(508) 896-3701 EXT 11.75 The Brewster Old King's Highway Regional Historic District Committee, acting under the Massachusetts General Laws, Chapter 470, Acts of 1973 as amended, came to order at 7:00 pm virtually being recorded at the Brewster Town Hall. Committee members present were Jim Trabulsie (Chairperson), Tom Turcketta, Steven Bergquist, Carol Appleton, George Carey and Patricia Bausch. The Chairperson, Jim Trabulsie determined a quorum. CONTINUED APPLICATIONS H-23-2 Kathy Weatherby, 220 Long Pond Rd, Map 66 Lot 113 Solar • Members present and voting: Tom Turcketta, Steven Bergquist, George Carey, Carol Appleton and Patricia Busch. • Jim Trabulsie abstained himself from voting because he was not present at the previous meeting. • Diane Addison with My Generation Energy, represented the applicant. • Tom Turcketta said he signed the amendment for the garage's location that same day (February 6th) and they could proceed with the with this application. • The applicant pointed out that this was an add on to system on the farm. Total of 9 black flat panels to be installed farther away from the road. • Jim said he watched the previous meeting and had no problem with the panels since they are in the back and facing away from the street. • Carol asked how the issue of the garage's position was resolved. Jim said that the application was amended and signed by Tom Turcketta to keep the garage where it was and now, they were in compliance. • Steven said he drove by the garage the week prior and he agreed on the fact that the panels wouldn't be visible from the road. Pat said she remembered driving by and had no problem with it. Carol and George were fine with it as well. • Jim asked if there were any abutters online, there being none, Steven made a motion to approve as presented. Carol seconded the motion and a vote was taken. He pointed out that the overhead pictures showed arrows, but according to application they were not taking down any trees. • Diane Addison said they added a site plan late that showed that some trees were going to be taken down. She pointed out that the first picture, (aerial view) showed a ground mounted system and a large clear area in front of it, which is the neighbor's property who owns the corner of Old Freemans Way. She said the proposed panels would be about 250 feet from the road across from the clear area. Jim expressed his concern about the road being a public way. Diane said it was a road created by the homeowner. Since the public has access to the road, it was determined that the road was a private road. Jim asked how visible these panels would be from the road and Diane said they would comply with the setbacks. • Jim proposed to go to the site to see where the proposed panels would go before deciding. Steven agreed that a site visit would be helpful. Carol asked for the property to be staked. Jim said he would look more into the private and public way question because one of the considerations for the committee was minimal visual impact. He checked to see if the waiver was signed, but it wasn't. • Diane said that they would have to continue to the next meeting so the property could be staked out. Jim pointed out that they would have to deny the application due to being incomplete and Diane would sign the waiver within 72 hours. Diane said she could stop by the day after to sign the waiver. Jim told her they could be back in the agenda for the next meeting. The committee would find a convenient time to meet with the applicant at the property. • Jim asked for a motion of deny the application as long as the 45 day waiver was signed. Carol made motion to deny due to being incomplete pending the signing of the 45 day waiver. Tom seconded. All voted to deny pending the signing of the waiver. • Prior to adjourning the Committee discussed 120 Freemans Way being a private road. Tom said it wasn't on a scenic road. Jim said he was asking if it was a private way rather than privately owned to see if they would be visible from the road. Carol said that 150 linear feet of solar panels would make it the size of the solar panels at the Transfer Station. Jim expressed that they didn't know what the materials for the roof were going to be, if they were going to be shingles or if the siding was going to be wood, vinyl or clapboard and there were no cut sheets for the doors and windows or size or trim of the casing. Jim apologized for not noticing sooner, otherwise he would have requested that information. However, he didn't notice until Friday after the Town Hall was closed. He also noted that at least one abutter had asked to review these plans and receiving the information that same afternoon would have not been fair for the abutter. • Jim asked for the other member's comments. Steven and Tom both agreed that it was an incomplete application. Jim said that it is the applicant's responsibility to submit a complete set of plans. Jim said that they could be heard at the next meeting pending the signing of the 45 days waiver within 72 hours and the submission of the specification sheets as soon as possible. Tavis Babbitt agreed to it. • Tom asked for a site plan to be submitted with the rest of the information. • Danielle, the property owner raised her hand. Danielle said that the abutter and her lawyer received a copy of the plans prior and that the abutter had all the information she needed. As far as the materials, everything was going to align with the rest of the building. Meaning wood shingles painted the same color and trim to match the rest of the building. The only difference would be the expansion of the building, but the exterior was going to match. • Jim said that was exactly what he would expect but he didn't know what was sent to the abutter and if that information was sent to the abutter, why wasn't it sent to the committee. Danielle didn't know because this was left to the contractor. Danielle asked to hear the abutters' comments, but there were none. • Jim asked to see if there were any abutter letters but there weren't any. Jim explained that not just the abutter, but anyone has the right to look at the plans and that those weren't available when the abutter requested them. • Danielle reminded the committee that her lawyer gave the abutter a copy of the application. Also, she asked what plans the committee received because the abutters' lawyer received the plans and didn't ask for any more information. Danielle said that these meetings are uncoordinated and that probably the paperwork was lost. Jim asked again for a site plan and specification sheets that describe the materials to be used. Danielle said she would send those. However, the fact that she was being asked for a site plan in order to determine the appearance of the project was "far-fetched". The applicant was asked to sign the 45 days waiver to be able to be on the next meeting. • Jim asked for a motion to deny due to incomplete application and pending the signing of the 45 days waiver. Steve made the motion. Tom seconded. All members voted to deny due to incomplete application and pending the signing of the waiver. H-23-5 Paul Sullivan, 636 Long Pond Rd, Map 75 Lot 44 Addition • No one was there to represent the applicant, so it was decided to table the discussion