AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING,
AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF
JEFFERSON, BY REZONING 13.56 ACRES LOCATED EAST OF SOUTHWEST
BOULEVARD IN THE 900, 1000 AND 1100 BLOCKS OF SOUTHWEST BOULEVARD
AND THE 1000 AND 1100 BLOCKS OF NORTHEAST DRIVE, LOCATED IN SECTION 12,
TOWNSHIP 44, RANGE 12 WEST, COLE COUNTY, MISSOURI FROM RA-2 MULTI-
FAMILY RESIDEN-rIAL TO PUD PLANNED UNIT DEVELOPMENT AND APPROVING A
PUD PLANNED UNIT DEVELOPMENT PLAN FOR THE PROPERTY.
WHEREAS, the adoption of Ordinance No. 13361, the Comprehensive Update to the Zoning
Code, has created nonconforming commercial uses in the RA-2 High Density/Multi-Family
Residential Zoning District previously authorized by conditional use permit; and
WHEREAS, the Ordinance No. 13407, adopting a similar PUD Plan for the property
addressed as 1101 Southwest Boulevard was previously approved; and
WHEREAS, it appears that procedures set forth in the zoning code relating to zoning have
in all matters been complied with;
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The following described real estate is rezoned from RA-2 Residential to
PUD, Planned Unit Development:
Area A-1: Part of the West Half of the Southwest Quarter of Section 12 and part of
the Northwest Quarter of the Northwest Quarter of Section 13, all in Township 44
North, Range 12 West, in the City of Jefferson, County of Cole, Missouri; being more
particularly described as follows: BEGINNING at the southeast corner of the
Southwest Quarter of the Southwest Quarter of said Section 12; thence N00 023'00"E
along the east line of the Southwest Quarter of the Southwest Quarter of said Section
12, 475.03 feet, to the southeast corner of Lot No. 12 of Major's "Southwest
Subdivision", as per plat of record in Plat Book 10, Page 24, of the Cole County
Recorder's Office, said corner also being on the north line of Woodcliff Drive; thence
N89°37'00"W, 239.04 feet, to a point 9.00 feet west of the southwest corner of Lot No.
1 , of said Major's "Southwest Subdivision"; thence leaving the north line of said
Woodcliff Drive on a bearing of N00 023'00"E, 138.84 feet to the northerly line of a
tract as described in Book 240, Page 967, of the Cole County Recorder's Office;
thence S86°09'02"E, along the north line of said tract, 9.00 feet, to the northeast
corner thereof, said corner being on the west line of the aforementioned Major's
"Southwest Subdivision"; thence N00 023'00"E, along said west line,662.70 feet, to the
northwest corner of Lot No. 1 , of said Major's "Southwest Subdivision", said corner
being on the southerly line of Tower Drive; thence N12°15'36"E, 77.95 feet, to the
northerly line of said Tower Drive; thence N00 023'00"E, 295.20 feet; thence
N89°52'00"W, 20.00 feet; thence N00°23'00"E, 20.00 feet; thence S83°27'22"W,
137.57 feet; thence S03°08'04"E, 31 ,75 feet; thence S85 034'29"W, 69.64 feet, to a

easterly line, 323.65 feet, to the intersection of said easterly line with the
aforementioned northerly line of Tower Drive; thence S06°14'12"E, 66.58 feet, to the
intersection of said easterly line with the aforementioned southerly line of Tower Drive;
thence continuing southerly along said easterly line the following courses:
S06°42'30"E, 8.48 feet; southerly on a curve to the right having a radius of 1472.69
feet, an arc distance of 392.29 feet; S08 030'30"W, 43.23 feet; S89 037'00"E, 5.00 feet;

easterly line with the north line of the aforementioned Woodcliff Drive; southerly on a
curve to the left having a radius of 676.10 feet, an arc distance of 19.95 feet;

said Woodcliff Drive; thence S89 037'00"E, along said south line, 172.78 feet; thence

easterly line of Southwest Boulevard; thence southerly along said east line on a curve
to the right having a radius of 994.75 feet, an arc distance of 184.79 feet; thence
S00 002'00"E, along said east line, 76.27 feet, to a point on the east/west line between
said Sections 12 and 13, the Section Line, said point being N89 034'30"W, 309.77 feet
from the aforementioned southeast corner of the Southwest Quarter of the Southwest
Quarter of said Section 12; thence continuing south along the said east line of
Southwest Boulevard, 271 .90 feet, to a point 430 feet north of the south line of Lot No.
11 , of Swift and Thompson's Subdivision of the Northwest Quarter of Section 13,
Township 44 North, Range 12 West, as per plat of record in Plat Book 1 , Page 9, of
the Cole County Recorder's Office; thence easterly 233.66 feet; thence north 271.90
feet, to a point on the aforementioned Section Line, said point being 234.48 feet east
of the east line of said Southwest Boulevard; thence S89 034'30"E, along the Section
Line, 75.29 feet to the POINT OF BEGINNING. Containing in all, 9.06 acres, more or
less.
AREA A-2 : Part of the Southwest Quarter of the Southwest Quarter of Section 12,
Township 44 North, Range 12 West, in the City of Jefferson, County of Cole, Missouri,
including Lot Nos. 1 thru 12, of Major's "Southwest Subdivision", as per plat of record
in Plat Book 10, Page 24, of the Cale County Recorder's Office; and being more

