AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH CERTAIN AGENCIES FOR LEASE. OF PARKING SPACES. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized and directed to execute an agreement with the Clerk of the United States District Court, Western District, the local U.S. Magistrate, the U.S. Probation Service, and the U.S. Marshal's Office or its security agency, for Lease of parking spaces. Section 2. The agreements shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. EFFERSON MA,S'TE,R PARKING LEArS'E 0THIS PARKING LEASE, made and entered into by and between the City of.lefferson, Missouri ("Lessor"), and the U.S. District Court, 131 West l ligh Street, .lef erson City, MO 65 101 ("Lessee"), for the purpose of renting parking spaces situaled in .leffcrson City, Missouri ("Leased property"), more particularly described its follows: 1. Premises. The Lessor hereby leases unto the Lessee the property identified in Exhibit A. 2. Term. Any concerns of the Lessor regarding the daily operation of this Lease shall be directed to the'Tenant for with the concern applies. 5. Lessee Covenants and Agrces: a. Lessee must use the premises for a parking lot so long as such use shall be deemed feasible by the Lessee,and Lessee shall have the right to assign its rights under this Lease, in whole or in part, to any other governmental agency, subject to the same terms and conditions of this Lease. Lessee may not assign its rights under this Lease to any nongovernmental party without the written consent of the Lessor. 6. Lessor and Lessee understand and agree that this Lease shall not be binding upon the Lessee unless and until general appropriations have been made by the Missouri Legislatureand,if'applicable, funds have been received from the United States Government, for the payment of'rental or for any other payment under this Lease on behalf of the Lessee fOr the fiscal period embracing the initial period or any option period of this Lease. 7. Notice. That any notice provided for herein may be given to the parties by personal service or by regular mail addressed to the Lessor at City of Jefferson, Department of Transportation, Parking Division, 320 East McCarty Street, Jefferson City, Missouri 65101, or the Lessee at U.S. District Court, 131 West I-ligh Street, Jefferson City, MO 65101. Premises. The Lessor hereby leases unto the Lessee the property identified in Exhibit A. 2. Term. The term of this Parking Lot Lease is for the period beginning September 1,2002,and continuing oil it month- to-month basis until such tinle is notice is given as defined in paragraph 7 below or August 31,2004 whichever is sooner. 3. Rental. All rental payments will be made on a monthly basis, payable in arrears upon invoices submitted by Lessor. The price per space shall be as shown on the attached Exhibit A. The montllly total rental shall not exceed $30.00 per space. 4. Lessor Covenants and Agrees: a. Lessor will invoice Lessce only for Bair(4) spaces f'or the billing period. Lessee will notify Lessor of any change in the total number of parking spaces required. b. Lessee shall be deemed to be occupying tine premises as a Lessee on a month-to-month tenancy,with the parties therefore subject to thirty(30)days written notice ofternlination. In addition, Lessor must give thirty(30) days prior written notice to Lessee of any change nil the availability of parking spaces or of any change in tine price per space per month as states on Exhibit A. C. Lessor shall maintain the said property in good repair during the term of all renewal. periods of this Lease. d. Lessor Hurst direct and pay For removal of snow and ice from the sidewalks and parking area by 7:00 a.m. ofeach working clay, or as required throughout the clay; Saturdays and Sundays excluded. e. Lessor must stripe all parking spaces. f. Lessor shall provide handicapped parking spaces in accordance with the American with Disabilities Act Accessibility Guidelines (ADAAG) within its total parking system. Upon request, additional spaces may be added oil lots covered by this agreement. g. Lessor shall provide a well-lighted parking area. h. Lessor shall,so long as Lessee Fully complies with all of the terms and conditions of this Lease,permit the Lessee to peaceably and quietly have, hold and enjoy the premises for the teen of this Lease.
