HomeMy Public PortalAboutORD13506 BILL NO, SPONSORED BY COUNCILMAN ORDINANCE NO._ AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, TRANSFERRING LAND AND ESTABLISHING PORTIONS OF CITY OWNED LAND AS PARK PROPERTY. WHEREAS, since 1917 the City of Jefferson, by and through its Park Board and Parks and Recreation Commission have systematically acquired various parcels of property which comprise the public,parks and recreation area known as Oak Hills Golf Center at Hough Park; and WHEREAS, in 1961 the City procured a 2.7 acre portion of the Hough Park property as a site for City Fire Station No. 4; and WHEREAS, in 1989 the City acquired two additional parcels totaling approximately 3 acres adjacent to and in close proximity to Hough Park for stormwater purposes from MoDOT which involved trading a 3.25 acre portion of Washington Park to MoDOT; and WHEREAS, in 1989 the City acquired an additional 2.21 acre adjacent parcel from Lloyd Kempker for stormwater purposes; and WHEREAS, two stormwater detention basins were subsequently constructed utilizing portions of the three acquired tracts as well as a portion of Oak Hills Golf Center at Hough Park property; and WHEREAS, in 1995 the Parks and Recreation Commission acquired 29 acres of additional land surrounding and adjacent to these two stormwater detention basins from MoDOT by combination purchase and trade of an additional 4.55 acre portion of Washington Park for the purpose of expanding and improving Oak Hills Golf Center at Hough Park; and WHEREAS, in 2001 the Parks and Recreation Commission adopted a Master Plan for specific golf course improvements to address public safety problems and enhance customer services to the golfing public; and WHEREAS, funding to initiate implementation of the Oak Hills Golf Center Master Plan was approved by voters in Novernber 2001 as a part of the Capital Improvements Sales Tax Program; and ® Bill 2002-142 Page t WHEREAS, Master Plan improvements require the use of undeveloped portions of the above properties previously acquired for stormwater and fire station purposes; and WHEREAS, designation of portions of the stormwater and fire station sites for public park and recreation purposes will not diminish their continuing simultaneous use for stormwater and fire purposes; and WHEREAS, the Parks and Recreation Commission desires designation of portions of these parcels for park and recreation purposes prior to the investment of substantial public funds for improvements. NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. That real property acquired by the City of Jefferson from Lloyd Kempker described as follows: Part of the Southeast Quarter of the Northeast Quarter of Section 24, Township 44 North, Range 12 West, in the City of Jefferson, County of Cole, Missouri; being more particularly described as follows: From the Southeast corner of the Southeast Quarter of the Northeast Quarter of said Section 24; thence 86"40'48"W along the South Line of the Southeast Quarter of the Northeast Quarter of said Section 24, 676.78 feet to the Southeast corner of a tract as described in Book 158, Page 94, of the Cole County Recorder's Office, the POINT OF BEGINNING for this description; thence continuing N86 040'48"W along the aforementioned South Line of said Quarter Quarter Section, 410.00 feet; thence leaving said South Line on a bearing of N08 023'20"W, 226.66 feet to the North Line of said tract in Book 158, Page 94; thence S86 047'26"E along said North Line, 456.95 feet to the Northeast corner of said tract in Book 158, Page 94; thence S03 033'55"W along the East Line of said tract in Book 158, Page 94, 222.82 feet to the POINT OF BEGINNING. Containing in all, 96.406.080 square feet(2.213 acres); and which is designated as Parcel 1 on Exhibit A attached hereto, be and hereby is designated for public park and recreation purposes by the City of Jefferson. Section 2. That real property acquired from the Missouri Department of Transportation (MoDOT) by the City of Jefferson described as follows: A tract of land which is a portion of the tract described in Book 190, page 518, of the Cole County Recorder's Office, being situated in the Southeast Quarter of the Northeast Quarter of Section 24, Township 44 North, Range Bill 2002-142 Page 2 12 West, in the City of Jefferson, County of Cole; Missouri, being more particularly described as follows: Beginning at the Southeast corner of the Southeast Quarter of the Northeast Quarter of said Section 24; thence N04 0181 3"E along the East Line of said Section 24, 460.00 feet; thence leaving the East Line of said Section 24 on a bearing of S32 015'21"W, 290.00 feet; thence S29°23'43"E, 245.00 feet to the POINT OF BEGINNING; and which is designated as Parcel 2 on Exhibit A attached hereto. AND; A tract of land which is a portion of the tract described in Book 190, page 518, of the Cole County Recorder's Office, being situated in the Southeast Quarter of the Northeast Quarter of Section 24, 'Township 44 North, Range 12 West, in the City of Jefferson, County of Cole, Missouri, being more particularly described as follows: From the Southeast corner of the Southeast Quarter of the Northeast Quarter of said Section 24; thence N86 040'48"W along the South Line of the Southeast Quarter of the Northeast Quarter of said Section 24, 676.78 feet to the Southeast corner of a tract as described in Book 158, Page 94, of the Cole County Recorder's Office, thence NO3 033'55"E along the East Line of said tract, 222.82 feet to the Northeast corner thereof; thence N86047,26"W along the North Line of said tract in Book 158, Page 94, 186.95 feet to the POINT OF BEGINNING for this description; thence continuing N86 047'26"W along said North Line, 240.00 feet; thence leaving said North Line on a bearing of N10°17'26"W,70.00 feet; thence N20 042'34"E, 90.00 feet;thence N01°47'26"W, 190.00 feet; thence N30 017'2.6"W, 90.00 feet; thence S80 017'26"F_, 80.00 feet; thence N39 012'34"E, 85.00 feet; thence S03 017'26"E, 140.00 feet; thence S78 017'26"E, 25.00 feet; thence S26°17'26"E, 125.00 feet, thence 5110,1726"E, 95.00 feet; thence S33 050'38"E, 50.00 feet; thence S02 050'49"E, 95.00 feet to the POINT OF BEGINNING; and which is designated as Parcel 3 on Exhibit A attached hereto, be and hereby are designated for public park and recreation purposes. Section 3. That a portion of real property acquired by the City of Jefferson from the Hough Club being more particularly described as follows: Beginning at the intersection of the northwesterly line of Chestnut Street and the north and south range line between Ranges 11 and 12, which point is also 1882.6 feet south of the northeast corner of Section 24, Township 44, Range 12 and is also 2209 feet north of the southeast corner of the northeast quarter of the southeast quarter of said Section 24, Township 44, Bill 2002-142 Page 3 Range 12; thence north 3 degrees west, along and with the said Range Line, 211.25 feet, more or less, thence south 74 degrees 13 minutes east, 140.51 feet more or less, creating a parallel plane approximately 100 feet south of the rear of the existing Fire Station ff4 building, thence south 35 degrees 43 minutes west, along and with the northwesterly line of Chestnut Street, 212.49 feet, to the point of beginning; containing .34 acres and designated as Parcel 4 on Exhibit A attached hereto, be and hereby is designated for public park and recreation purposes. Section 4. That the properties or portions of properties set out in Sections 1, 2 and 3 above are hereby transferred to the Parks and Recreation Commission of the City of Jefferson, which is further charged with responsibility for their care for public park and recreation purposes in accordance with Article VI, Section 6.2, Paragraph B of the Charter of the City of Jefferson, Missouri. Section 5. That the Council reserves the right to retain and utilize any and all parts of existing utility easements and shall remain responsible for the maintenance, repair and improvement of detention basis dams and stormwater control structures on these sites. Section G_ That the Mayor and Clerk are authorized to execute any documents necessary to carry out the intent of this ordinance. Section 7.
