WHEREAS, Scott and Karen Raithel d/b/a Nick's Homestead has been selected as the firm best qualified to provide professional services related to the Airport ' Restaurant Operation project; i NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Scott and Karen Raithel d/b/a Nick's Homestead is hereby approved as the best ualified firm to rovide professional services and its proposal is hereby accepted. The second paragraph of the Lease dated October 2, 2001, is amended to read as follows: Lessor hereby leases unto Tenant and Tenant hereby takes from the Lessor as Tenant, the premises commonly known as the Airport Caf6, with certain equipment, furnishings, and ° J4 fixtures therein for a term of one(1)year commencing on the 1''day of November,zee+2002 ,+; and terminating on the 31''day of October-2982 2003,with an option to renew said lease vt ' r upon mutual agreement for fete-(4) three(3) additional terms of one (1) year on the same terms and conditions. The option to renew said lease shall be expressed by Tenant by giving `;';;:473`r- ` written notice to Lessor of such desire to renew and lease at least ninety(90)days prior to the expiration of the then current one 1 year period. 2. The option to renew said lease shall be expressed by Tenant by giving written notice to Lessor of such desire to renew and lease at least ninety (90)days prior to the expiration of the then current one(1)year period. 2. The third paragraph of the Lease dated October 2,2001,is amended to read as follows: As rental for said Airport Cafe property,Tenant shall pay to the Lessor during the term November 1,-2M 2003,through October 31,20%2004,the sum of Six Thousand Dollars($6,000.00). Payment of the rent due under this lease shall be paid in equal monthly installments and shall be due and payable in advance on the first day of each and every month to the City of Jefferson, Department ofommunity Development,Airport Division. If the lease is renewed as set out herein,the rent shall remain the same, subject to any adjustments provided herein. The renewal rate of the second year shall be$6,000.00. The • renewal rate for the third,fourth,and fifth year shall be$6,000.00. 3. All other sections of the Lease dated October 2,2001, and amended October 14, 2002, shall remain in effect as previously agreed to.
