HomeMy Public PortalAboutORD13477 BILL_ NO. _ _ 2002-103 SPONSORED BY COUNCILMAN Voael and Smith ORDINANCE NO.___�� AN ORDINANCE OF THE CI-I-Y OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO AND LYING NORTH OF THE PRESENT CITY LIMITS INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN SECTIONS 3, 4 AND 9 OF TOWNSHIP 44 NORTH, RANGE 11 WEST, COUNTY OF CALLAWAY, STATE OF MISSOURI, AND REPEALING SECTION 1-17 OF THE CODE OFTHE CITY OFJEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson was presented with a verified petition requesting that the city annex the unincorporated area of land described in Section 1 ; WHEREAS, the petition requesting said annexation was signed by all fee interests of record in all real property located within the area proposed to be annexed; and WHEREAS, a public hearing concerning the annexation was advertised on November 5, 2002 in the Jefferson City Post Tribune; and NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council intends to and shall proceed to annex, as provided by law, the unincorporated area of land described as follows: Parts of the Southeast Quarter of Section 4, the Southwest Quarter of Section 3 and the Northeast Quarter of Section 9, all in the Township forty-four (44) North, Range Eleven (11) West more particularly described as follows: Beginning at the point where the south bank of Halifax Diversion Channel meets the easterly line of the former M.K.& T. Railroad right-of-way, thence northwesterly, along the easterly line of the former railroad right-of-way to a point which is two hundred fifty (250)feet from the west line of the Southeast Quarter of the Southeast Quarter of Section 4, Township 44 North, Range 11 West, Callaway County, Missouri as measured on a line perpendicular to said west line; thence north, parallel to the west line of the Southeast Quarter of the Southeast Quarter of said Section 4, five hundred twenty- five (525) feet; thence northeasterly on a diagonal to the northeast corner of the Southeast Quarter of the Southeast Quarter of Section 4, Township 44 North, Range 11 West; thence east along the quarter quarter line extended one hundred Gill 2002-103 Page t fifty (150) feet; thence south, parallel to the east line of said Section 4 to the 101 northerly line of a County Road known as Oil Well Road; thence southwesterly, along the north line of said County Road to a point which is three hundred seventy (370) feet from the east line of said Section 4 as measured on a line which is perpendicular to said east line; thence south parallel to the east line of said Section 4 to the south bank of the Halifax Diversion Channel thence southwesterly along the south bank of the Halifax Diversion Channe(to the easterly line of the former M.K.& T. Railroad right-of-way, which was the point of beginning. Containing 27.7 acres. Section 2. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable and necessary to the proper development of the City; and further, did determine the City has the ability to furnish normal municipal services to the area. Section 3. A public hearing was held on November 15, 2002 as provided by law, concerning the annexation of the unincorporated area described in Section 1. Section 4. Section 1-17 of the Code of the City of Jefferson, Missouri is hereby repealed and a new Section 1-17 is hereby enacted, which shall read as follows: Sec. 1-17. City boundaries. The limits and boundaries of the city are extended,defined and declared to be as follows, in the counties of Cole and Callaway, in the State of Missouri: ® BEGINNING in the center of the Missouri River at a point on the northerly extension of the westerly line of Private Survey No.2680; thence southerly along the said northerly extension to the intersection of said northerly extension with the southerly line of the Missouri Pacific Railroad;thence leaving said northerly extension and southeasterly along the said southerly line of said Missouri Pacific Railroad the following courses: on a curve to the right, having a radius of 2338.12 feet, an arc distance of 553.89 feet (the chord of said curve being S81°37'30"E, 552.59 feet;
