March 3, 1969
In accordance with the tarrant the meeting was held in the Brewster
School Auditorium Monday, March 3, 1969.
The meeting was called to order at 7:00 P. M. by the Xoderator, Grant U.
Koch with tellers Paul C. Syl.ver, Elisabeth Linnell and June Gallant. Checkers
were Dorothea Dugan and Jean Gage. Prayer was offered by Rev. Henry L. Durand,
Y. S.of Our Lady of the Cape Church. Fledge of Allegiance to the Flag was led
by Boy Scout, Steven Lajoie. Unanimous consent was given the Moderator to elimin-
ate the first reading of articles.
The.Warrant, was read_ by the Town Clerk, Donald P. Consodine, with the
"T exception of the Articles which were read as they were being considered.
WIGLE 1 . To act on the annual report of the Selectmen and other gown
Officers.
Voted unanimously that the annual report of the Selectmen and other Town
Officers. be accepted as printed.
ARTICLE 2. To see if the Town will vote to authorize the Town Treasurer,
with the approval of the Selectmen to borrow money from time to time in antici-
pation of the revenue of the financial year beginning January 1, 1969 and to
issue 4 none or notes, therefore, payable within one year, and to renew any note
or notes.as may be given for a period of less than one year in accordance with
Section 17 of Chapter 44, General yaws as amended.
Voted unan ously that the Town authorize the Town Treasurer with the
approval of the Selectmen to borrow money from time to time in anticipation of
the revenue of the financial year beginning January 1, 1969 and to issue a note
or notes therefore, payable within one year, art to renew any note or notes as
may be given for a period of less than one year in accordance with Section 17
of Chapter 40, General Laws as amended.
ARTICLE 3. To see if the Town will vote to transfer a sum of money from
surplus overlays to the Reserve Fund.
Noted unanimously that the Town transfer rive Thousand Dollars ( SAX ON
from surplus overlays to the Reserve Fuad.
_..__ ARTICLE 4. To -tear the report of any special committee.
An interim report on the progress oftnunicipal tennis courts was given by
-- Wiliam Saylor. A final report of the Regional School Planning Committee was
given by .Lawrence Crocker. A motion to discharge the committee was unanimously
voted with a rising vote of thanks.
ARTICLE 5. To see if the 'Town will vote to fix the salary and compensation
of ali elective officers of the Town as provided by Section 108, Chapter 41.,
General Naim as amended,for the year 1969 to be effective January 1, 1969.

Section 12.1.2 by deleting the present language and substituting the following:

appointed boards and commission shall be as follows:
Registrar of Voters $2.15/hr.
Election Tellers $2.15/hr.
Millsite Workers $2.15/hr.
Voted unanimously that the Town amend the Personnel. By-Law, Section 12.42
by deleting the present language and substituting the following: 12.1.2 as
reported in the annual Town Arrant of 1969.

Minium for response and first hour or fraction thereof, hourly rate
for time hereafter.
-� aegular part-time patrolmen assigned to stand-by duty and subject to
respond calls between the hours of 7:00 p.m. and 7:00 a.m., or between
7:00 a.m. and ?:00 p.m. during the periods when no other officer is on
active duty, or a regular employee is not on stand-by duty, shall be
paid $3.00 for said stand-by duty plus his regular rate per hour for
time spent in .response to calls to active duty during said periods of
stand-by duty.
^� Salary based upon five 10-hour day and 14-hour night shifts worked.
Shifts may be rotated. Temporary substitutes shall be paid at the rate
of $18.80 per shirt, day or night. Regular parttime substitutes shall
be paid at the rate of $18.50, $19.40, $20.00, $20.60, $21 .20, $21 .80 -_
per shift for the 1st, 2nd, 3rd, 4th, 5th and 6th Steps respectitelY;
when working night or day shift.

