AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI AUTHORIZING A MORATORIUM ON ISSUANCE OF BUILDING PERMITS WITHIN THE PLANNED FOOTPRINT AND CONSTRUCTION ZONE OF LEVEE PROJECT L-142. WHEREAS, for a number of years the City has worked toward the construction of a levee to protect property and public facilities north of the Missouri river; and WHEREAS, the Council desires to move forward with Levee Project L-142 and to maximize the benefits of the project while minimize disruption and economic loss; and WHEREAS, the Council believes that the development of final design and execution of necessary document to trigger acquisition of necessary land will occur within the next nine (9) months; and WHEREAS, the Council finds it is in the best interest of the citizens of the City of Jefferson to adopt an interim moratorium prohibiting the issuance of building permits within the planned footprint and construction zone of Levee Project L-142. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI AS FOLLOWS: Section 1. An interim moratorium on the issuance of building permits within the planned footprint and construction zone of Levee Project L-142 is hereby established beginning with the effective date of this ordinance and extending until September 30, 2003. No permit shall be issued for the construction, repair or alteration of any structure in the City of Jefferson which lies within the planned footprint or the construction zone for Levee Project L-142 as currently designed. The area affected by this moratorium is reflected on the map attached hereto as Exhibit A. Section 2. For good cause shown, the Community Development Department may waive the above moratorium on an individual building permit. When requesting a waiver, it shall be the applicant's responsibility to show good cause, which shall include but not be limited to evidence that the proposed improvement will not adversely impact the levee project nor be adversely affected by the levee project. In granting a waiver, the Community Development Department may impose such conditions as may be necessary to ensure that the waiver will. not violate the intended purpose of the moratorium. r "xe Section 3. MONTHLY STATUS REPORT TO SPONSOR DATE: DEC 2002 'PROJECT: MRLS L-142 JEFFERSON CITY, MO SPONSOR: JEFFERSON CITY, MO PM: CINDY MOSES What we are Currently Working On Hydrology and Economics- We are continuing to work on the Limited Reevaluation Report (I.RR). The St Paul District has reviewed the VIEC-RAS model and all comments are incorporated. Our economist will now be taking that data and the economic data once it is received to revalidate the NED plan. Once that is done, the top of levee profile will be determined by the hydrologist and the report will be finalized. Once the entire report is finished, it will be sent to St. Paul to review, then be signed off by the District commander and go to our Division Office for approval. The New Top of Levee will be set by this report. Getting the Top of Levee set is crucial to allowing the designers to move forward. The geotechnical engineers have done a considerable amount of work in analyzing the soil borings and soil reports. This has allowed them to work on stability analysis and underseepage design. The amount of underseepage berms needed will also control the amount of land required for the levee. They will not be able to finalize this until the LRR is finished. To proceed further with the technical design—getting the Top of Levee is critical. The underseepage berms, the utilities, the structure heights—all depend upon Top of Levee. Notification to MDNR on the fuel found on the Millman property will be made once the notification letter is routed through our office for signature. Road Raise vs Stop Log height— This study is at it's final stages we received the cities desired options. The report will be provided as soon as we get the information on the new water surfaces profiles which will be part of the LRR. Surveys—The Surveys crews will be going back out to the site to get some additional manhole invert elevations and there were some borings that were missed due to site conditions. Upcoming Milestones and Dates Informational Meeting in March LRR submittal for Review—February *Depending upon getting economic data. 65%Review of the Plans, Specs and Design Document Report delayed until Summer 2003 *depending upon when LRR can be done. (Had heard that Sprint did some work in the area and want to get that incorporated into our mapping) Identify stop log storage location Decision on the design of the roads—who will be doing this? If desired to be part of the design MOA— the Corps needs a letter requesting that effort, Items the Sponsor needs from the Corps A copy of the finalized road raise study once sponsor determines the desired option. A copy of the LRR once it is ready for review. Current Funding The Federal Governments is still operating under a CRA—Continuing Resolution Authority therefore the budget is not yet past.
