SPONSORED BY COUNCILMAN Councilmen Ferguson Groner ORDINANCE NO. =V _ AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE PERTAINING TO LIGHTING STANDARDS ON EAST HIGH AND EAST CAPITAL STREETS, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1 . Chapter 32 (Streets and Subdivisions), Article IV (Construction of Sidewalks, Curbs, etc.), Division 2 (Duties and Responsibilities of Property Owner) is hereby amended by adding a new subsection as follows: Sec.32-102. Privately owned,operated, and maintained pole lighting. A. Upon proper III)piicaIion for Permissive Ilse of Rig ht-of-«'ay and approval of the Cily Cowicil, privately owned,operated and maintained pole lighting may he installed on the City right-of- way. All expenses,such as cost of lighting,installation,maintenance,will power shall be al the expense of the owner. 13. If the owner fails to properly install,opera(e,or maintain the pole lighting, the Director of'the Departrrrenl of C'onununity 1)evelopnren( (Director) may live seven days notice to the owner to correct any defleleucies. If the deficiency Is not corrected within seven days or reasonable steps to effectuate it correction arc not commenced mill diligently pursued within said seven-day period,the pole lighting may be removed by the City at the expense of the owner and permissive use of right-of-way may be revoked. If the Director determines that the condition of the pole lighting constitutes it hazard to public safety, file City niay remove the pole lighting without advance noliee to the owner and at the osvoer's expense,and the permissive use of the riglat-of- way may be revoked. 1).
