No. 120– 127 Date of Adoptio Augus 27, 2020 AWARDING BID FOR THE REHABILITATION OF BERGEN STREET PUMP STATION WHEREAS, the Borough has publicly advertised for the receipt of bids for the Rehabilitation of the Bergen Street Pump Station; and WHEREAS, the Borough has solicited and received seven (7) bid proposals for the Rehabilitation of the Bergen Street Pump Station Project as follows: 1. Total Bid Base Bid Plus Allowance) $256,690.00 $264,300.00 $269,890.00 $307,000.00 $370,000.00 $383,723.00 $417,000.00 WHEREAS, Rapid Pump & Meter Service Co., Inc, of Paterson, NJ has submitted the lowest bid for said contract as evidenced by the response on file with the Borough's Purchasing Department and with the Borough Engineer; and WHEREAS, the Borough Engineer has reviewed the above bid proposals and has recommended the award of a contract to Rapid Pump & Meter Service Co., Inc., in a total amount not to exceed $256,690.00, per attached award letter; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Acct. It NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: 1. That the appropriate Borough Officials are hereby authorized to enter into a contract with Rapid Pump & Meter Service Co., hie., of Paterson, NJ for the Project for the sum of $256,690.00 in accordance in all respects with the request for proposals and bid on same. 2. That a copy of this Resolution shall be forwarded to the Borough's Purchasing Department, the Borough's Consulting Engineers Mott MacDonald and the Borough's Director of Engineering. 3. That the aforementioned award of bid is contingent upon formal approval from die New Jersey Department of Labor, Division of Wage and Hour Compliance. 4. DuPont, PE', CME, PP Director of Municipal Engineering 61 Cooke Avenue Carteret, NJ 07008 Borough of Carteret Contract 2019.1 Rehabilitation of Bergen Street Pump Station Report Upon Bids Received August 10, 2020 3 Paragon Way Freehold NJ 07728 Mr. DuPont, United States of America As requested, we have reviewed bids received by the Borough of Carteret T +1 (732) 780 6565 (Borough) on August 5, 2020 for Contract No. 2019 -1, Rehabilitation of Bergen F +1 (732) 577 0551 mottmac.com Street Pump Station. As the Borough is aware, the base scope of work under this contract includes the rehabilitation of the Bergen Street Pump Station to restore the facility to a state of good repair. The project involves critical repair and improvement of the Bergen Street Pump Station and most importantly includes the replacement of the two (2) existing sewage pumps, associated pump motor drives, pump discharge valves and piping, and the replacement of the station's discharge flow meter which is currently not operational. In addition to these process improvements, significant facility improvements are proposed including the replacement of pump motor controllers, main control panel and related power distribution and electrical improvements. Thirteen (13) contractors and suppliers purchased the bid documents for this contract of which, seven (7) contractors submitted proposals. With regard to the bids received, the apparent low bidder was Rapid Pump & Meter Service Co., Inc. (herein referred to as Rapid Pump), 285 Straight Street, P.O. Box AY, Paterson, NJ 07509 with a Total Bid (including Allowances) of $256,690. M The apparent second lowest bidder was Allied Construction Group, Inc., 499 M Washington Road, Partin, NJ 08859 with a Base Bid price of $264,300. The apparent third lowest bidder was Coppola Services, Inc., 28 Executive Parkway, MOTT Ringwood, NJ 07456 with a Base Bid price of $269,890. MACDONALD The bid documents of each of the three lowest bidders were reviewed for mathematical errors as well as inconsistencies with regard to bid form endorsements and supplemental documents. Fortunately, no mathematical or submission errors were identified in any of the three lowest bidders' documents however we recommend review by the Borough's Law Department. With regard to the bid prices received, the apparent low bidder's total Bid Price of $256,690 is approximately 2.9% less than the second bidder and 5.1% percent less than the third lowest bidder, which reflects the current highly competitive bidding environment. Based upon the bid cost difference between the apparent low bidder and second lowest bidder as well as the difference between the apparent low bidder and Engineer's Estimate, it appears that the Borough has received competitive and favorable pricing for the proposed work. Mott MacDonald has contacted the apparent low bidder and received confirmation that Rapid Pump is satisfied with its bid. Rapid Pump offered reassurance that its price is reflective of the full scope of the work and incorporates the use of named equipment and compliance with Buy - American provisions. Rapid Pump has been in business for over 50 years and has demonstrated their ability to complete projects of similar or greater complexity with successful results. We have contacted several references provided and all have provided favorable reviews of Rapid Pump's work. Mott MacDonald has also had many years of positive experience working with Rapid Pump on current and previously completed utility construction projects. Accordingly with respect to our review of the bid documents submitted and the prices received and favorable review of Rapid Pump's past work history, it is our recommendation that Contract No. 2019 -1, Rehabilitation of Bergen Street Pump Station, be awarded to Rapid Pump & Meter Service, Inc, in the amount of $256 contingent upon favorable review and concurrence by the Borough's Director of Law as well as formal written Authorization to Award by the NJDEP. In accordance with N.J.A.C. 7:22 -3.32 and N.J.A.C, 7:22 -4.32, our authorization to award this contract should not be construed as an actual or implied commitment of NJWB funds for this contract or the project as a whole. Our approval serves to allow the Borough to award the contract while retaining eligibility under the NJWB. The Borough must be aware that it is proceeding with constrilction of the contract at its own financial risk. After the contract has been signed, we will require a certified copy for our files. Forward only the contract pages which show the contract amount, the date and signatures of both parties, exclusive of the accompanying specifications. Certification that the appropriate bonds (performance and payment), if applicable, and all required insurances have been purchased must be provided to this office prior to the issuance of the notice to proceed with the work. Please note that in accordance with N.J.A.C. 7:22 -3.17 (a) 19 and N.J.A.C. 7:22 -4.17 (a) 19, evidence must be provided which verifies that the Borough of Carteret has included the State and its agencies, employees and officers as additional "named insureds" on any certificate of liability insurance of the contractor. Loanee name, project and contract number, and site location of the contract. b. Name, address, telephone number, and employee ID number (tax number) of the contractor who is awarded the contract. c. The date and the amount of the contract award. d. A confirmed date for the preconstruction meeting. Please note that the Department is required to participate in accordance with the enclosed form. e. Estimated date as to when the contract period will commence (notice to proceed date) and be completed, and an estimated date for the initiation of operation of the contract. f Estimated date as to when the final inspection of the contract will be conducted. Please note that a final inspection is required once all construction and restoration has been completed to the satisfaction of the Borough of Carteret and engineer. The loanee, the engineer, construction inspector and the environmental inspector representing the loanee, the contractor, inspectors from this office and a representative from the Department's Office of Diversity, Equal Opportunity and Public Contract Assistance must attend this conference. The following items as a minimum should be considered with regards to the preconstruction conference: 1) Call the NJDEP, Bureau of Construction, Payments and Administration, Construction Section to establish a date. 2) Invite the above listed attendees to the conference. Also, if applicable, we ask that you invite a representative from the Freehold Soil Conservation District to the meeting. 3) Schedule the preconstruction conference in two segments — a) A quick tour of the construction site. b) A meeting immediately after the site tour to discuss the procedures to be followed to comply with the construction and environmental requirements of the contract documents and applicable regulations. 4) Call the Department of Labor and Workforce Development, Construction EEO Monitoring Program at (609) 292 -9550 to determine if their attendance is necessary. Please realize that this conference will be limited to items primarily concerned with the Federal and State requirements of loan assisted projects. Therefore, it is not necessary to have representatives of the police, fire department, utilities, etc, at the conference.