Voted unanimously that the town amend Section 12.1.3 by deleting
Sections CAF , thru sections 1~12 and substitute the following as printed
in the annlaal town warrant of 1969.
ARTICLE 8. To see if the Town will vote to install and maintain.
"tun street lights, one on pole 40, Route 137 and one at the junction of
Old North Road and Point of Rocks Road.
Voted unanimously that the town install and maintain two street lights,
one on pole 3/86, Route 137 and one at the junction of Old North Road and
Point of Rocks Road.
ARTICLE 8A. To see if the Town will vote to raise and appropriate such
sums of money as may be deemed necessary to defray Town charges and expenses
for the year 1969.

ARTICLE 9. To see if the Town: will vote to raise and appropriate
or transfer from unappropriated available funds in the treasury, a sura of
money for Chapter 81, Highways.
Voted unanimously that the town raise and appropriate a sum of Five
Thousand One Hundred Twenty Five Dollars ($5,125.00) and transfer from free
cash in the treasury the suet of Eleven Thousand Two Hundred Seventy Five
Dollars ($11,275.00) to meet the state's share of Chapter 81 highway work.
ARTICLE 10. To see if the Town will vote to raise and appropriate or
transfer from unappropriated availabe funds in the treasury, a sum of money
for Chapter 90, Highways.
Voted unanimously that the town raise and appropriate the sum. of Sip:
Thousand Dollars ($6,000.00) and transfer from free cash the sum of Eigh-
teen, Thousand Dollars ($18,000.00) to meet the cost of the state and
county's share of Chapter 90 highway construction.
ARTICLE ll.To see if the Town will vote to appropriate from. the Road
NAchineiy General rand, the sum of Thirty Five Hundred Dollars ($3,500.00)
to be used for the purchase, maintenance and operation of Road 1achi.nery.
Voted unanimously that the Town appropriate from Road ha.chinery General
Fund, the sum of Thirty .Five Hundred Dollars ($3,500.00) to be used for the
purchase, maintenance and operation of Road Machinery.
ARTICLE 12. To see if the Town will vote to transfer the sump of Tyree
Thousand Three Hundred Twenty Four Dollars and Twenty Five Cents (33,324.25)
.from the funs provided by Chapter 616 of the Acts of 1967 to be used for
resurfacing a portion of Long Fond Road.
Voted unanimously that the town transfer the sun_ of ThreeThousand Three
Hundred Twenty Four Dollars and Twenty Five Cents ($3,324.25) from the funds
provided by Chapter 616 of the Acts of 1967 to be used for resurfacing a
portion of Long Fond Road.
ARTICLE 13. To see if the Town will vote to raise and appropriate the
sum of Thirty Five Thousand Dollars ($35,000.00) to be used in conjunction
with Chapter 90, money previously appropriated for construction work on
Freeman's Way, work to be done by Town forces.
Voted unanimously that the town raise and appropriate the sum of Thirty
-_- Five Thousand Dollars 035,000.00) to be used in conjunction with Chapter
90, money previously appropriated for construction work on Freeman's ?ray,
work to be done by Town forces.
ARTICLE 14. To see if the Town will vote to accept the layout of Old
North Road as made and reported by the Selectmen on January 28, 1969 as
showm on a plan drawn by Nickerson a Berger and on file with the Town Clerk;
and to authorize and instruct the Selectmen to purchase or take by eminent
domain the land, or the interest in the lands within said layout, and to
act fully thereon; and for this purpose raise and appropriate a sura not
exceeding Six Thousand Seventy Dollars ($6,070.00) to be used for land taking.
A notion: was made to indefinitely postpone this article. it was de-
feated on a hand count vote , Yes - 94 - No - 123. This article was dis-
approved on a hand count vote, Yes 147 - No - 75. Two thirds vote required.
ARTICLE 15. To see if the town will vote to accept the layout of
Jonathan's lay and Aunt Moll's Ridge Road as made and reported by the
Selectmen on January 28, 1969 as shown on a plan on file with the Town
Clerk and to authorize and instruct the Selectmen to purchase or tare by
eminent domain the lands, or the interests in the land within said layout,
and to act fully thereon; and for that purpose raise and appropriate a sum
not exceeding Fifty Nine Dollars ($59.00) to be used for land taking.
Voted unanimously that the town accept the layout of Jonanthan's Way and
Aunt Moll's Ridge Road as made and reported by the Selectmen on January 28,
1969 as shown on a plan on file with the Town Cleric and to authorize and
instruct the Selectmen to take by eminent domain the lands, or the interests
in the lard within said layout, and to act fully *hereon; and for that
purpose raise and appropriate a sum not exceeding Fifty Nine Dollars ($59.00)
to be used for band taking.
ARTICLE 16. To see if the Town will vote to raise and appropriate
the sum= of Two Thousand Dollars ($2,000.CO) to construct a wooden bulk-
head at the Breakwater Landing to be done under the supervision of the
Department of Public Arks.
Noted unanimously that the Town raise and appropriate the -sum of
Two Thousand Dollars ($2,000.00) to construct a wooden bulkhead at the
Breakwater Landing to be done under the supervision of the Department
of Public Works.
ARTICLE. 17. To see if the Town will assume liability in the
manner provided by Section 29 of Chapter 91 of the General Laws, as
amended by Chapter 516 and 524, Acts of 1950 for all damages that may
be incurred by mark to be performed by the Department of Public Works
of Massachusetts for the improvement, development, maintenance and
protection of tidal and non-tidal rivers and streams, harbors, tide--
waters, foreshores and shores along a public beach outside Boston Harbor, --
including the herrimack and Connecticut Rivers, in accordance with Section
11 of Chapter 99 of the General Laws, and authorize the Selectmen to
execute and deliver a bond of indemnity therefore to the Commonwealth.
Voted unanimously that the tow: assume liability in the manner
provided by Section 29 of Chapter 91 of the General Laws, as amended by
Chapter 516 and 524, Acts o; 1950 for all damages that may be incurred
by work to be performed by the Department of Public Yorks of hassachu--
setts for the improvement, development, maintenance and protection of
tidal and non--tidal rivers and streams, harbors, tidewaters, foreshores
and shores along a public beach outside Boston Harbor, including the
Merrimack and Connecticut Rivers, in accordance with Sections 11 of
Chapter 91 of the General Laws, and authorize the Selectmen to execute
and deliver a bond of indemnity therefore to the Cormonwealth.
ARTICLE 18. To see if the Town will vote to authorize and instruct
the Town Treasurer to pay the Bog Tax returns from the assessments of
1968 to the Brewster Ladies' Library Association in accordance with
Chapter 140, Section 72.

