HomeMy Public PortalAboutOrdinance No. 867-99 09-14-1999 • ORDINANCE NO. 867-99 AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 844-98 AND THE FISCAL YEAR 1998-99 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 844-98 on September 22, 1998, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 1998-99; and WHEREAS, changed conditions resulted in the adoption of Ordinance No. 856-99 on March 23, 1999, amending the budget adopted by Ordinance No. 844- 98; and WHEREAS, changed conditions and circumstances, which could not have been foreseen through the use of reasonably diligent thought and attention, have necessitated a certain amendment to Ordinance No. 844-98 and the budget adopted thereby; and WHEREAS, a public hearing on the following amendment to the fiscal year 1998-99 budget contemplated hereby has been held as required by law. • NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: That Section II of said Ordinance No. 844-98 be amended to increase the general fund appropriation from $3,538,333 to $3,618,172 with such increase allocated and appropriated as follows: I. $78,839, such sum the surplus from the 1998 General Obligations issue, for transfer to the 1998 General Obligations Interest and Sinking Fund as required by said issuance ordinance for repayment of debt. II. That Section III of said Ordinance No. 844-98 as amended be amended to increase the enterprise fund appropriation from $2,544,570 to $5,301,775 with such increase allocated and appropriated as follows: $2,757,205, such sum the surplus from the 1998 Certificates of Obligation issue, for transfer to the 1998 Certificate of Obligations Interest and Sinking Fund • as required by said issuance ordinance for repayment of debt. That Section V of Ordinance 844-98 be amended appropriating $153,157 out of the 1993 Utility System Revenue Bond Interest and Sinking Fund for the repayment of water and sewer works long-term debt principle and interest. IV. That Section VII of Ordinance No. 844-98 be amended appropriating $23,535 out of the 1994 Personal Property Finance Contractual Obligations Interest and Sinking Fund for the payment of general long-term debt principal and interest. V. That Section VIII of Ordinance 844-98 be amended appropriating $64,680 out of the 1998 General Obligations Interest and Sinking Fund for the payment of general long-term debt principal and interest. VI. That Section IX of Ordinance 844-98 be amended appropriating $306,161 out of the 1998 General Obligation Issue for the payment of construction costs • associated with the new Animal Shelter. VII. That Section X of Ordinance 844-98 be amended appropriating $833,872 out of the 1998 Certificates of Obligation issue for wastewater system improvements. VIII. That Section XVII of Ordinance 844-98 be amended appropriating $287,050 from the Equipment Replacement Fund, $230,101 from the General Fund and $56,949 from the Enterprise Fund, for the purchase of capital assets. IX. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, • sentences, paragraphs and sections of this ordinance, since the same would ORDINANCE NO. 867-99 PAGE 3 have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. X. Saving Clause. That Ordinance No. 844-98 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. XI. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
