HomeMy Public PortalAboutOrdinance No. 910-01 09-11-2001 • ORDINANCE NO. 910-01 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS BY AMENDING ARTICLE 1, GENERAL PROVISIONS, SECTION 90-4, DEFINITIONS; ARTICLE 7, PERMITTED USES, SECTION 90-201, PERMITTED USE TABLE AND SECTION 90-202, CONDITIONS AND SPECIAL REGULATIONS FOR LISTED USES; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FORA SAVINGS CLAUSE; PROVIDING FOR A PENALTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 23, 1952, the City Council of the City of Richland Hills, Texas adopted a Zoning Ordinance for the City; and WHEREAS, an analysis of the City's codes and regulations has determined that an amendment to these codes and regulations are required in order to protect the health, safety, and welfare of the City and to comply with the development goals of the City; and WHEREAS, on August 6, 2001, the Planning and Zoning Commission of the City of Richland Hills has recommended that the Zoning Ordinance be revised in accordance with the procedures and processes established in that code for the Town; • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: Section 1 That the recitals set forth above are hereby incorporated herein, adopted by the City and found to be true and correct. Section 2 That the Zoning Ordinance of the City of Richland Hills, Texas be amended by amending Article 1, General Provisions, Section 90-4, Definitions, to add the following: Alcohol Sales Establishments, Drive-Thru -Any premises where alcohol is sold for the primary use, consisting of beer and wine for off-premise consumption and may offer prepackaged food products, household items, and other goods. Section 3 That the Zoning Ordinance of the City of Richland Hills, Texas be amended by amending Article 7, Permitted Uses, Section 90-201, Permitted Use Table, to add the following: Page 1 of 3 gisim • • • • - R®aic!le~el Nan-Residential Land klse Desig~Eiana Speclal Conditions • ~ AlcohvF Sales ! o, x Establishments, Drive- Thru Section 4 That the Zoning Ordinance of the City of Richland Hills, Texas be amended by amending Article 7, Permitted Uses, Section 90-202, Conditions and Special Regulations for Listed Uses, to add the following: x. Not permitted within 300 feet of any church, public school, or public hospital. Section 5 - Severability Sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6 -Savings • This Ordinance shall be cumulative of all other ordinances of the City affecting the regulations of land and zoning and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those Ordinances are in direct conflict with the provisions of this Ordinance. Section 7 -Penalty It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision hereof shall he fined, upon conviction, according to Article 1, General Provisions, Section 90-5, Violation and Penalties, of the Zoning Ordinance. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. • Page 2 of 3 aisin i • Section 8 -Effective Date This Ordinance shall become effective upon its passage by the City Council.