funds in the Treasury, the sum of Five Hundred Dollars ($500.00) to the

AR ICLE 20. To see if the Town will vote to instruct the Selectmen
to contract for one year for Ambulance Service with the Brewster, Orleans,
Eastham Ambulance Association, Inc. , and raise and appropriate the stun of
Three Thousand Five Hundred Dollars ($3,500.00) for this purpose.
Noted unanimously that the town instract the Selectmen to contract

ARTICLE 21 . To see if the Town will vote to permit the Brewster
Historical Society, Inc. to use the second floor auditorium of the Towns.
Hall as well as the small room opposite and raise and appropriate the sum
of Sixteen Hundred Dollars ($1,600.00) for restoring, painting and elect-
rical work.
Voted unanimously that the town permit the Brewster Historical

ARTICLE 22. To see if the Town will vote to raise and appropriate
a sum of money for the purchase of approximately 1.4 acres of land now
owner. by Mrs. George F. Russell to increase the size of the present Town
Landing on Sheep Pond.
It was voted.by majority that the town raise and appropriate Nine
Thousand Dollars ($9,000.00) for the purchase of approximately 1.4 acres
of land now owned by Mrs. George F. Russell to increase the size of the
present Town Landing on Sheep Pond. -
AWICLE 23. To see if the Town will vote to raise and appropriate
the sura of Two Hundred Dollars ($200.00) for engineering fees in conn-
ection with the enlargement of Sheep Pond Landing.
. Voted unanimously that the Town raise and appropriate the sum of
Two Hundred Dollars ($200.00) for engineering fees in connection with the

