Roll Call: 2. Approval of Agenda: Minutes of November 14, 2013 Commissioner Soles moved, and Commissioner Hodsdon seconded the motion to approve the Agenda. Motion carried: 6-0. 3. Open Forum: 4. Action Items: a. Re-Appoint Planning Chair Commissioner Wolter was reappointed chair of the Planning Commission. Commissioner Sumrall was appointed vice-chair. Commissioner Hodsdon moved, and Commissioner Sumrall seconded the motion to Re-Appoint Planning Chair. Motion carried: 6-0. 5. Discussion Items a. Sign Code — We had a request from a Town Board member to revisit the Fraser Sign Code and prohibit off-premise signage. The reason is that it is his belief that such signage is ineffective and uncontrollable. This is a discussion item and will be scheduled for a public hearing in the near future. Section 16-10-170 (c), page 16-99 regulates off-premise signs: Page 2 of 3 "Off-premise signs may be permitted if the business street frontage is not on U.S. 40. Property owner's permission is required and off-premises signs must be approved by the Board of Trustees on a case-by-case basis." b. Zoning Regulations— During the Byers Peak Ranch annexation process, it was discussed with the Annexation Committee and the applicant that there appears to be some duplication in the Town's regulations relating to zoning requirements. Article 4 is the Business District Regulations and Article 5 is the PD District Regulations. Please review these 2 sections of the Code in preparation for our discussion. 6. Public Hearing/Action a. Minor Subdivision — Replat of Lot 3, Broken Wagon Wheel Estates Commissioner Hodsdon moved, and Commissioner Soles seconded the motion open the Public Hearing regarding a Minor Subdivision — Replat of Lot 3, Broken Wagon Wheel Estates. Motion carried: 6-0. We are in receipt of a minor subdivision application from Todd Bruteig. In 1996, the Town of Fraser approved Broken Wagon Wheel Estates which created 4 lots on the corner of CR 8 and Wapiti Drive. See attached aerial map. Todd is the current owner of lot 3 (0.93 AC). He is proposing to split the vacant parcel into 3 smaller lots. The plat is included in the packet. This application is being processed as a minor subdivision in accordance with Section 17-4-10 of the Fraser Municipal Code. The purpose and scope of a minor subdivision is that the resulting subdivision will create a total of not more than four(4) lots or four(4) dwelling units and no new streets need to be constructed and municipal utilities exist immediately adjacent to the parcel and do not need to be extended to serve the subdivision. The proposed new lots also will also in accordance with the R2 — Medium Density Residence Zoning District detailed in Section 16-3-120 of the Fraser municipal Code. In the R-2 Zoning District, the minimum lot area for each principal use is 6000 SF with a minimum lot width of fifty(50)feet(if serves by central water and sewer and if the lots abuts a public street). The plat indicates that the proposed lots do indeed meet these minimum requirements. We are still working through some possible revisions to the plat notes. As a policy change, the Planning Commission will be adopting resolutions now to document the recommendations of approval to the Town Board. Pending any comments we hear at the public hearing, we will have a resolution ready for you to adopt at the Planning Commission meeting. Public comment was taken. Page 3 of 3 Commissioner Sumrall moved, and Commissioner Soles seconded the motion continue the Public Hearing regarding a Minor Subdivision — Replat of Lot 3, Broken Wagon Wheel Estates to April 10, 2013.
