AN ORDINANCE AMENDING CHAPTER 12 "ZONING" OF
THE RICHLAND HILLS CODE OF ORDINANCES TO ADD
A DEFINITION AND USE CATEGORY FOR "PALM/TAROT
CARD READER, PSYCHIC, ASTROLOGER"; ALLOWING
SAME AS PERMITTED USES IN INDUSTRIAL DISTRICTS;
PROVIDING A SAVING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE.
WHEREAS, the Richland Hills City Council recently enacted a new comprehensive zoning
ordinance for the City; and
WHEREAS, said new zoning ordinance contained numerous use categories and definitions
of uses; and
WHEREAS, since the time of the adoption of said new comprehensive zoning ordinance,
it has become apparent that a use category is needed for "Palm/Tarot Card Reader, Psychic,
Astrologer"; and
• WHEREAS, the City Council of the City of Richland Hills, Texas, desires by this
amendment to add a definition for such use and to amend the use table in the zoning ordinance to
allow such use as a permitted use in districts zoned I-1 or I-2, and
WHEREAS, proper notice of this proposed amendment has been given as required by law,
and public hearings thereon have likewise been held, as provided by law; and
WHEREAS, the following proposed amendment, after public hearing before the Richland
Hills Planning and Zoning Commission, received a recommendation to the City Council that such
amendment be adopted; and
WHEREAS, the Richland Hills City Council finds and determines that the following
regulations will promote the health, safety and welfare of the citizens of Richland Hills.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That Subsection B "Definitions for Uses" of Section 90-4 "DEFINITIONS", Article 1
"GENERAL PROVISIONS" of Chapter 12 "ZONING" of the Code of Ordinances of the City of
Richland Hills, Texas, as amended, be hereby amended by the addition thereto of a new definition
• for "Palm/Tarot Card Reader, Psychic, Astrologer",which new definition shall hereafter be and read
as follows:
• Palm/Tarot Card Reader, Psychic, Astrologer -pertaining to predictions of the
future based on intuitive or mental powers or supernatural influences and not
statistical or otherwise empirical evidence.
II.
That the "AMUSEMENT AND ENTERTAINMENT USES" portion of the permitted use
table contained in Section 90-201 "PERMITTED USE TABLE" of Article? "PERMITTED USES"
of Chapter 12 "ZONING" of the Code of Ordinances of the City of Richland Hills, Texas, as
amended, be hereby amended by the addition thereto of a new land use designation "Palm/Tarot
Card Reader, Psychic, Astrologer",with indication that such use is a permitted use innon-residential
districts I-1 and I-2, and with no special conditions listed therefor.
III.
Severability Clause. That it is hereby declared to be the intention of the City Council that
the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase,
• clause, sentence, paragraph or section.
IV.
Saving Clause. That Chapter 12 of the Code of Ordinances, City of Richland Hills, Texas,
as amended, shall remain in full force and effect, save and except as amended by this ordinance.
V.
Effective Date. This ordinance shall be in full force and effect from and after its passage and
publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of the
Richland Hills City Council on the 26thday of June , 2001, by a vote of 4 ayes, 0 nays,
and 0 abstentions.
