ORDINANCE NO.
AN ORDINAN^E OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING CERTAIN
EASEMENT RIGHTS FOR COMBINATION SANITARY SEWER AND GENERAL UTILITY
PURPOSES ACROSS A PART OF LOT NOS. 49 AND 50 OF SCHOTTHILL WOODS
SUBDIVISION, SECTION ONE,
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS:
WHEREAS, by an easement recorded in Book 11, Page 145, of the Records of the Cole County,
Missouri, a combination sewer and general utility easement was granted to the City of Jefferson,
a Municipal Corporation, to excavate within, install, construct, maintain and repair structures for
the routing and conveyance of sewer in, under and through the lots, tracts or parcels of land
described in Section 1;
Section 1. The Council finds that the following described easement is surplus property of
the City and is no longer needed for any public purpose:
A part of a sanitary sewer and general utility easement across part of Lot Nos. 49
and 50, of Schotthill Woods, Section One, as per plat of record in Plat Book 11,
Page 145, of the Cole County Recorder's Office; being more particularly described
as follows:
BEGINNING at the northeast corner of said Lot No. 50, said corner also being the
southeast corner of said Lot No. 49; thence N34053'1 6"W, along the easterly line
of said Lot No. 49, 33.75 feet, to a point on the easterly line of Lot No. 66, of
Schotthill Woods, Section Two, as per plat of record in Plat Book 11, Page 324, of
the Cole County Recorder's Office; thence S1 7"32'25"W, along the easterly line of
said Lot No. 66, 83.83 feet; thence leaving said easterly line on a bearing of
S24 008'48"E, 104.63 feet; thence N79°07'28"E, 14.37 feet; thence N78"17'53"E,
22.89 feet, to a point on the east line of aforementioned Lot No. 50; thence
N13°53'14"W, along the east line of said Lot No. 50, 144.63 feet to the POINT OF
BEGINNING. Containing in all, 7,065.52 square feet, more or less.
Section 2. The easement described in Section 1 is hereby relinquished, and the City does
hereby release and abandon whatever interest it has in the easement.
Section 3, The Mayor and City Clerk are hereby authorized to execute any necessary legal
document relinquishing all of the City's interest in the tract of ground described in Section 1.
Section 4. This Ordinance shall be in full force and effect from and after the date of its
passage and approval.
