AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND
APPROVING THE FINAL PLAT OF JULMAR SUBDIVISION, SECTION THREE, A
SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI,
WHEREAS,Tom D. Smith and Jeanette A, Smith, owners of the real estate hereinafter
described, having submitted to the City Council a plat of said real estate, being located in
Jefferson City, Cole County, Missouri, and more particularly described as follows:
Part of the West Half of the Southwest Quarter of Section 3, Township 44
North, Range 12 West, in the City of Jefferson, Cole County, Missouri, more
particularly described as follows: From the southwesterly corner of Lot 7 of
JULMAR SUBDIVISION, SECTION TWO, as per plat of record in Plat Book 12,
page 103, Cole County Recorder's Office; thence southwesterly, along the
northerly right-of-way line of WEST TRUMAN BOULEVARD, on a curve to the
right, having a radius of 5689.62 feet, an arc distance of 426.79 feet,
(Ch=S57°55'04"W, 426,69 feet) to the POINT OF BEGINNING for this
description; thence continuing along said northerly right-of-way line,
southwesterly on a curve to the right having a radius of 5689.62 feet, an arc
distance of 150.00, (Ch=S60 049'19"W, 150.00 feet): thence N25"56'39"W,
274.69 feet to the center of an existing 10 foot wide Sanitary Sewer Easement
as described in Book 271 , page 149, Cole County Recorder's Office; thence
N670131 6 E, along the center of said Sanitary Sewer Easement, 150.00 feet;
thence S2505627"E, 257.94 feet to the point of beginning. Containing in all
0.92 acres.
WHEREAS, it appearing that said plat has been fully and properly signed and
accepted by the owners of said subdivision, known and referred to as the Plat of Jtalmar
Subdivision, Section Three, that all taxes have been paid, and that in all respects the
requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with by the
owners of said subdivision, and that in all respects the requirements of the Planning and
Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions have
been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
SECTION 1. That portion of the plat of Julmar Subdivision, Section Three, lying, being
and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said
plat attached hereto and made a part of this ordinance, is hereby approved and accepted by
the City Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby M10101'iz_ed and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the
City of Jefferson.

its passage and approval.

Three. The subdivision proposes one(1)lot upon 092 acres,and is zoned PUD,Planiled Uillt Dc%,clopincill.
The subject property is located in the Southwest Quarter of Section 3,'Township 44 North, Range 12 West.

The subject property is located west of Julmar Subdivision Sections One antl Two, in the 3200 Mock
of West Truman Boulevard. The Planning and'Zoning Commission originally approved the lien irllintary flat
for Julmar Subdivision on August 13, 1996. A revised preliminary plat was approved by the Planning anti
Zoning Commission on September 10, 1996.
To date, the following Sections of Julrnar have been approved:

On February 11, 1999 the Planning and Zoning Commission approved a rezoning of approxl nlatcly
3.47 acres on the corner of West Truman Boulevard and North Ten Mile Drive that comprises Lots 1 -5 of'
Julmar Section One and Lots 6 and 7 of Julmar Section Two from PUD, Planned Unit Development to C'-C),
Office Commercial. The proposal was subsequently approved by the City Council on April 19, 1999 by
Ordinance No. 12913.
Current Proposal for Julmar Subdivision, Section Three
The Final Plat of Section 'Three proposes to continue with the Construction o1' a conlnlercial
subdivision containing one lot 0.92 acres, all zoned PUD, Planned Unit Development. Acccss for the
subdivision is available frorn West Truman Boulevard, and the lot has street li•ontage to West Truman
Boulevard. The proposed Final Plat does conform to the approved Revised Preliminary I'lat of A111llar
Subdivision.
Section 33-8 ol'the Subdivision Code. Rewarding Final Plats
All items required by Section 33-8 Final Plat Contents have been addressed on the Final Plat anti the
Final Plat general ly conforms to the approved Revised Preliminary Plat. All information pertinent to review
by Planning staff have been addressed. No improvements plans were required as the infrastrucnn-e is
existing.

Section 33-9 of the Subdivision Code Construction of Sidewalks
The construction of sidewalks does not apply to this subdivision as there are no revisions to the
preliminary plat required and the plat was approved by the Planning and 'Zoning Commission prior to the
passage of the sidewalk ordinance.
Recommendation;
Planning staff recommends approval of the Final Plat of Julmar Subdivision, Section Three, subject
to recommendations from Engineering Division.

COMMENTS:
The l ngineering Division has done a technical review ofthe linal plat as submitted by Central
Missouri Professional Services, Inc. All items concerning Engineering Division review in Section
33-8. of the Subdivision Code pertaining to final plat contents have been addressed on the latest
submittal of the final plat. The following comments are regarding this review;
Regarding infrastructure;
I. xisting street, storm sewer, and sanitary sewer infrastructure are in the vicinity of the
proposed development.
A site plan will be necessary to consider how any future development will tic; to these
existing facilities.
Regarding traffic impact;
West Truman Blvd. is classified as a minor arterial roadway from U.S. Highway 50 to MO
Route 179 (Classification is from the List of Functional Roadway Classification for
Jcarson City, dated April 12, 2000).
The speed limit flor West "Truman Blvd. is 40 mph.
ADT (average daily traffic) infbrmation available for West 'Truman 131vd. east of Schumate
Chapel Road is 13338 vehicles per day. (Source is MODOT 'Traffic Count Summary for
.10'erson City, 2002).
The proposed development is within an existing office area.
Width of West TrUillan 131vd. is approximately thirty-eight (38) feet from curb to curb.
Access for the proposed development will occur as per previous agreement, one (1)
private drive access per 200 linear feet of road frontage. See the note included upon the
face of the plat Ibr more information.
