AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING,
AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF
JEFFERSON, BY REZONING 1,42 ACRES FROM M-1 , LIGHT INDUSTRIAL TO RA-2,
MULTI-FAMILY RESIDENTIAL FOR PROPERTY ADDRESSED AS THE 3500 BLOCK OF
CHAPEL HILL. ROAD, LOCATED IN FRACTIONAL SECTION 4, TOWNSHIP 44 NORTH,
RANGE 12 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI AND ENDORSING AN
AMENDMENT ON THE DEVELOPMENT PLAN MAP OF THE COMPREHENSIVE PLAN TO
REFLECT SUCH CHANGE.
WHEREAS, IT APPEARS THAT THE PROCEDURES SET FORTH IN THE ZONING CODE
RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH,
WHEREAS, THE ZONING ORDINANCE REQUIRES CONSISTENCY BETWEEN THE
COMPREHENSIVE PLAN AND THE ZONING MAP AND THE PROPOSED ZONING
CHANGE WOULD NECESSITATE A CHANGE TO THE COMPREHENSIVE PLAN
DEVELOPMENT PLAN MAP.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1 . The following described real estrite is rezoned from M-1 Light Industrial
to RA•-2 Multi-Family Residential:
A part of Reserved Tract B of Chapel Hill Commons Section Four, a plat record
in Plat Book 12, page 348, Cole County Recorder's Office, being a part of
Fractional Section 4, Township 44 North, Range 12 West, Cole County,
Missouri, more particularly described as follows: BEGINNING at the
southwesterly corner of said Roserved'Tract B of Chapel Hill Commons Section
Four, thence along the boundary of said Reserved Tract B the following
courses: N52"54'07"E, 18.73 feet; thence northeasterly, on a curve to the left
having a radius of 335.00 feet, an arc distance of 275.64 feet (the chord of said
curve is N29°1 9'50"E, 267.93 feet); thence northeasterly, on a curve to the right
having a radius of 285.00 feet, an arc distance of 33.26 feet (the chord of said
curve is N09"06'07"E, 33,24 feet); thence N86"28'35"E, 384.91 feet; the 1,100
leaving (lie boundary of said Reserved Tract B, S52"08'06"W, 209.01 feet to
a point on the southerly boundary of said Reserved Tract B; thence
S52'54'07"W, along the southerly boundary of said Reserved Tract B, 205.46

SECTION 2. This ordinance shall be in full force and effect from and
after its passage and approval.
SECTION 3. An amendment to the Comprehensive Plan Development Plan Map is
hereby endorsed to reflect the changes necessary for the area described in Section 1 .

In the 3500 Block of Chapel Hill Road
The City Council of the City of Jefferson, Missouri, will hold a public hearing on
Monday, September 15, 2003, at 6:00 p.m. in the Council Chamber of the John G. Christy
Municipal Building, 320 East McCarty Street, to consider the rezoning and associated
amendment to the Development Plan Map of the City's Comprehensive Plan for 1.42 acres
located in the 3500 Block of Chapel Hill Road, as follows:
A part of Reserved Tract B of Chapel Hill Commons Section Four, a plat
record in Plat Book 12, page 348,Cole County Recorder's Office, being a part
of Fractional Section 4, Township 44 North, Range 12 West, Cole County,
Missouri, more particularly described as follows: BEGINNING at the

regarding this request. Mr. Bates stated that the proposed dovolopment is a mixed use., on the north
edge of the City, including commercial, 2-unit tOW1111011le'S and [NOPOSed multi-family. The proposed
rezoning request is for an irregular shaped piece of property, which would allow all of the property
fronting on Chapel Hill Road to be contig(JOLIS c-Ind CO11t1('K10U,'-,, in its zoning character and allow for
compatible development of the site.

Mr. Harness stated that the only type of development that can go in the irregular shaped piece of property
is commercial or residontial.

recommendation.
Notification was gent by letter to adjacent and affected prof:)erly owners within 155 feet arid by

Mr. Bickel moved and Mr. Lake seconded to approve the map amendmenit to the Comprehensive
Plan changing the designation from Commercial and Industrial to High Density [Residential for the 3500
Block of Chapel Hill [-load. The motion passed 5-0 with the following votes:
