDINANCE OF 'THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF 130 ACRES ADJACENT TO AND CONTIGUOUS WITH 'THE
CITY BOUNDARY, INCLUDING 108 ACRES OF REAL PROPERTY AND 22 ACRES OF RIGHT-
OF.•WAY LYING IN SECTIONS 14, 15 AND 22, TOWNSHIP 44 NORTH, RANGE 12 WEST, IN
COLE COUNTY, STATE OF MISSOURI, AND REPEALING SECTION 1-17 OF THE CODE OF
THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND
ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71,012.2 RSMo, 1994, the City Council of the City of Jefferson
was presented with verifiod potition rocluosting tl-itnt tho city annex 108 acres of
the unincorporated area of land described in Soctioll 1 :
WHEREAS, the petition requesting said annexation was signed by all fee intorosts of record in
all real property located within the area proposed to bo nnnexed; and

WHEREAS, the Council has determined that it is in the best interest of the city to it nox L 11
right-of-way of Missouri Highway 179 which adjoins the property described in
Section 1: and
WHEREAS, a Public hearing concerning the annexation was hold,as advortisod In tho Jefferson

NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:

Section 3. The City Council finds and declares that the land described in Section 2 is
contiguous to the City boundary; that the annexation is reasonable and necessary to the proper
development of the City; and further, did determine the City has the ability to furnish normal
municipal services to the area.
Section 4. Section 1-17 of the Code of the City of Jefferson, Missouri is hereby repealed
and a new Section 1-17 is hereby enacted, which shall read as follows:

SUBJECT: our objection to the proposed re-zoning and annexation
Dear Ms. McMillian:
As property owners that adjoin the 108 acres that St. Mary's wants to build
upon, we wish to use this means to communicate our displeasure of the situation to
you.
We are adarnantly opposed to re-zoning this 108 acres from
residential to commercial, for a whole plethora of reasons.
To start with we do riot want to live and raise our Family next to a 108 acre
con-rercial center -- this area of town is a residential area, and our children roam
around amongst the various neighborhood homes just like we were gable to do in "the
old" days -- and we like: that!!! We do not writ our neighborhood to change into a
major commercial center.
Next, we feel like the V141L1eS Of Our neighborhood homes will be deminished by
a considerable amount, because no one will buy Our homes if faced with living next
to a 108 acre commercial park.
Next, we do not want all of that traffic flowing by our homes - and sure do riot
want all of those high speed, IOUd siren bearing ambulances going by at all hours of
the day arid night. Your City Street department cannot take adequate care of this end
of Rolling Hills Drive now, so YOU Call just guess V% hLit Would happen if you increase

the traffic count many times ovcar - our area of the street is falling apart and the City
has not been able to rare for it as it is.
We could go on for a considerable amount of time in our attempt to tell you
about our concerns with this proposed rezoning and construction, but feel you should
understand our concerns are legitimate, and we object very strongly to each proposal
listed in your June 3, 2004 notice on this matter.
There is adequate real estate available to St. Mary's Hospital now within the
County that is already zoned commercial -- and St. Mary's should look to that realty
and leave this end of town alone.

from the larger tract, was created when right-of*way was acc)uircd for the extension of Highway 179. The
subject property was formerly a firrni owned by Sylvester Benihooni.
