FOR THE MUNICIPAL SERVICE OF JEFFERSON CITY, MISSOURI PERTAINING 1'0 MILITARY LEAVE. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1 , Section 14-3, Military leave, of the Personnel Policy Manual for the municipal service of Jefferson City, Missouri, is hereby amended as follows: Section 14-3. Military leave. (a) Eligibility, Employees who enter the active uniform service of the United States, drafted into such service, or employees subject to compulsory service who voluntarily enlist, shall be granted a military leave of absence without pay to extend to three (3) months beyond the date of termination of active uniform service. The term "uniform service" as used herein shall include the Army, Navy, Air Force, Marine Corps, Coast Guard, and Public Health Service as well as all auxiliary branches of said services in which either men or women shall be called on to serve, but shall not include services as civilian employees of any of the services. arc terms- atiar�af errter�er�ey" as-trssed-hefeitr-thall-exist -f#tt tit aeffi--permed-as-detem�i�r�e!-t�q-t+ -feder�rt glovern _ (b) Restoration An employee returning from military leave shall be entitled to restoration to his forme! position provided he makes application within three (3) months after his release fi om duty and has been honorably discharged and he is physically and mentally capable of performing the duties of the position involved. In the event that the position he vacated no longer exists at the time he qualifies for return to work, such person shall be entitled to be reemployed in another existing position of the same class. (c) Salary Supplementation While on Active Duty. An employee who receives orders to report for military service shall be eligible to receive supplementation payments from the City under the following circumstances: 1. The orders are for a period of at least ninety (90) days. 2. The amount of military pay and allowances received,exclusive of any amounts paid to the employee for dutv-related risks, such as hazardous duty pa is less than the amount th„ a em�loXee is are d by the Cam. In calculatinq any pay differential the tax consequences of the pay and allowances shall be taken into account. • 3. The right to receive supplemental pay shall extend for a period of up to twenty four months while on active duty for any single riod of active chit sx - ervice. The remainder of military leave pursuant to treat p9rjd of pct p duty service shall be without pay. 4. The employee provides written documentation of all military pay to the City, including written authorization sufficient to permit the City to obtain verification from the military. The City pay does not intend to provide any City benefits other than those covered by federal or state law except as set out in this section. (-e)(d) Sala_Ueon Return to Work. An employee returning from military leave may be. reemployed at the salary he had attained when granted a military leave plus any general increases granted to all employees. He may be eligible for a merit increase upon completion of one (1) year of service which shall include his time between his last merit increase and the date military leave was granted to him. (d)(e) Disposition of vacation and sick leave. An employee who leaves the municipal service directly for such military leave may elect to be paid for any accrued vacation as he may be entitled to if he were actually separating from the city service. His decision shall be noted on the personnel action form effecting the leave. If the employee elects not to be paid for vacation leave, accrued vacation credits shall be reinstated upon return of the employee. Accrued sick leave shall be reinstated upon return of the employee in either case. Section 2. Section 14-4. Military training leave of absence, of the Personnel P I' o icy Manual for the municipal service of Jefferson City, Missouri, is hereby amended by the additions and changes as follows: Section 14-4. Military training leave of ahsence. (a) All employees who are or may become active members of the National Guard,the Officers' Reserve Corps,or the Enlisted Reserve Corps of the United States Government shall be entitled to leave of absence with pay from their respective duties on all days during which they are employed will) or without pay under the orders or authorization of competent authority on active training duty, duty with troops, field exercises, or instruction for a period not to exceed a total of fifteen(15)eafUTTUCff-Uaps one hundred twenty(120) working hours in any one (1) Federal fiscal year(Oct. 1 - Sept. 30). Employees requesting this leave of absence, with or without pay, shall provide documentation of the orders or authorization of competent authority for the time period for which military leave will be taken. (b) All employees who are or may become active members of the National Guard,the Officers' Reserve Corps,or the Enlisted Reserve Corps of the United States Government who are required to attend monthly training sessions which conflict with their normal work schedules shall give advance notification to their supervisors in accordance with departmental rules and regulations.
