HomeMy Public PortalAboutOrdinance No. 886-00 10-24-2000 ORDINANCE NO. 886-00 • AN ORDINANCE AMENDING SUBSECTION "E" OF SECTION 8 "SPEED REGULATIONS" OF CHAPTER 10 "TRAFFIC REGULATIONS" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS; ELIMINATING THE TWENTY MILE PER HOUR SPEED LIMIT ON VANCE ROAD BETWEEN RICHLAND ROAD AND BROOKS AVENUE, AND THEREBY MAKING THE SPEED LIMIT ON VANCE ROAD THIRTY MILES PER HOUR THROUGHOUT ITS LENGTH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills has heretofore, by ordinance, designated the portion of Vance Road between Richland Road and Brooks Avenue as a twenty mile per hour speed zone, due to its proximity to a public park; and WHEREAS, due to substantial public input, the City contracted with Parsons Transportation Group, Inc., to perform a traffic study to determine whether or not the twenty mile per hour speed zone was still appropriate for that area; and WHEREAS, said traffic study concluded that the twenty mile per hour speed zone was no longer appropriate to the area, and recommended certain other measures, including signage and • pavement markings, to alert motorists to the proximity of the public park; and WHEREAS, the Richland Hills Chief of Police has concurred with the recommendations of the Parsons Transportation Group, Inc. concerning deletion of the twenty mile per hour speed zone on Vance Road at the location listed above. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That paragraph (17), entitled "Vance Road between Richland Road and Brooks Avenue - - - 20 MPH" of Subsection E "SPEED LIMITS ENUMERATED" of Section 8 "SPEED REGULATIONS" of Chapter 10 "TRAFFIC REGULATIONS ofthe Code of Ordinances of the City of Richland Hills, Texas, as amended, be deleted in its entirety, so that the speed limit on Vance Road between Richland Road and Brooks Avenue shall revert to thirty miles per hour. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or • unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City • Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 10 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