ARTICLE 24. To see if the Town will vote to instruct the Assessors
to act under Chapter 40, Section 4 of the General Lags, and to enter into
a contract for a professional equalization of unimproved acreage north of
Route A and raise and appropriate the sum of Twelve Hundred Dollars ($1200.00)
It was voted by majority that the town instruct the Assessors to act

ARTICLE 25. To see if the Town mill vote to appropriate the sum of
Twenty One Thousand Dollars (21 ,000.00) to purchase or take by eminent
domain land shown on plans entitled "Plan showing marsh at Quivet Creek in
Brewster, Mass. as surveyed for the Brewster Conservation Commission, Scale
1" = 1001 , March 1969, Nickerson & Berger, Civil Engineers, Eastham $. Chathal,
Mass." and ''Plan showing Skaket Greek in Brewster, Xass. as surveyed for
the Brewster Conservation Commission, Scalcl "= 1001 , Narch 1969, Nickerson
and Berger, Civil Engineers, Eastham & Chatham, Mass." for conservation
purposes, and to determine whether such monies should be raised by taxation,
borrowing or otherwise, and to authorize and direct the Brewster Conserv-
ation Commission to enter into any agreements it deems advantageous on be-
half of the town with the Comnorwealth of Massachusetts and/or United States
of America for partial reimbursement of the cost of the land.
A recess was declared to allow Frank Richards; Attorney for TGNN, INC.
and George King, owner of Sea--nand, the privilege of the floor.
An amendment to exclude Parcel ,#6 on the Nivey creek parcel, subject to
a negative easement was approved on a hand count vote - yes 151 - No 53.
An amendment (on behalf of TONN, INC.) to exempt a strip 100 feet wide
from Parcels 14 and 15 subject to whatever restrictions the Conservation_
Commission may place on same, and that TON' , INC. will deed to the Town of
Brewster the remaining part of the marsh Nand that they now own at no fee was

ARTICLE 34. To see if the Town will raise and appropriate the sum of
Seven Thousand Dollars ($7,000.00) for the purpose of putting fluorescent
lighting in the Brewster Elementary School..

ittee consisting of three persons to be appointed by the Moderator, in

AMICL:E 47. To see if the Town will vote to utilize the town-owned
Land of approximately 191 acres on Great Fields Road near its junction
with Route 124 as the site of a public disposal. area.
An amendment that the Selectmen of the Torn of Brewster appoint a
committee of five (5) persons to study the feasibility of moving the
Town Dump up into the Great bods on Run til,_ Road extension s said
committee to report back to the Selectmen with their recommendations by
September 1, 1959 was defeated on a voice vote.
A recess was declared to allow Charles E. Frazier, Jr., counsel for
the Board of Selectmen, the privilege of the floor was granted.
It was voted on a voice vote to indefinitely postpone this article.
ARTICLE 48. To see if the Town will authorize the Selectmen to enter
into negotiations with the owners of two lots of lands, comprising approxi-
ately 14 acres, to the west of the town-owned land on the northern side of
Great Fields Read, in order to add to the use of the latter as a public
disposal area.

ing and Operating an Ice Skating Rink, such acceptance to be effective
upon the passage of the act; and to raise and appropriate a sufficient sum
of money for the purposes set forth in said Act and any damages relating
thereto; and upon the Selectmen having been furnished with evidence satis-
factory to them that the Commonwealth of hassachusetts will construct an
ice skating rink in accordance with the provisions of said Act, within
two years from the effective date of said Act, to pay the said appropri-
ation of the Town of Harwich for the purposes set forth in said Act, in-
cluding improving the :and and installing waste„, sewer and parking
facilities.
