HomeMy Public PortalAboutOrdinance No. 911-01 09-25-2001 • ORDINANCE NO. 911-01 AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 883-00 AND THE FISCAL YEAR 2000-01 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 883-00 on September 26, 2000, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2000-01; and WHEREAS, changed conditions resulted in the adoption of Ordinance Nos. 890-01 on January 23, 2001; 892-01 on March 13, 2001; 904-01 on August 14, 2001 and 906-01 on September 11, 2001, amending the budget adopted by Ordinance No. 883-00; and WHEREAS, changed conditions and circumstances, which could not have been foreseen through the use of reasonably diligent thought and attention, have necessitated a certain amendment to Ordinance No. 883-00, and the budget adopted thereby; and WHEREAS, a public hearing on the following amendment to the fiscal • year 2000-01 budget contemplated hereby has been held as required by law. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section III of said Ordinance No. 883-00 as amended be amended to increase the enterprise fund appropriation from $2,892,147 to $4,450,410 with such increase allocated and appropriated as follows: $1,432,409 such sum the surplus from the 1998 Certificates of Obligation issue, for transfer to the 1998 Certificates of Obligation Interest and Sinking Fund as required by said issuance ordinance for repayment of debt. $125,854 such sum an amount to fund a budgetary shortfall resulting from unexpectedly high wastewater treatment costs charged to the City by the cites of Fort Worth and Hurst. II. That Section V of said Ordinance No. 883-00 as amended be amended • appropriating $166,900 out of the 1993 Utility System Revenue Bond Interest • and Sinking Fund for the repayment of water and sewer works general long-term debt principal and interest. II1. That Section VI of said Ordinance 883-00 as amended be amended appropriating $265,856 out of the 1998 Certificate of Obligations Interest and Sinking Fund for the repayment of wastewater works general long-term debt principal and interest. IV. That section VII of said Ordinance No. 883-00 as amended be amended appropriating $30,986 out of the 1994 Personal Property Finance Contractual Obligations Interest and Sinking Fund for the payment of general long-term debt principal and interest. V. That Section VIII of said Ordinance No. 883-00 as amended be amended appropriating $68,353 out of the 1998 General Obligations Interest and Sinking Fund for the repayment of general long-term principal and debt. • VI. That Section X of said Ordinance No. 883-00 as amended be amended appropriating $872,965 out of the 1998 Certificates of Obligations issue for wastewater system improvements. VII. That Section XII of said Ordinance No. 883-00 as amended be amended appropriating $1,021,096 out of the Economic Development 4B fund for water and street improvements and property acquisition. VII1. That Section XVI of said Ordinance No. 883-00 as amended be amended appropriating $47,365 out of the 1996 Personal Property Finance Contractual Obligations Interest and Sinking Fund for the payment of general long-term debt principal and interest. • • IX. That Section XVII of said Ordinance No. 883-00 as amended be amended appropriating $127,770 from the Equipment Replacement Fund, for the purchase of capital assets. X. That Section IV of said Ordinance No. 883-00 as amended be amended appropriating $75,036 out of the Parks and Beautification Fund for the payment of capital costs related to public parks, recreation and beautification programs and improvements. XI. That Section XIII of said Ordinance No. 883-00 as amended be amended appropriating $536,031 out of the Road and Street Improvement Fund for improvements to city streets. XII. Severability Clause. That it is hereby declared to be the intention of the • City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XI11. Saving Clause. That Ordinance No. 883-00 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. XIV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas. • • PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of the Richland Hills City Council on the 25th day of September, 2001, by a vote of 5 ayes, o nays, and o abstentions.
