HomeMy Public PortalAboutORD13482 BILL NO. 2002-1 't 3 _..� SPONSORED BY COUNCILMAN_ SMITH ORDINANCE NO, / 'Y/(.), %} AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 13.56 ACRES LOCATED EAST OF SOUTHWEST BOULEVARD IN THE 900, 1000 AND 1100 BLOCKS OF SOUTHWEST BOULEVARD AND THE 1000 AND 1100 BLOCKS OF NORTHEAST DRIVE, LOCATED IN SECTION 12, TOWNSHIP 44, RANGE 12 WEST, COLE COUNTY, MISSOURI FROM RA-2 MULTI- FAMILY RESIDEN-rIAL TO PUD PLANNED UNIT DEVELOPMENT AND APPROVING A PUD PLANNED UNIT DEVELOPMENT PLAN FOR THE PROPERTY. WHEREAS, the adoption of Ordinance No. 13361, the Comprehensive Update to the Zoning Code, has created nonconforming commercial uses in the RA-2 High Density/Multi-Family Residential Zoning District previously authorized by conditional use permit; and WHEREAS, the Ordinance No. 13407, adopting a similar PUD Plan for the property addressed as 1101 Southwest Boulevard was previously approved; and WHEREAS, it appears that procedures set forth in the zoning code relating to zoning have in all matters been complied with; NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. Pur ose. _ p Dill 2002-113 Page 2 The purpose of this PUD Plan is to preserve the area's unique development character by continuing with the same or similar types of development originally authorized by a Conditional Use Permit issued for the 1000-1100 Block of Southwest Boulevard and the 1000 Block of Northeast Drive by the Board of Adjustment on March 12, 1974 which described the development as 50% office/50% apartments, and by the later addition of properties addressed 915 Southwest Boulevard, 1115 Southwest Boulevard and 1125 Southwest Boulevard. SECTION 3. PUD PLAN. A. PUD Plan for Area A-1. The following described Planned Unit Development Plan is hereby approved for Area A-1 of this PUD District described above and depicted on the map attached hereto (Exhibit A) and consisting of the following addresses: Southwest Boulevard Addresses: 915, 1001, 1007, 1011, 1021, 1025, 1 ,I 01 Rear, 1103, 1 103 Rear, 1105, 1109, 1115, and 1121. 1 . Uses of Land and Buildings in Area "A-1" on Exhibit A shall be permitted as follows: a. Museum, art gallery, library b. Day care center for adults or children G. Medical and dental clinics d. Church ® e. Schools: public, private or parochial f. Vocational-technical schools g. Dance, art, music schools h. Telecommunication facilities meeting the standards of Section 35-41 Specific Use Standards for the C-O districts i Professional and business offices, real estate, finance, insurance, travel consultants, interior design studios j. Parking lots k. Bank, financial institutions I. ATM M. Personal services, including barber, hairstyling, tanning, day spa, nail care; n. Incidental retail sales, only when associated with a permitted use. o. Residential uses when located on the second floor or above. B. PUD Plan for Area A-2. The following described Planned Unit Development Plan is hereby approved for Area A-2 of this PUD District described above and depicted on the map attached hereto (Exhibit A) and consisting of the following addresses: Northeast Drive Addresses: 1000, 1004, 1008, 1014, 1020, 1026; 1001,1003, 1005,.1009, 1015, 1021 , 1025. Professional and business offices, including travel consultants and interior design studios e. Residential uses. C. No outdoor storage of materials, supplies or equipment is allowed in this PUD district. D. Signage shall be as governed by the Advertising and Sign Code as It exists, or may be amended. SECTION 4. Public areas, common areas, property owners association, private agreements. A. No new public areas, rights of way or easements, or common areas, are dedicated with this plan. B. No property owners' association is created. C. Private agreements between property owners to allow for ingress-egress, shared use of off-street parking facilities, signage locations and other shared arrangements is authorized, however applicable permits shall be obtained prior to erection or construction of any structure. The first meeting will be held at 5:30 P.M. on Tuesday, September 24, 2002, in the City Council Chambers of the John G. Christy Municipal Building, 320 East McCarty Street. The second meeting will occur at 12:00 Noon on Thursday, September 26, 2002, in the lower level of 1109 Southwest Boulevard. These meetings are being held in order to collect comments on the proposed rezoning, present proposed conditions of rezoning, and gather official affected landowner sign-off of the proposed rezoning. Enclosed, please find a copy of the draft ordinance outlining the proposed rezoning, as well as a Land Use Matrices Table, which outlines all allowable land uses by zoning district. The draft ordinance contains the proposed specific allowed land uses for the rezoning area. As a landowner, you have the privilege of attending this meeting. Your comments are important in regard to the proposed rezoning and will be taken into consideration and made a part of the conditions of the proposed rezoning. Unfortunately, we are unable to record comments received by telephone, but written comments will be collected for consideration and made available to staff.
