PROFESSIONAL SERVICE CONTRACT FOR
ENGINEERING SERVICES
WHEREAS, there exists a need for professional services to investigate sewer
surcharge problems in the Herman Street area; and
WHEREAS, engineering services are a professional service exempt from the
requirement of public bidding pursuant to NJSA. 40A: 11-5 (1) (a); and
WHEREAS, the Local Finance Officer has certified that funds are available.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve the appointment of Killam Associates
at a maximum cost not to exceed $3,000.00 billable hourly rate according to rate
schedule.
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract.
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with NJS.A. 40A:11-5 (1) (a) due to the specialized and
professional nature of the services provided.
IT IS FURTHER RESOLVED that a notice of this action shall be published in the
Home News Tribune on May 26, 1998.

$3,000.00
THE INDEM/~IFICATION AGREEMENT ON THE REVERSE OF THE PIRCHASE ORDER SHALL BE LIMITED T(
THE VENDOR'S NEGLIGENT OR WRONGFUL ACTS.
According to the terms set forth ~n Re~olution., and Purchase Order 98-1315.
