Y AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING
CERTAIN EASEMENTS FOR SANITARY SEWER PURPOSES IN THE 3500 BLOCK OF
TRUMAN BOULEVARD .
WHEREAS, by an easement recorded in Book 380, Page 361 (EL MERCADO, INC. to
The City of Jefferson, August 16, 1996) of the Records of the Cole County,
Missouri, a sewer easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and repair
structures for the routing and conveyance of sewer in, under and through the
lots, tracts or parcels of land described in Section 1; and
WHEREAS, by an easement recorded in Book 380, Page 362 (MEYER ELECTRIC
COMPANY, INC. to The City of Jefferson, August 19, 1996) of the Records
of the Cole County, Missouri, a sewer easement was granted to the City of
Jefferson, a Municipal Corporation, to excavate within, install, construct,
maintain and repair structures for the routing and conveyance of sewer in,
under and through the lots, tracts or parcels of land described in Section 2;
• and
WHEREAS, by an easement recorded in Book 392, Page 405 (EL MERCADO, INC. to
The City of Jefferson, November 12, 1997) to The City of Jefferson, August
19, 1996) of the Records of the Cole County, Missouri, a sewer easement
was granted to the City of Jefferson, a Municipal Corporation, to excavate
within, install, construct, maintain and repair structures for the routing and
conveyance of sewer in, under and through the lots, tracts or parcels of land
described in Section 3; and
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described easement, as found in
Book 380, Page 361 (EL MERCADO, INC. to The City of Jefferson, August 16, 1996) of
the Records of the Cole County, Missouri is surplus property of the City and is no longer
needed for any public purpose:
A strip of land 15 feet wide across part of the Southeast Quarter of Section
4, Township 44 North, Range 12 West, in the City of Jefferson, Missouri,
said 15 foot wide strip lying 7.5 feet either side of and adjacent to a line more

particularly as follows:
•
From an existing manhole at Station 10+21.48 extension of Private Sewer
No. 382, Line C of a sanitary sewer easement recorded in Book 271, Page
125, Cole County Recorder's Office; thence on a angle of 90 007'06" from the
existing sanitary sewer line back, S17°33'31"W, 68.86 feet to the southerly
line of a tract of land described in Book 288, Page 812, Cole County
Recorder's Office, and the point of beginning for the centerline of this
description; thence continuing S 17°33'31"W, 147.44 feet to a point hereafter
to be known as Point "A"; thence continuing S17°33'31"W, 10.7 feet to the
northerly line of WEST TRUMAN BOULEVARD, and the point of termination.
ALSO:A strip of land across part of the South half of Section 4, Township 44
North, Range 12 West, in the City of Jefferson, Missouri, said strip of land
lying 7.5 feet northerly of and 10.0 feet southerly of a line being more
particularly as follows:
Beginning at the aforesaid Point "A"; thence S86 024'25"W, 933.70 feet;
thence N80 003'39"W, 191 .00 feet to the point of termination.
Except that part that lies within the right-of-way of SCOTT STATION ROAD.
® Section 2, The Council finds that the following described easement, as found in
Book 380, Page 362 (MEYER ELECTRIC COMPANY, INC. to The City of Jefferson,
August 19, 1996) of the Records of the Cole County, Missouri, is surplus property of the
City and is no longer needed for any public purpose:

Section 3. The Council finds that the following described easement, as recorded
in Book 392, Page 405(EL MERCADO, INC. to The City of Jefferson, November 12, 1997)
to The City of Jefferson, August 19, 1996) of the Records of the Cole County, Missouri,
is surplus property of the City and is no longer needed for any public purpose:

A strip of land across part of the Southeast Quarter of Section 4, Township
44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri,
more particularly as follows:
Beginning at a point on the easterly line of a tract of land as described in
Book 278, Page 36, Cole County Recorder's Office, where said easterly line
intersects with the northerly right-of-way line of WEST TRUMAN
BOULEVARD; thence NO3 054'08"W, along the easterly line of said tract in
Book 278, Page 36, 129.55 feet to the southerly line of a tract in Book 288,
Page 812, Cole County Recorder's Office; thence N79°24'52"1N, along the
southerly line of said tract, 33.57 feet; thence S03 054'08"E, 120.25 feet;
thence S83°20'11"W, 76.55 feet; thence S86 024'25"W, 932.69 feet; thence
N80 003'39"W, 106.18 feet to the easterly right-of-way line of SCOTT
STATION ROAD; thence S34°00'21"E, along the easterly right-of-way of
SCOTT STATION ROAD, 36.35 feet to the northerly right-of-way line of
WEST TRUMAN BOULEVARD; thence easterly, along the northerly line of
WEST TRUMAN BOULEVARD the following courses: S74 056'42"E, 50.16
feet; thence N86 024'25"E, 891 .95 feet; thence easterly, on a curve to the
left, having a radius of 2824. 79 feet, an arc distance of 151 .92 feet, the
chord of said curve being N84 051'59"E, 151.90 feet to the point of beginning.
Section 4. The easements described in Sections 1, 2, and 3 are hereby
• relinquished, and the City does hereby release and abandon whatever interest it has in the
easements.
Section 5. The Mayor and City Clerk are hereby authorized to execute any
necessary legal document relinquishing all of the City's interest in the tracts of ground
described in Sections 1 , 2, and 3.
Section 6. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
