HomeMy Public PortalAboutOrdinance No. 895-01 04-10-2001 ORDINANCE NO. 895-01 • AN ORDINANCE AMENDING THE DEFINITIONS CONTAINED IN SECTION 4 "JUNKED VEHICLES" OF CHAPTER 6 "NUISANCES" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS; INCORPORATING A NEW DEFINITION OF "JUNKED VEHICLES" AS ALLOWED BY THE TEXAS LEGISLATURE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, the current definition of "junked vehicles" contained in the Richland Hills Code of Ordinances does not reflect changes made by the Texas Legislature in its most recent session; and WHEREAS, the revised definition provided hereby will promote consistency in interpretation of regulations governing junked vehicles; and WHEREAS, the City Council of the City of Richland Hills, Texas, finds and determines that the following ordinance amendment will promote the health, safety and welfare of the citizens of Richland Hills. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: • I. That paragraph (1) of Subsection A "Definitions" of Section 4 "JUNKED VEHICLES" of Chapter 6 "NUISANCES" of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: A. Definitions (1) Junked Vehicles. For the purposes of this Section, "junked vehicle" means a vehicle that is self-propelled, and: (a) does not have lawfully attached to it: (i) an unexpired license plate; or (ii) a valid motor vehicle inspection certificate; (b) is wrecked, dismantled or partially dismantled, or discarded; or (c) is inoperable and has remained inoperable for more than: (i) 72 consecutive hours, if the vehicle is on public • property; or (ii) 30 consecutive days, if the vehicle is on private property. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 6 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
