COMMENTS: ?t The Department of Public Works has done a technical review of the preliminary and final site plan �. as submitted by Central Missouri Professional Services Inc. All items concerning Public Works �< and final fan contents in Section 3 5-70, of the Zoning Code pertaining to preliminary ` ; :-:¢• have been addressed on the site plan. The following comments pertain to this review; r' 1. The private driveway extends to serve the proposed building as shown on the site plan. x,• r t� 2. Sanitary sewer main extension has been indicated on the proposed site plan. Existing ; -•ire'=^'' sewer easements on adjacent property allow for main extension as shown. Sanitary sewer plans, including easements being signed and recorded, must be finalized prior to issuance , ,'; •ti, „ ,. of any , ormits for construction. , 3. The total acreage of the proposed site is 0.65 acres. The total watershed east of Tanner ' } =x Bridge Road is estimated at approximately 204 acres according to the 1988 Drainage Study of this area. The basin is essentially developed below the existing detention basins. ;'+ ' .�4 The total additional runoff from the proposed building and pavement is estimated at 1.0 cfs in a 10 year storm (0.22 acres of impervious area). The total runoff generated from w, ., ', pit,':}•: the entire watershed is estimated at 483 cfs in a 10 year storm with the upstream detention Pi n basins that the City of Jefferson built in place, according to the 1988 Storm Drainage Study. As you may recall, a few months ago when Mr. Mike Bates appeared before the Commission on behalf of Mr. Beasle s proposed rezoning and construction he told the Commission there had been a history of some flooding problems involving the creek and :. property below the site of the proposal, but the City had remedied the problem. At the time this occurred, I was '°� standing on my back porch watching the creek rise from the heavy rain fall we were p. t experiencing. I observed that from a period beginning approximately at 12:30 p.m. and '.; continuing to 1 p.m. this creek rose from only minimal water in the creek bed to a depth P, of approximately 5 to 6 foot. Behind my house, the width of the water flowing down the '' t: creek was approximately 16 foot, when nonnally the width is approximately five foot. As ,y I observed the water rising, I was amazed at the number of what looked like small raging creeks carrying water drain off down the hillside immediately above the creek and into the creek. I can't really adequately describe the water run off that runs into the creek from off this hillside—you have to see it yourself to believe it. Basically what is described in the letter is a series of problems, some caused by inadequate facilities to handle the volume of the City's water drain off during heavy rain fall, some caused by what appears to be the City's ineffectiveness to discourage citizens from placing things in and around the creek that may cause flooding downstream and some caused by negligent actions on the part of { ' families who reside along the creek. After reading my April 4 letter, you may think, "What does this have to do with the Commission and the Council? The answer is, the residents located along this creek can a!,;'rt;rs Y•Aa +.,t, f. not tolerate any additional problems, such as more construction on the hillside above this creek that poses to cause more water drain off into the creek. You see what Nh-. Bates neglected to tell you when he appeared before the Commission is that many of the drain pipes located in the creek, and through which creek water passes during heavy rains are too small. They apparently were installed at a time when the potential for flooding was not as significant. This is why debris gets clogged up so easily in these pipes, which in1i',,, tN turn causes the creek to run over. I am not aware that the City has any plans for projects to decrease the water drain off �`'•r,>�*•..,.,v��'',`~;. �, from the streets and hillside above the creek. It is not likely that the drain pipes, over which private driveways pass, will be replaced in the near future because City officials ,,.,• have informed me that the replacement of such drain pipes, or clean-up in and around such pipes, is the responsibility of property owners not the City's. Therefore it is not P P � p Y P p Y � Y � likely that many, if any, of these drain pipes will be replaced anytime soon. It is also not ! ,H rrl. •n t�� 7. likely that the City's ability to monitor and effect clean-up in and along the creek banks ILL will improve anytime soon. I recently(April 4, 2001) talked to a City employee about this matter and was told that in the past the City had warned families residing alon g thist .r: ' .^f u creek to not place debris etc. in and around the creek. He told me the City had not observed any significant increase in compliance on the part of these families. Therefore, ;zt �* „'v it is not likely there will be less debris passing through these undersized drain pipes anytime soon, so the potential for these drain pipes to get clogged up, and for flooding to occur, will continue for an unforeseeable time. So, what about families who live downstream, who are at the mercy of everybody—the City, its citizens and those who propose projects such as the Beasley project? r ,J 4t In my opinion, it appears that so far as the proposed Beasley project is concerned our :., I)• SU�F ,' hopes rest with the Commission and the Council, because the only consideration remaining is to not enhance the potential for more water drain off down this hillside than already exists. My point is there are not adequate facilities to handle any additional significant construction in this area. Neither the City nor its citizens need to be Lira•s�'.