MINUTES OF THE SELECT BOARD EXECUTIVE SESSION MINUTES
DATE . April 6, 2021
TIME $ 9 : 00 AM
PLACE . Remote Teleconference
ALL PARTICIPANTS ARE PARTICIPATING REMOTELY : Chair Chaffee , Selectperson Whitney,
Selectperson Bingham , Selectperson deRuyter, Selectperson Chatelain , Town Administrator Peter
Lombardi , Assistant Town Administrator Susan Broderick
Call to Order & Declaration of a Quorum Meeting Participation Statement and Recording Statement
Chair Chaffee called the meeting to order at 9 : OOam , conducted a roll call vote of attendance,
declared a quorum present, and read the meeting participation and recording statements .
Chair Chaffee stated that the Board would be going into executive session to consider the purchase ,
exchange, lease or value of real property if the chair declares that an open meeting may have a
detrimental effect on the negotiating position of the public body . As well as the approval of
February 2 and 16, 2021 Executive session meeting minutes . The Board will not be returning to
open session .
Selectperson Bingham moved to enter executive session . Selectperson Chatelain second . A roll call
vote was taken . Selectperson deRuyter„ yes, Selectperson Bingham -yes, Selectperson Whitney„ yes,
Selectperson Chatelain -yes , Chair Chaffee - yes . The Board vote was 5 -year, 0- No .
All members stated , " No other person is present or able to hear the discussion at this remote
location . ”
Executive Session : To consider the purchase , exchange, lease or value of real property if the
chair declares that an open meeting may have a detrimental effect on the negotiating position
of the public body
Peter Lombardi stated that a revised appraisal report has been received on the bay parcel . The
updated value is now approximately $ 18 million , the two additional lots were added . Mr .
Lombardi spoke with the Town Planner and Heath Director to discuss the parcel . The area could
be designated as Open space or rural development . The Open space designation can be met by
three requirements . A large portion of the parcel is within the Conservancy soil overlay district .
There can be no residential or commercial structures built within the overlay district .
The current location of the boat house is the closest area to the bay where a structure could be
built . The appraiser stated that he included the overlay district in consideration of his appraisal ,
although it was not mentioned in his written report .

There was a discussion on whether or not the Zoning Board of Appeals could grant a variance .
That is not know at this time . There are also the septic regulations to consider . They would not
eliminate or prohibit residential development .
In regard to the pond parcel the consideration of waterfront lots is difficult . There could be one or
two waterfront lots . There is a survey on file that stated that the pond parcel is 66 acres, not 70
acres . The Assessor' s office has the lot listed as 70 acres . There is a recommendation to have the
appraisal peer reviewed . The appraisal is based on highest and best use, what could be done by
right . There needs to be one methodology to determine the value of the properties .
Mr . Lombardi stated that there has been a cash, no contingencies offer on the bay parcel for $ 20
million dollars, for single family use, which was rejected . Although this offer cannot be verified , it
is believed that the management company has a higher number in mind .
Mr . Lombardi stated that the Board ' s earlier conversations regarding eminent domain are now
relevant . They must make sure that the by right appraisal is correct . He does recommend that the
appraisal be peer reviewed . Mr . Lombardi stated that he believes that we should continue the
work on the appraisals, get them updated and then have them peer reviewed . The Board was in
agreement with this strategy .
One benefit the Town has is that we are interested in both parcels . The Board was also in
agreement that Mr . Lombardi will attempt to reach out to the family that may have placed an
offer on the bay parcel to try and confirm if there was indeed an offer .
The meeting minutes were not voted on , this will be reviewed at a future meeting . The Board
discussed possible next meeting dates and times .
Selectperson Whitney moved to adjourn at 9 : 58am . Selectperson Bingham second . A roll call vote
was taken . Selectperson deRuyter-yes, Selectperson Bingham -yes, Selectperson Whitney-yes,
Selectperson Chatelain -yes , Chair Chaffee - yes . The Board vote was 5 -yes, 0- No .
