HomeMy Public PortalAboutOrdinance No. 862-99 05-25-1999 • ORDINANCE NO. 8 6 2- 9 9 AN ORDINANCE AMENDING SECTION 9 "PLANNING AND ZONING COMMISSION" OF CHAPTER 13 "ADVISORY BOARDS" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, AS AMENDED; AMENDING SUBSECTION "A" THEREOF TO PROHIBIT MEMBERS OF THE PLANNING AND ZONING COMMISSION FROM SERVING, CONCURRENTLY, ON THE RICHLAND HILLS BOARD OF ADJUSTMENT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, after study, has determined that the health, safety and general welfare of the citizens of the Richland Hills would be best served if members of the Richland Hills Planning and Zoning Commission did not, at the same time, also serve on the Richland Hills Board of Adjustment; and WHEREAS, the City Council has further determined that current, existing members of each of these boards should be exempt from this prohibition. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: • I. That Subsection A "CREATION; QUALIFICATION OF MEMBERS" of Section 9 "PLANNING AND ZONING COMMISSION" of Chapter 13 "ADVISORY BOARDS" ofthe Code of Ordinances of the City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: A. CREATION; QUALIFICATIONS OF MEMBERS There is hereby created the Richland Hills Planning and Zoning Commission. Members ofthe commission shall be registered voters and residents ofthe city on the date of their appointment. No member may serve in any capacity on more than one other Richland Hills standing board, commission and committee, or any special committee exceeding six month's duration; or serve as city representative to a local, state or national organization. No member appointed to the commission on or after May 25, 1999, may, at the time of such appointment or during the term thereof, concurrently serve as a member of the Richland Hills Board of Adjustment. All members shall serve without compensation. No debts of any kind or character shall be made or incurred by the board or by anyone acting in its behalf. • ORDINANCE NO. PAGE 1 i II. • Severabilit Clause. That it is hereb declared to be the intention of the City Council that y Y the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