and revisit after the other applicants. • After discussing all the other applications, the Committee was informed that Paul Sullivan, the owner, was present. • Paul Sullivan was asked to explain the project, but due to technical difficulties he couldn't be heard. • Jim said to the committee that they were going to try to do it on their own and asked the rest of the committee if they had questions. • Tom said he had no problem with the dormer above the garage since it was like for like. Pat and Carol both said they didn't have a problem with the application at all. Steven didn't have issues either. • Jim said that the steps would need risers and asked Davis; the Building Commissioner, who said those would be enforced during the inspection. Jim also asked about the solar panels on the rear of the garage where the addition was proposed and if they were planning to re -install those panels in the same place. • Paul Sullivan was able to rejoin the meeting but couldn't be heard again. • Jim asked for any abutters and there were none. • Carol made a motion to approve the application as presented. Steven seconded. Tom said he wasn't clear about the solar panels so Jim explained that they could accept an exemption to re -install the solar panels if the applicant decided to, even though that issue wasn't being addressed at that meeting. Tom said he was ok with the addition. They all voted to approve as presented. • Paul Sullivan rejoined the meeting and was asked about the relocation of the solar panels. He said they would go back on the roof of the dormer once it was finished. Pat seconded and all voted to accept the motion. Steve was elected as chair. Pat and George where the other two members voting on this application. • Susan Ladue from Eastward Companies, Bill Marsh and Don Poyant were present. • Susan said that they were proposing the removal of the existing covered porch and patio. Proposing to dismantle the existing barn and reuse those materials in the proposed addition to the home. They also wanted to relocate the shed. The applicants listed that they submitted the assessor's sheet and the abutters request form along with the 45 days waiver's pictures. Susan also said that the committee had met at the site and that under the recommendation of the Building Commissioner, they had an engineering survey done. • Don Poyant said the Committee had a site visit through the barn and house. He asked if there were any questions regarding the house. Steven said that he didn't have any questions about removing the porch. Neither Pat nor George had any questions. Bill said that they didn't think the barn was salvageable. Dominic DeAngelo, civil engineer, did an assessment of the barn which was submitted to the committee where it was stated that the barn was beyond repair and that they wanted to take it down. • Steven asked if there were any abutters. There were none, however there were two letters that were sent to the committee. The committee had reviewed the letters and Steve offered to read them even though Eastward had already seen them. Jim Trabulsie chimed in to say that due diligence would be done if they were read because even though Eastward had read them, the public might not have. • Steven read the letter from George Boyd, Chair of the Brewster Historical Commission dated February 2"d, 2023 where he expressed his view of preserving the barn. (See attached) • Steve also read a letter from Paul and Heather Mangelinkx from 766 Long Pond Rd. This letter was addressed to the committee members and dated January 30`h, 2023 where they expressed their view of preserving the barn (see attached). • Bill asked for the structural report from Dominic D'Angelo to be read as well so it would be part of the record. This report stated that the barn was structurally unsound. (See attached) • Steven asked for the opinion of the other members and there were none, so he asked to move to a vote. Pat said that due to the building's historic importance she was moved to deny. George said he reviewed all documents, and he was up for the preservation of the barn, so he voted to deny the demolition of the barn and front porch. Pat made motion and George seconded the motion. Steve voted to deny the application. Davis reminded the point of order of the procedure. Jim was asked to advice on the matter and he in fact said that the applicant could withdraw without prejudice since the vote hadn't taken place. • The committee voted to approve the withdrawal. George seconded the motion. They all voted to approve to the withdrawal of the application. H-23-8 Eastward MBT Trustees, 736 Long Pond Rd, Map 75 Lot 20 Single Family Dwelling • Again, due to possible ethic violations, Jim, Carol and Tom recused themselves from this application. • Steve was elected as a chair. • Steven went though the materials and specs of the application. • Steven asked the other two members if they had any questions. Pat asked if the windows on the left elevation's left corner were going to be separated and if there was a stud pocket between them. • Susan said that was the sunroom. Pat said she couldn't tell if there was a stud pocket in the drawing. Bill Marsh said they were planning on doing those and if they could talk about the lower and upper level separately. The lower level would be double hung windows with stud pockets. Pat asked to clarify the location of the stud pockets and said she couldn't hear too well because if the eco. Steven asked if the upper-level windows would have stud pockets as well. Bill said that was the sunroom and those would be casing windows that come as a unit. He said that if they needed the stud pockets, they could order the windows individually rather than as a group. Steve said that the drawing did not reflect the stud pockets and the applicant would have to redraw to reflect the changes as an amendment. Pat said that was be acceptable. • George asked if those windows would be crank out windows and the applicant said yes. George then asked if the orientation and right elevation faced Long Pond Rd. Susan said they were even though they could not be seen from the road. George asked how they wouldn't be seen, and Bill said that it was because the house on 724 obstructed the view. George asked if the house was going behind the barn and the applicant said yes. George again confirmed the orientation of the house was on Long Pond. • Bill expressed that zoom meetings were difficult as far as communications. He said he talked to Jon Idman, the Head of the Planning Department, who said that meetings would be going back to in person as of March 15th so Bill asked if that was true. Davis said that it was his understanding that this was the last online meeting. • George Motioned to approve as presented with an amendment of all windows to have stud pockets. Pat seconded. Next Meeting • March 6th, 2023, at 7pm Adjournment • Jim Trabulsie asked Davis to confirm if as of March 15th meetings would be in person since the next HDC meeting would be March 6th. Davis said the meeting was going to have to be re -scheduled because there was another meeting that night. • Steven made a motion to adjourn. Tom and Carol seconded the motion; a vote was taken, and the Committee voted unanimously to adjourn. 7
