ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A CERTAIN
EASEMENT FOR SANITARY SEWER PURPOSES IN PART OF LOT 1, AMERICAN
SUBDIVISION.
BE IT ENACTED BY THE COUNCIL OF 11111E CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
WHEREAS, by an easement recorded in Book 257, Page 727, of the Records of the Cole
County, Missouri, a sewer easement was granted to tile City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and repair structures for the routing
and conveyance of sewer ill, under and through the lots, tracts or parcels of land described in
Section 1;
Section 1. The Council finds that the following described oasement is surplus property
of the City and is no longer needed for any public purpose:
Part of a tell (10) foot wide sanitary sewer easement across a part of Lot No, 1, of American
Subdivision, Section One, as per plat of record in Plat Book 11, Page 543, of the Cole County
Recorder's Office, said easement being an easement of record in Book 257, Page 727, of the
Cole County Recorder's Office, the centorline of said p(-..irt of said ten (10) foot wide easement
being more particularly described as follows:
From the northeast corner of said Lot No. 1: thence south along the easterly line of said
Lot No. 1, 97.16 feet, to the centerline of said easement as described in said Book 257,
Page 727; thence deflecting to the right at an angle of 83('05'29", along the centerline
of said easement, 18.88 feet to the POINT OF BEGINNING for this centerline
description; thence continuing along the centerline of said easement, 93.47 feet, to
centerline Station 3• 49.05 of Private Sewer No. 371, line"C"; thence deflecting to the
left at an angle of 13038'49", along said centerline, 132.55 feet, to the westerly line of
said Lot No, 1 and the POINT OF TERMINATION of this centerline description.
Section 2. The easement described in Section 1 is hereby relinquished, and the City does
hereby release and abandon whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any necessary
legal document relinquishing all of the City's interest in the tract of ground described in Section
1.
Section 4. This Ordinance shall be in full force and effect from and after the date of its
passage and approval.
