ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A CERTAIN
EASEMENT FOR SANITARY SEWER PURPOSES IN LOT 150 OF LANDWEHR HILLS.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
WHEREAS, by an easement recorded in Book 231 , Page 705, of the Records of the Cole
County, Missouri, a sewer easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and repair structures for the
routing and conveyance of sewer in, under and through the lots, tracts or parcels of land
described in Section 1;
Section 1. The Council finds that the following described easement is surplus property
of the City and is no longer needed for any public purpose:
A strip of land ten (10) feet of even width across part of Lot 150, Landwehr Hills Subdivision,
Section 3, in the City of Jefferson, Missouri, per the plat of record in Plat Book 7,pages 74 and
75,Cole County Recorder's Office,said ten(10)foot wide strip of land being described in Book
231, Page 705, of the Cole County Recorder's Office; the centerline of said 10 foot strip being
more particularly described as follows:
From the Northeast corner of said Lot 150: thence Westerly along the Northerly lot line a
® distance of 130 feet to the point of beginning for this description; thence deflecting 111030'to
the left, a distance of 156 feet to a point on the Southerly lot line, said point on the Southerly
lot line, said point being 115 feet Westerly of the Southeast corner thereof."
Note: Description in quotes is as appears in the Sanitary Sewer Easement as recorded in Book
231, Page 705.
Section 2. The easement described in Section 1 is hereby relinquished, and the City does
hereby release and abandon whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any necessary
legal document relinquishing all of the City's interest in the tract of ground described in
Section 1.
Section 4. This Ordinance shall be in full force and effect from and after the date of
its passage and approval.