�.'.., creating a potential for more problems than those that already exist. I recognize that w�;��-�pi4•.,,,,,{.>:.. circumstances do occur when there is good reason for rezoning within the City; however, in my opinion this is not one of them. The Beasley proposal serves to benefit nobody ` except those individuals involved in the project and serves a significant potential for causing he citizens who reside aloe this creek even more problems. g g P In addition to my letters, as you review this proposal, I ask that you please consider the following: (1) Mr. Beasley was aware of his risks when he bought this RS-2 property. After the meeting in January 2001 I think-), where the Commission reviewed and recommended approval of Mr. Beasley's earlier proposed project on this site Mr. Beasley talked with a group of us who had opposed him during this meeting. At that time, he displayed a lot confidence that he had bought this property zoned RS-2 with considerable confidence that both the Commission and the Council would rule in his favor when he decided to request that the property be rezoned" In my opinion, his attitude Y f•;:y:;t;+,. did not show a lot of respect for the integrity of the Commission or the Council. (2) In addition to this rezoning and development proposal, Mr. Beasley already has under `r��7' I r;: construction what appears to be a sizeable expansion of the condominium complex ?;°f` � pt , located adjacent to the property in this proposal. This new construction, along with the proposed project, are all located on the hillside located above the creek that I reference in this letter. (3) The project and rezoning proposed by Beasley at the first of the year ; °{ '• y (2001) was voted down by the City's Council because they did not believe it served the best interest of the citizens in this area of the City. " • In the past,the contractor of the proposed development has developed other property within areas adjacent to his current proposal as multi-family dwellings(condominiums). Located behind my house, is a small creek that normally 17 is dry unless there is a significant rain or snowmelt. The creek appears to primarily receive the drain off from properties located above the creek. When there is a lot of rain or snowmelt, the creek generally gets bank ?i full, but does not flood, at least not near our house. Along the creek,there are streets and fr s r es large driveways that run over the creek. In such instances there are i for the creek � g pipes water to pass through. Yesterday, April 3, 2001, during the hard hail and rain storm that occurred around 1 m., I experienced quiet a panic when the pipe located behind our `'>"�(% r,,.. p. p q I� p P 3 ' house got clogged up and the water from the creek came over the top of my neighbor,s ` Gr, driveway and into my mine and my other neighbor's back yards, and almost flooded our houses. It probably would have flooded our houses if I and a neighbor had not been able }, ,•ah ;,;. to get the drain reopened enough for the water to recede a little back into the creek banks. $ f However, we were both placed ourselves at risk when we took this action. 'St�{� �,;� ; + Needless to say, even though my house did not actually flood, my backyard, in which I have invested significant dollars, did not survive the creek overflow very well. I also observed that the dirt and rocks used to fill in around the pipe, located under my µ4 . Yt ;� neighbors driveway,have been substantially washed away. Thus, there is little support remaining to prevent my neighbor's driveway. Yesterday, April 3, ?r, what appeared to have stopped up the pipe was some unusually large logs, measuring t r approximately one foot in diameter with some of the logs measuring as long as four or �- five foot. These logs came down the creek during the high water. There were several other shorter logs, but measuring about the same in diameter. In addition, I observed a 'rt; 1 '<<';;•a part of a yard tie wall that was made out of small yard ties, normally used for flower yt, f.LtSixfiJ;i gardens. Someone must have built this wall along the creek and it washed away in the -y high waters. I also observed other debris, such as large signs, tree limbs, leaves etc. These ':. logs, yard ties and other debris came down the creek during the hard rain. The logs and 'r ties of turned crossways at the pipe and the other debris became entangled in these logs g Y P P and ties. I was wondering if the City of Jefferson has the .rt names and addresses of the families who reside along this creek and, if so,would the r° City consider reminding/warning families along the creek to be cautious petUining to what they place in or near the creek. 'A } Since our houses are not considered to be located in a flood plain,we are not eligible to apply for flood insurance. Therefore,we are at our neighbor's mercy concerning ; .f proper maintenance of the creek and, I assume,we are at the City of Jefferson's mercy to make sure our neighbors do what is right in this regard. x = I am also concerned about the size of the pipe that runs under my neighbor's driveway. It appears to be too small to handle the water run off that runs down this creek during hard rains and during snowmelt. Within the past few years, during hard rains thei y% creek has come very close to overflowing its banks, even without the pipe getting clogged up. �:r�. ' At recent council meetings and a rezoning meeting, many of the families in the neighborhood reported their concerns, about the water run-off into this creek and the t potential for flooding, to members of the city's council. However, to my knowledge, f nobody has initiated a review of this area in follow up to our concerns.
