HomeMy Public PortalAboutOrdinance No. 898-01 06-26-2001 ORDINANCE NO. 898-O1 • AN ORDINANCE AMENDING SECTION 5 "EXEMPT SIGNS" OF CHAPTER 14 "SIGN CODE" OF THE RICHLAND HILLS CODE OF ORDINANCES; REMOVING THE REQUIREMENT THAT SUCH SIGNS BE LOCATED AT LEAST TEN (10) FEET FROM THE EDGE OF A STREET; REQUIRING THAT SUCH SIGNS BE LOCATED SO AS TO NOT POSE TRAFFIC HAZARDS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, the Richland Hills City Council previously adopted a new sign code, contained in Chapter 14 of the Richland Hills Code of Ordinances; and WHEREAS, said sign code contains a requirement that political signs, on lots where no sidewalk exists, shall be located at least ten (10) feet from the edge of the street; and WHEREAS, the Richland Hills City Council has found through experience that such ten foot requirement is unnecessary; and • WHEREAS, the Richland Hills City Council desires to eliminate such requirement, but also desires to require that such signs be located so as not to pose traffic hazards; and WHEREAS, the Richland Hills City Council finds and determines that the following provisions concerning the location of political signs will promote the health, safety and general welfare of the citizens of Richland Hills, Texas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That paragraph (1) of Subsection E "NON-ILLUMINATED POLITICAL SIGNS" of Section 5 "EXEMPT SIGNS" of Chapter 14 "SIGN CODE" of the Code of Ordinances of the City of Richland Hills, Texas, same also being known as Ordinance No. 817-97, as amended, be hereby amended to hereafter be and read as follows: E. NON-ILLUMINATED POLITICAL SIGNS (1) With the permission of the property owner or tenant, non-illuminated political signs maybe erected in any zoning district with no limitation as to their number. On lots where a sidewalk exists within the streetright-of--way, • signs shall be located between the sidewalk and the structure. On lots where no sidewalk exists within the street right-of--way, the sign shall be located in such a manner so as not to cause a traffic hazard or otherwise obstruct a motorist's view of traffic on an intersecting street or driveway. Signs cannot • be erected sooner than thirty (30) days prior to the election and must be removed within ten (10) days of the completion of the election. (a) Political signs that are located on developed property zoned R-1L, R-1, R-2, R-3 and R-4, shall not exceed eight (8) square feet in effective area per side. (b) Signs erected on property zoned C-1, C-2, I-1 or I-2 shall not exceed thirty two (32) square feet in effective area per side. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. • Saving Clause. That Chapter 14 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
