AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE MISSOURI
DEPARTMENT OF NATURAL RESOURCES FOR STORMWATER GRANT
AGREEMENT #JEFF-0336-02G.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to execute
an agreement with the Missouri Department of Natural Resources for Stormwater Grant
Agreement #JEFF-0336-02G.
Section 2. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

C. PROJECT DESCRIPTION
This project is for a Storm Water masterplan for Jefferson City and portions of Cole
County that drain into the City.

1. By signing this agreement, the recipient certifies that:
A. contract documents and/or contracts for professional services will conform to
relevant local, state, and federal laws;
B. all state storm water grant funds will be expended solely for carrying out the
approved grant project;
C. a professional engineer registered in Missouri has been/will be selected and will
perform the services outlined in the project;
D. the local share is available to complete the project.
2. All funds must be expended by July 1, 2003.
3. Grant payments will be made in no more than four installments.
A. The first payment may be made when not less than 25% of the contracted or
estimated cost of the plan has been completed. The completed portion of the basin
plan and invoices or time cards (if done by force account) are required to process
this payment.
B. The second payment may be made when not less than 50% of the contracted or
estimated cost of the plan has been completed. The completed portion of the basin
plan and invoices or time cards (if done by force account) are required to process
this payment.
C. The third payment may be made when not less than 90% of the contracted or
estimated cost of the plan has been completed. The completed portion of the basin
plan and invoices or time cards (if done by force account) are required to process
this payment.
D. The final payment may be made when the final plan is submitted to and approved
by MDNR. This payment request must be accompanied by supporting invoices or
time cards.
4. Grants are limited to one half of eligible costs or to the grant amount, whichever is
less.
5. Change orders or changes in scope of work.must be approved by MDNR. Grantee
agrees to pay any further expense resulting from a change order if grant amount is
exceeded.

6. Projects must be in compliance with the Storm Water Assistance Regulation (10 CSR
20-4.061) and the conditions of the grant agreement.
7. Failure to expend all funds for development of the basin plan prior to July 1, 2003
will result in termination and recovery of this grant.
8. If necessary the grant amount will be adjusted downward to reflect eligibility and
final costs.
9. Repayment of the grant is required if the applicant fails to obtain and meet reporting
requirements of all MDNR permits for all facilities owned by the recipient.
10. In accordance with the Department of Natural Resources Contracting and
Procurement Participation Plan and the Governor's Executive Order 98-21,
special efforts must be made to assure that a l0% objective be made available to
Minority Business Enterprises (MBE) and a S% objective be made available to
Women Business Enterprises (WBE), when using state grant agreement funds to
purchase supplies, equipment, construction and services related to this award
Agreement.
A. The Recipient agrees to take all necessary affirmative steps required to
assure that Minority Business Enterprises and Women Business
Enterprises are used when possible as sources when procuring supplies,
® equipment, construction and services related to this award Agreement.
The solicitation documents. Affirmative steps shall include:
a. Placing qualified minority business and women's business
enterprises on solicitation lists;
b. Ensuring that small and minority and women's business enterprises
are solicited whenever they are potential sources;
C. Dividing total requirements, when economically feasible, into
small tasks or quantities to permit maximum participation by
minority and women's business enterprises;
d. Establishing delivery schedules, where the requirements of work
will pemlit, which would encourage participation by minority and
women's business enterprises;
C. Requiring any prime contractor or other Recipient, if sub-
agreements are to be let, to take the affirmative steps in
subparagraphs a. through c. of this section.
B. The Recipient agrees to submit, to the Department of Natural Resources'
project officer, a completed MBE/WBE Utilization report, within 30 days
after the end of each federal/state fiscal quarter.
By signing this grant agreement, the grantee acknowledges and agrees to the conditions
set forth herein.
THE STATE OF MISSOURI HEREBY OFFERS A STORM WATER GRANT OF
$204,624 TO THE CITY OF JEFFERSON.
