AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A SPECIAL EXCEPTION USE FOR A CLUSTER SUBDIVISION AND ACCEPTING AND APPROVING THE REPLAT OF LOTS 1 , 2, 3, 4 AND 5 OF WASHINGTON PARK ADDITION-BLOCK 24, A CLUSTER SUBDIVISION OF THE CITY OF JEFFERSON. WHEREAS, River City Habitat for Humanity, owners of the real estate hereinafter described, having submitted to the City Council an application for a special exception use for a cluster subdivision and final plat of said real estate, being located in Jefferson City, Cole County, Missouri, and more particularly described as follows: All of Lot No's. 1, 2, 3, 4, and 5 of Washington Park Addition, Block 2.4, as per plat of record in Plat Book 2, page 3 Cole County Recorders Office and part of vacated Oregon Street right-of-way, as per Ordinance No. 13545, b.482, p. 864, property description more particularly described as follows: Beginning at the northwesterly corner of said Lot No. 1 , thence S70"16'39"E along the northerly line of said Lot No. 1 and the easterly extension thereof, 180.00 feet to a point on the easterly right-of-way line of said vacated Oregon Street; thence S19 55'31"W along the easterly right-of-way line of said vacated Oregon Street 236.96 feet to a point on the southerly boundary line of said Washington Park Addition; thence N87004'1 7"W along the southerly boundary line of said Washington Park Addition, 188.22 feet to the southwesterly corner is of Lot No. 5 of said Block 24; thence N 19 05631"E along the westerly line of said Lot No's. 5, 4, 3. 2, and 1 of said Block 24, 2.91 .34 feet to the point of beginning and containing 1 .09 acres. WHEREAS, it appears that said plat has been fully and properly signed and accepted by the owners of said subdivision, known and referred to as the Replat of Lots 1 , 2, 3, 4 and 5 of Washington Park Addition-Block 24,a Cluster Subdivision, that all taxes have been paid, and that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owners of said subdivision, and that in all respects the requirements of the Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with. WHEREAS, it appears that in all respects the requirements of Section 35-54 of the Jefferson City Zoning Code pertaining to Cluster Subdivisions have been complied with. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1 . That portion of the plat of the Replat of Lots 1 , 2, 3, 4 and 5 of Washington Park Addition-Block 24, lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat attached hereto and made a part of this ordinance, is hereby approved and accepted by the City Council of the City of Jefferson, Missouri as a cluster subdivision. The Mayor and City Clerk are hereby authorized and directed to endorse acceptance of said plat hereon and to certify the approval of said plat and cluster subdivision under the seal of the City of Jefferson. Respectfully Submitted, Daniel Klindt hifth Ward Councilman Memorandum Late: May 28, 2003 To: Mayor John Landwehr City Council From: Janice McMillan, Senior Planner Re: Bill No. 2003-21 (Bills Pending) Request for Change of Street Name as Shown on Proposed Plat Habitat for Humanity Replat of Lots 1-5 of Block 24, Washington Park Addition River City Habitat for Humanity has requested in a memo addressed to me on May 28, 2003 that the name of a street in the above referenced subdivision be changed. The subject plat currently shows"Pike Court,"as the name of the new street; River City Habitat for Humanity proposes the name of this street be changed to "Coplen Court." Please see the letter from Ron Hansen, President of River City Habitat for Humanity. Since "Pike Court" is a proposed new street on the subdivision plat, the name of street is assigned on the subdivision plat. A change in the name of this street could be proposed as an amendment to the plat when this bill is brought up for final reading on June 2, 2003. County of Cole, City of Jefferson and E-911 staff have discussed this proposed change and have indicated the proposed change to "Coplen Court"would not duplicate an existing street name, and as such, do not object to the proposed name change. IZoy Coplen has provided countless volunteer hours to our organization and has been the primary site and construction supervisor for a majority of the 36 houses that River City I fabitat for Humanity has constructed in Jefferson City.
