MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH SCOTT AND KAREN

WHEREAS, Scott and Karen Raithel d/b/a Nick's Homestead has been selected as the
firm best qualified to provide professional services related to the Airport
' Restaurant Operation project; i
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. Scott and Karen Raithel d/b/a Nick's Homestead is hereby approved as
the best ualified firm to rovide professional services and its proposal is hereby accepted.
Section 2.The Mayor and City Clerk are hereby authorized to execute an agreement
with Scott and Karen Raithel d/b/a Nick's Homestead for Airport Restaurant Operation.

Section 3. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A.
Section 4. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

AMENDMENT TO LEASE
HEREAS, the City of Jefferson, Missouri, a municipal corporation, hereinafter designated "City," entered into a ,
4- ease with Nick's Family Restaurant, Inc., beginning November 1, 2001 and ending October 31,2002, hereinafter
referred to as "Tenant"; and i
WHEREAS,the Lease was for rental of the premises situated in the Jefferson City Municipal Airport Terminal Building,
tl„ commonly known as the Airport Cate,with certain furnishings and fixtures therein; and
WHEREAS, the parties wish to renew the Lease for a one (1) year period. ���I��Sgly!j-,,
NOW, EREFORE, be it agreed as follows:

t.s: 1. The second paragraph of the Lease dated October 2, 2001, is amended to read as follows:
Lessor hereby leases unto Tenant and Tenant hereby takes from the Lessor as Tenant, the
premises commonly known as the Airport Caf6, with certain equipment, furnishings, and ° J4
fixtures therein for a term of one(1)year commencing on the 1''day of November,zee+2002 ,+;
and terminating on the 31''day of October-2982 2003,with an option to renew said lease vt ' r
upon mutual agreement for fete-(4) three(3) additional terms of one (1) year on the same
terms and conditions. The option to renew said lease shall be expressed by Tenant by giving `;';;:473`r-
` written notice to Lessor of such desire to renew and lease at least ninety(90)days prior to the
expiration of the then current one 1 year period.
2. The third paragraph of the Lease dated October 2, 2001, is amended to read as follows: }st`.,
As rental for said Airport Cafe property, Tenant shall pay to the Lessor during the term ,
November 1,-2891 2002, through October 31, 2892 2003, the sum o nd Six
' <' +ice-Boliefs( r3,E,89 99}Six Thousand Dollars($6,000.00). Payment of the rent due under
this lease shall be paid in equal monthly installments and shall be due and payable in � y '
advance on the first day of each and every month to the City of Jefferson, Department of
Transportation,Airport Division. If the lease is renewed as set out herein,the rent ryU ',"R'
shall remain the same,subject to any adjustments provided herein. The renewal rate of the

commonly known as the Airport Cafd,with certain equipment, furnishings,and fixtures therein for a term `

provide a complete and proper arrangement for the adequate sanitary handling and disposal,

its business. Tenant shall provide and use proper receptacles for all such garbage,trash and
other refuse.

(i) This lease may be canceled by Lessor if Tenant fail to make any rental payment at the time
' M it is due, or for any violation of other covenants contained in this lease. If Tenant fail to
correct any default within five 5 days after Lessor has given written notice thereof,Lessor
}t may take immediate possession of the leased premises and remove Tenant effects forcibly, r

danger to Lessor,the public or to adjoining facilities,Lessor may close the leased premises

WHEREAS,the parties wish to renew the Lease for a one (1)year period.
NOW,THEREFORE,be it agreed as follows:
1. The second paragraph of the Lease dated October 2,2001,amended October 2,2001,is amended to read as follows:
Lessor hereby leases unto Tenant and Tenant hereby takes from the Lessor as Tenant, the premises
commonly known as the Airport Cafe,with certain equipment,furnishings,and fixtures therein for a term
of one (1) year commencing on the 1"day of November,2992 2003 and terminating on the 31" day of
October 20%2004,with an option to renew said lease upon mutual agreement for4hree-F3}two (2)
additional terms of one(1)year on the same terms and conditions. The option to renew said lease shall be
expressed by Tenant by giving written notice to Lessor of such desire to renew and lease at least ninety
(90)days prior to the expiration of the then current one(1)year period.
2. The third paragraph of the Lease dated October 2,2001,is amended to read as follows:
As rental for said Airport Cafe property,Tenant shall pay to the Lessor during the term November 1,-2M
2003,through October 31,20%2004,the sum of Six Thousand Dollars($6,000.00). Payment of the rent due
under this lease shall be paid in equal monthly installments and shall be due and payable in advance on the
first day of each and every month to the City of Jefferson, Department ofommunity
Development,Airport Division. If the lease is renewed as set out herein,the rent shall remain the same,
subject to any adjustments provided herein. The renewal rate of the second year shall be$6,000.00. The
• renewal rate for the third,fourth,and fifth year shall be$6,000.00.
3. All other sections of the Lease dated October 2,2001, and amended October 14, 2002, shall remain in effect as
previously agreed to.

AMENDMENT TO LEASE
WHEREAS,the City of Jefferson,Missouri,a municipal corporation,hereinafter designated
"City,"entered into a Lease with Nick's Family Restaurant,Inc.,hereinafter referred to as
"Tenant", on October 2, 2001, and amended October 14, 2002, and January 30, 2004 and;
WHEREAS, the Lease was for rental of the premises situated in the Jefferson City
Municipal Airport Terminal Building, commonly known as the Airport Cafe, with certain
furnishings and fixtures therein; and
WHEREAS,both parties wish to extend the lease for the third of four additional one-year
renewal periods as stipulated in Paragraph 2 of the agreement dated October 2, 2001, and
amended October 14, 2002, and January 30, 2004;
NOW,THEREFORE,be it agreed by the parties that the agreement is hereby renewed for
the third of four additional one-year periods periods to end October 31, 2005.
