Section 1. The Mayor and City Clerk are hereby authorized and directed to execute
an agreement with State of Missouri for Wastewater Utility Services at the Jefferson City ', . x°

Section 2. The agreement shall be substantially the same in form and content asr
that agreement attached hereto as Exhibit A.

WHEREAS,The State owns a parcel of real estate and is constructing a new inmate correctional center,"Centel";
and
WHEREAS,The State owns and operates an adjoining correctional facility with self-contained wastewater facilities;
and

WHEREAS, the State desires to have wastewater service hereinafter Utilities available to the Center; and to '
remove itself fiom operation of the current self-contained wastewater facilities at the existing Correctional f

WHEREAS, there are at this time no wastewater lines connecting the Center or the existing facility to the City's
Utilities; and

quipment to the Center and to place responsibility for ownership, operation and maintenance of all wastewater f

and approximately twenty(20)acres contiguous thereto,more particularly described and shown on Exhibit

State of Missouri agrees to grant easements for all sewer lines,pump station and force mains which will be
owned and maintained by the City of Jefferson.

4. State Equipment
State shall install and maintain complete in place on correctional center property all necessary piping,valves,
fittings, pretreatment facilities (to include but not limited to the following, if applicable, fine screening, Y,n {tr =
shredding, oil & grease separation, and metal extraction equipment), pumping equipment, and any other
+` equipment required to enable the wastewater to properly discharge into City's sanitary sewer
` 5. Determination & Limitations Of Floe Quantities and Characteristics
City shall have the right at its sole discretion to determine physical,chemical,biological characteristics,and
flow quantities which can be properly discharged into the City's sanitary sewer.These characteristics,subject
;• ;, i to change by the City, are set forth in Article III of Chapter 29 Code of City, '.
Specific parameters to which the parties have agreed are as follows:
(A) Wastewater flows shall not exceed 565,000 gallons per day on a monthly daily average.
Allocation of the total daily average have been furnished to the City by the Department of
Corrections as follows:

6. State To Maintain, City's Right To inspect
State shall,at its sole cost and expense,install and maintain interior sewer service lines necessary to connect;,: ., a, ;

future will be properly maintained and operated so as to not adversely affect the operation and maintenance tF
of the City's sewer system. The Public Works Director and other duly authorized employees of the City
bearing proper credentials and identification shall be permitted to enter the property for the purpose of

A. State agrees to pay City its proportionate and fair share of all operations, testing and maintenance
costs associated with operations and maintenance of the sewers, pump stations, and treatment
facilities. The City will review annually it's actual cost of operation, maintenance and repair and
advise the State of any rate adjustments. The estimated cost of operation, maintenance and repair

B. A surcharge in addition to the normal user charge will be collected for wastewater the strength of
