AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND
APPROVING THE AMENDED FINAL PUD PLAN FOR 1913 ST LOUIS ROAD.
WHEREAS, IT APPEARS THAT THE PROCEDURES SET FORTH IN THE ZONING CODE
RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1 . The following described property is subject to the Amended Final
Planned Unit Development Site Plan described in Section 2:
From the Southwest corner of the Northeast Quarter of Section 16, Township 44N,
Range 11 W; thence north 15 feet to the Point of Beginning for this description: Thence
Easterly 411.7 feet;thence Northerly 605.36 feet;thence Westerly 460.55 feet;thence
Southerly to the Point of Beginning; Except that portion of the property zoned RS-2
Single Family Residential, generally described as the westerly 40 feet, as measured
along the west property line; and the northerly 220 feet, as measured along the
easterly property line.
SECTION 2. The following described Amended Final PUD Site Plan is hereby
approved:
A. Land Use. The use of land and referenced in Section 1 is authorized as vehicle
sales and auto body shop, with the following conditions:
(1) Screen the area between the north and south buildings in accordance with Section
35-41.6.16 (specific recommendation was evergreen planting or fence, 8 feet in
height);
(2) Submit a landscaping plan (and install the trees required for the paved parking lot);
(3) All exterior lighting to be directed in a downward, unobtrusive manner that will not
intrude upon surrounding properties; and limit lighting to that which is in existence.
The Commission asked that proposals for additional lighting be reviewed by the
Commission.
(4) All on-site storage of wrecked or disabled vehicles on the premises shall either
be indoors or outside within an area designated as a drop off and storage area
which shall be screened on at least the west, south, and east sides by dense
evergreen plantings and a fence 8 feet in height. The designated drop off and
storage area shall be located at least 100 feet from the side property line and
275 feet from the front property line. The number of vehicles stored in the drop
off and storage area at any one time shall not exceed twenty (20);
(5) Maintain open driving lanes; driving lanes shall not be blocked by vehicle display;
(6). The auto vehicle sales and auto body use is restricted to the area zoned PUD, and
further restricted to the two eastern-most buildings and area around these buildings
shown on the 1996 aerial.
B. Common Areas, Public Areas. No common areas or dedication of land to the public
is part of the PUD Plan.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Amended Final PUD Plan
The City Council of the City of Jefferson, Missouri, will hold a public hearing on Monday,
October 21, 2002 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building,
320 East McCarty Street, to consider an Amended Final Planned Unit Development Site Plan for
1913 St. Louis Road, such real estate being described as follows:
Property Description:

2. Common areas, Public land. No common area is created by this PUD Plan and no land
is proposed to be dedicated to the public.

Jim and Mary Kay'kinlbkc have contracted to purchase the property known as 1913 St,
Louis Road, currently owned by C:dgar W. ".lake" and Mary Ann Schenewcrk. This application
is made in the alternative to a request to the City Stai'l'lor a determination that the proposed use
of the property does not constitute a change in use. In the event that in aincndnient is required,
the parties request that the property be considered as a C-2 property liir future zoning.
The premises were most recently used by "Town &' County I..awrl & Leisure Equipment
Company who was the John Decrc Equipnlcrit Dealer for Lawn Equipment and "Tractors up to
60hp. They also sold trailers, ATV's and other motorized equipment. Merchandise was
displayed outside in the paved areas of the parking lot. Smaller merchandise was displayed on
the insider of the front of the building. This area was also used for off ice space as well. The real-
,
rea was used for equipment maintenance and repair. A warehouse building in the rear was used
for storage. Ali approximately 36 x 45 fool concrete pad was enclosed by fencing for additional
outside storage of crated merchandise. A 5,000 scparatc ofiicc building is located on the
premises and is rented Out to another company for that purpose. It- use will continue.
Other than the type of equipment displayed outside, (cars and trucks as opposed to lawn
tractors, ATV's and other motorized equipment), the Outside use will remaiil the same. Ail
e estimated inventory of 25-30 cars is expected to be displayed. The irons building will be used in
the same mariner as prior users with the front used for sale of truck accessories and offices for the
auto sales and the body shop. The rear will be used for the body shop operations. There will be
S bays for repairs.
The back hali'of the rear building currently used as a warehouse will continue that use.
The front half will house the frame machine and the paint booth
It is anticipated that there will be three (3) employees in the body shop and two (2) in the
auto sales area. four existing parking spaces will be used for auto sales display. These spaces
will be re-located to (lie approximately 36' x 45' pad at the rear of the lot, which also provides
space for any additional parking spaces needed. Customer barking currently fiaced into the
building, including the handicapped space, will renlain faced into the building except for the two
spaces on the east end which will be used for display.
Signage will renlain the same size, type and location. No additional lights are anticipated
to be installed on the lot.

Dear Ms, McMillan:
We arc in receipt of your notice dated September 3, 2002, regarding the proposed amended
PUD Plan for 1913 St. Louis Road (Case No. P02041). We are the owliers of the duplex
located at 203 Riverview Drive (the corner of St. Louis Road and Riverview Drive) and are
very concerned about the proposed zoning plan change that would allow for the operation of
an auto vehicle sales business and auto body shop at this location. Our tenants will be
unhappy with this type of a commercial business being located in their backyard and should
we decide to live in our duplex in the future, we would not want to live next door to such
businesses either.
Current and past renters have told its that the bright lights from the previous farm machinery
and equipment company disrupted their sleep. They have also told us that alamis frequently
went off as people tampered with the riding lawn mowers and other equipment when the
business was closed. They say they were questioned many times by police as to whether or
not they heard or saw anything.
We can't help but believe that an auto sales lot would bring even more bright and constant
lighting,, increased traffic congestion both during and after hours, people looking at vehicles
on the lot even when it is closed for business, and possibly more theft attempts. It seems that
Jefferson City has been experiencing more auto tampering, vandalism and thefts than ever
before. If the auto body shop is like any other typical body shop, I third:you could expect
noise, traffic, towing of vehicles to the sight (both during and after hours), and loud noise and
odor from the auto repair and painting processes.
We believe the value of our property and the ability to attract renters would be adversely
affected if this change is made. While we did not oppose the daycare that located adjacent to
our property several years ago,we would go on record in opposition to this proposed
amendment. We would be interested in hearing if this change meets with the "city's plan"
that we have heard about.

The Commission will note that the site is surrounded on at least two sides by residential
uses. The other adjoining sites include two, well illailitililled convenience Stores. Landwchr
