SC"l EIDERS RLZONING REQUES 11' Section 35-74. 11.4 RLVIEW CRITCRIA a, The existing zoning was in error at the time of adoption RESPONSE;: There was no error in the adoption of present zoning map. b. There has been a change in character in the area due to installation of public facilities, other zone changes, new growth trends, neighborhood deterioration,or development transitions. RESPONSE: The area has continued to change in character with the development of the Re/Max office on the West border of the site, and the deterioration of non conforming single family units on the site. • C. There is a community need for the proposed rezoning. RESPONSE Rezoning would allow for infill development and allow consistent compatible development. d. The proposed change is consistent with, and in furtherance of, the implementation of the goals and policies of the Comprehensive Plan, other adopted plans, and the policies, intents and requirements of this Ordinance and other City regulations and guidelines. RLSPONSF: The 1996 Comprehensive Plan update shows the area to be commercial. C. The proposed zoning is compatible with the zoning and uses of property nearby. RESPONSE: The proposed rezoning will establish the entire area north of St. Mary's and West of Heisinger as commercial with the exception of the property addressed as 2310 St. Mary's Boulevard. In accordance with. Section 35-74.B.3.b, (Page 154) we are recommending the staff and Planning & Zoning Committee include 2310 St. Mary's in the area to be rezoned. Page 2 f Public and community facilities,which may include, but are not limited to, sanitary and storm sewers, water,electrical service, police and fire protection,schools, parks and recreation facilities,roads, libraries, and solid waste collection and disposal, are available and adequate to serve uses authorized under the proposed zoning. RESPONSL?: Public and community facilities exist or can be reasonably provided. g. A traffic impact analysis has been provided to indicate the potential number of new trips generated and provisions are provided to mitigate impacts of high traffic-generated projects. RESPONSE: A format traffic impact study has not been performed, however it is not believed the proposed use is a high traffic generator. The facility will employ approximately thirty people. ADT is estimated at less than 200 which the existing street network is capable of handling. 11. Authorized uses shall not adversely affect the capacity or safety of the street network in • the vicinity of the property. RESPONSE: Street network is adequate. i. Potential environmental impacts (e.g.,excessive storm water runoff, water pollution, air pollution, noise pollution, excessive lighting,or other environmental harms) of authorized uses shall be mitigated. RESPONSE: Site is bounded by U.S. 50 4-lane highway on the North and Business 50 on the South. Surrounding development generates significantly greater impact. The proposed use has relatively low level of environmental impact. j. There is an adequate supply of land available in the subject area and the surrounding community to accommodate the zoning and community needs. RESPONSE: The proposed site is significantly larger than the planned facility or community requires. They were relocated in the late 1970s by the Jefferson City Housing Authority from the Mill Bottom area, to the present site on Southridge Drive. In the near,future, they will need to expand beyond the capacity of their present site.
