HomeMy Public PortalAboutOrdinance No. 847-98 10-13-1998 ORDINANCE NO. 847-98 AN ORDINANCE AMENDING SECTION 1.37 "INFLUENZA VACCINE" OF THE PERSONNEL POLICIES MANUAL OF THE CITY OF RICHLAND HILLS, TEXAS; PROVIDING FOR ANNUAL, FREE INFLUENZA VACCINATIONS FOR CITY EMPLOYEES, ELECTED OFFICIALS AND BOARD AND COMMISSION MEMBERS; PROVIDING FOR SUCH VACCINATIONS FOR Il1~IlVIEDIATE FAMILY MEMBERS OF EMPLOYEES, ELECTED OFFICIALS AND BOARD MEMBERS UPON PAYMENT OF THE ACTUAL COSTS THEREFOR; PROVIDING FOR CONTINUING AUTHORIZATION OF SUCH PROGRAMS; PROVIDING A SEVERABILTTY CLAUSE, PROVIDING A SAVING CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the City of Richland Hills, Texas, currently provides influenza vaccinations for City employees, with the cost of such vaccinations borne by the City; and WHEREAS, the City Council of the City of Richland Hills, Texas, recognizes that such vaccination program enhances the productivity of City employees, in a manner that far outweighs the cost of said program; and WHEREAS, the City Council desires to expand the program of free vaccinations to elected officials and volunteer board and commission members; and • WHEREAS, the City Council further desires to extend the availability of influenza vaccinations to the immediate family members of City employees, elected officials and volunteer board and commission members, upon payment of the actual costs incurred by the City for such vaccinations; and WHEREAS, the City Council further desires to give continuing authorization to the City Manager to institute such programs on an annual basis, without further action by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: L That Section 1.37 "INFLUENZA VACCINE" of the Personnel Policies Manual of the City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: 1.37 Influenza Vaccine The City of Richland Hills will provide and pay the costs necessary for all City employees, elected officials and volunteer board and commission members to annually receive an influenza vaccination, at the option of each such person. The City Manager shall coordinate arrangements to ensure the vaccine is provided to all participating employees each year. Employees, elected officials • and volunteer board and commission members may participate in the program ORDINANCE NO. PAGE 1 • free of charge at their individual option. Immediate family members of such employees, elected officials and volunteer board and commission members may also participate in the program, upon payment to the City of the actual cost incurred by the City to provide influenza vaccine to such immediate family member. Each person receiving the vaccine must sign a liability waiver releasing the City of liability and responsibility related to illness or other problems which result or are alleged to have resulted from such person's election to receive the vaccine. The City Council of the City of Richland Hills, Texas, hereby grants continuing authorization to the City Manager to provide this program annually to the persons named herein, and no further action of the City Council shall be necessary to authorize the influenza vaccine program in any succeeding year. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. • Saving Clause. That the Personnel Policies Manual of the City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