The purpose of this PUD Plan is to preserve the area's unique development character
by continuing with the same or similar types of development originally authorized by
a Conditional Use Permit issued for the 1000-1100 Block of Southwest Boulevard and
the 1000 Block of Northeast Drive by the Board of Adjustment on March 12, 1974
which described the development as 50% office/50% apartments, and by the later
addition of properties addressed 915 Southwest Boulevard, 1115 Southwest
Boulevard and 1125 Southwest Boulevard.
SECTION 3. PUD PLAN.
A. PUD Plan for Area A-1. The following described Planned Unit Development
Plan is hereby approved for Area A-1 of this PUD District described above and
depicted on the map attached hereto (Exhibit A) and consisting of the following
addresses:
Southwest Boulevard Addresses: 915, 1001, 1007, 1011, 1021, 1025,
1 ,I 01 Rear, 1103, 1 103 Rear, 1105, 1109, 1115, and 1121.
1 . Uses of Land and Buildings in Area "A-1" on Exhibit A shall be permitted
as follows:
a. Museum, art gallery, library
b. Day care center for adults or children
G. Medical and dental clinics
d. Church
® e. Schools: public, private or parochial
f. Vocational-technical schools
g. Dance, art, music schools
h. Telecommunication facilities meeting the standards of Section
35-41 Specific Use Standards for the C-O districts
i Professional and business offices, real estate, finance, insurance,
travel consultants, interior design studios
j. Parking lots
k. Bank, financial institutions
I. ATM
M. Personal services, including barber, hairstyling, tanning, day spa,
nail care;
n. Incidental retail sales, only when associated with a permitted use.
o. Residential uses when located on the second floor or above.
B. PUD Plan for Area A-2. The following described Planned Unit Development
Plan is hereby approved for Area A-2 of this PUD District described above and
depicted on the map attached hereto (Exhibit A) and consisting of the following
addresses:
Northeast Drive Addresses: 1000, 1004, 1008, 1014, 1020, 1026;
1001,1003, 1005,.1009, 1015, 1021 , 1025.

1. Uses of Land and Buildings in Area"A-2" on Exhibit A shall be permitted
as follows:
a. Museum, art gallery, library
b. Medical and dental clinics
C. Church
d. Professional and business offices, including travel consultants
and interior design studios
e. Residential uses.
C. No outdoor storage of materials, supplies or equipment is allowed in this PUD
district.
D. Signage shall be as governed by the Advertising and Sign Code as It exists, or
may be amended.
SECTION 4. Public areas, common areas, property owners association, private
agreements.
A. No new public areas, rights of way or easements, or common areas, are
dedicated with this plan.
B. No property owners' association is created.
C. Private agreements between property owners to allow for ingress-egress,
shared use of off-street parking facilities, signage locations and other shared
arrangements is authorized, however applicable permits shall be obtained prior
to erection or construction of any structure.
SECTION 5. This ordinance shall be in full force and effect from and after its passage
and approval.

Planning Division, will hold an informative mooling at 6:00 p.m. on Wednesday, August 14, 2002,
in the Largo Conforonco Room of the John G. Christy Municipal Building, 320 East McCarty Street.
The purpose of the meeting is to p1ment information and collect comments from landowners in
regard to the possible rozoning of propertios along Southwest Boulevard and Northeast Drive, from
RA-2, Multi-Family Residential, to PUD, Plannod Unit Development.

Dear Property Owner:
This latter is to notify you the Jefferson City Department of Community Development,
Planning Division, will hold two (2) informative meetings regarding the rezoning of properties
along Southwest Boulevard and Northeast Drive, from RA-2, Multi-Farnily Residential, to PUD,
Planned Unit Development. The first meeting will be held at 5:30 P.M. on Tuesday, September 24,
2002, in the City Council Chambers of the John G. Christy Municipal Building, 320 East McCarty
Street. The second meeting will occur at 12:00 Noon on Thursday, September 26, 2002, in the
lower level of 1109 Southwest Boulevard.
These meetings are being held in order to collect comments on the proposed rezoning,
present proposed conditions of rezoning, and gather official affected landowner sign-off of the
proposed rezoning. Enclosed, please find a copy of the draft ordinance outlining the proposed
rezoning, as well as a Land Use Matrices Table, which outlines all allowable land uses by zoning
district. The draft ordinance contains the proposed specific allowed land uses for the rezoning
area.
As a landowner, you have the privilege of attending this meeting. Your comments are
important in regard to the proposed rezoning and will be taken into consideration and made a part
of the conditions of the proposed rezoning. Unfortunately, we are unable to record comments
received by telephone, but written comments will be collected for consideration and made
available to staff. Written cornrnents may be directed to the Planning Division in one of the
following ways:
