AN] ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND
APPROVING THE FINAL SUBDIVISION PLAT and FINAL.PUD PLAN OF HATTING PLACE,
A PLANNED UNIT DEVELOPMENT AND SUBDIVISION OF THE CITY OF JEFFERSON.
WHEREAS, Raymond M. Bax, Robert M. Rackers arid Richard L Samson, doing
business as BSR, L.L.C., a Missouri Limited Liability Company and owners of the real estate
hereinafter described, having submitted to the City Council a final subdivision plat of said real
estate, being located in Jefferson City, Cole County, Missouri, and more particularly described
as follows:
Part of the Southeast Quarter of the Southwest Quarter of Section 2 and part of the
Northeast Quarter of the Northwest Quarter of Section 11, Township 44 North, Flange
12 West, in the City of Jefferson, Cole County, Missouri, more particularly described
as follows: BEGINNING at a concrete monument marking the northeast corner of the
Northwest Quarter of said Section 1,11; thence S4"55'49"E, along the Quarter Section
Line, 245.19 feet to a point intersecting the northerly line of the U.S. Highway 50 right-
of-way; thence along said right-of-way line the following courses: Westerly on a curve
to the left, having a radius of 3014.95 feet, an arc distance of 168.10 feet, (Chord:
S62°00'40"W, 168.08 feet); thence S70"20'49"W, 222.32 feet; thence S59"58'54"W,
512.95 feet; thence Westerly on a curve to the right, having a radius of 5539.64 feet,
an arc distance of 0.37 feet, (Chord: S59"59'0'1"W, 0.37 feet) to a point on the westerly
boundary of a tract described by deed of record in Book 429, page 159, Cole County
Recorder's Office and said point being the southeasterly corner of a tract described by
deed of record in Book 315, page 208, Cole County Recorder's Office; thence leaving
the northerly line of the aforesaid U.S. Highway 50 right-of-way, along the boundary
of said tract described in Brook 429, page 159, the following courses: 1\15-1615"W,
along the easterly line of said tract described in 315, page 2.08, and along the easterly
line of Shellridge East Subdivision plat of record in Plat Book 8, page 71 and along the
easterly line of other tracts described by deeds of record in Book 211, page 553, Book
214, page 669, Book 389, page 679, Book 368, page 69, Book 290, page 452, Book
405, page 339 and Book 318, page 674, Cole County Recorder's Office, 1379.87 feet
to a point on the southerly line of a tract described by deed of record in Book 204,
page 554, Cale County Recorder's Office; thence N86"291 7"E, along tile southerly
line of said tract described in Book 204, page 554, 737.57 feet to a point on the
westerly line of a tract described by deed of record in Book 202, page 624, Cale
County Recorder's Office,and re-described in the boundary line adjustment agreement
of record in Book 314, page 674, Cole County Recorder's Office; thence S5"03'57"E
along said re-described line, 774.54 feet; to a point intersecting the south line of the
Southeast Quarter of the Southwest Ouarter of the aforesaid Section 2; thence
N86"06'19"E, along the, Section Line, 103.60 feet to the point of beginning.
Containing 21.04 acres.
WHEREAS, it appears that said plat has been fully and properly signed and accepted
by the owners of said subdivision, known and referred to as the Final Plat of Hatting Place
Subdivision, that all taxes have been paid, and that in all respects the requirements of
Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owners of said
subdivision, and that in all respects the requirements of the Planning and Zoning Commission

of the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with;
WHEREAS, it appears that the procedures set forth in the zoning code relating to

zoning have in all matters been complied with, as said property owners submitted to the
Planning and Zoning Commission and City Council a Final PUD Plan for 14.73 acres
previously rezoned to PUD by Ordinance No. 13384 on June 3, 2002 and described therein.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Hatting Place, lying, being and
situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said
plat attached hereto and made a part of this ordinance, is hereby approved and accepted by
the City Council of the City of Jefferson, Missouri.
SEC-rIOrq 2. That a Final PUD Plan is hereby approved for proposed Lot 11 of
Hatting Place as shown on the Final PUD Plan attached hereto and made a part of this
ordinance, with permitted land uses to consist of 50 dwelling units in 25 attached or duplex-
style structures, as shown on the Final PUD Plan prepared by Central Missouri Professional
Services Job No. 86-109, revised date April 2003.
SECTION 3. That a Final PUG Plan is hereby approved for proposed Lot 12 of
Hatting Place as shown on the Final PUD Plan attached hereto and made a part of this
ordinance, with permitted land use to consist of six (6) dwelling units in multiple family-style
structure(s), as shown on the Final PUD Plan prepared by Central Missouri Professional
Services Job No. 86-109, revised date April 2003.
SECTION 4. The Mayor and City Clerk are hereby authorized and directed to
endorse acceptance of said subdivision plat thereon and to certify the approval of said plat
under the seal of the City of Jefferson.
SECTION 5. This ordinance shall be in full force and effect from and after the date of
its passage and approval.

SUBMICT: Reserved "Tract A - Hatting Place Subdivision
Meeting in official session on Monday,March 10,2003,the City of.leficrson Parks and Recrcation
Commission took f m-mal action relative to the above parcel of land. Dire to the majority of(lie site being
included in stor•mwater casements, the rugged terrain, and minimal amount of usable space, the
Commission felt that the property offered little in the way of recreation and park development potential
to serve the neighborhood and would constitute an unjustifiable drain upon an already inadequate
maintenance budget.
The Commission voted unanimously to at this time decline the developers' offer to donate the
parcel to Parks and Recreation. The Commission may at some point reconsider if the parcel could be
linked to the greenway trail system along the north branch of Wear's Creek.

REF: Conveyance of right-of-way for extension of Country Club Drive (outer roadway)

Dear Mr. 5chwarize:
The City of Jeffe,rson would like to request that the right-of-way necessary for the
extension of and improvement of the outer roadway, locally known as Country Club Drive, be
transferred to the City of Jefferson. The limits of this request are as shown on the
attached exhibit.
As in previous discussions with members of your staf f, this extension and improvement would
serve the proposed development known as "Hatfing Place". In the post, the Commission had
previously "quit-claimed" to the City of Jefferson the right-of-way of Country Club Drive
from Rte. 179 east to the west end of that as requested above,as referenced in an attached
copy of the "QUITCLAIM DEED".
Your consideration and a favorable recommendation for the granting of this request is
appreciated, If you should need additional information, please advise.
