Chatelain Board members absent:Annette Graczewski, MT (ASCP) Others present:Amy von Hone, R.S., C.H.O., Health Director; John O'Reilly, J.M. O'Reilly &Associates Inc. (remotely); Adrienne Jones, Realtor for 141 Long Pond Road (remotely); Joseph Hartung, Realtor(remotely) and Chris Childs (remotely). 1. Call to order Meeting was called to order at 6:30PM 2. Chair announcements None. 3. Citizen's forum None. 4. Request for determination of number of bedrooms at 141 Long Pond Road Amy von Hone (AVH) stated that this home is being sold. An inspection report was done and submitted "needs further review" because the existing system was not large enough to hand le the number of bedrooms. There are 3 bedrooms in the main house and a detached building that would meet the definition of a bedroom. There were discrepancies in the septic plan. The inspector was asked to determine the amount of stone around the leaching pit. Which he did and it was determined to be just shy of 440 gallons per day. Adrienne Jones (AJ), Realtor for seller stated that the detached building was one big room and has a set of French doors and a single door. When the current owner bought it in 2014, it was sold to her as a 3 bedroom with the detached building, which she never used. AVH-the Health Department did sign off on a building waiver for the detached building as an "after the fact" permit in 2005. Kimberley Crocker Pearson (KCP)-believes the detached building would meet the definition of a bedroom. Joseph Hartung (JH), realtor for buyer, questioned why this detached building was previously ok'd and why it was changing now. KCP-when a property is sold,that triggers re-considerations of some aspects of septic systems. David Bennett(DB)—question the repair permit that was issued. AVH-went over the different inspections and what was written on them (3 vs 4 bedrooms) DB-the Town did act on a permit that made this 4th bedroom. He feels that this is a 4 bedroom home and the Assessors records should reflect that. He asked if there was a stove or refrigerator in the building. AJ- no stove or refrigerator. There are cabinets. DB-was this building represented as and Accessory Dwelling Unit(ADU) at any time. He was told it was not. He stated that the new owners should be aware that it is not an ADU. Penny Holeman (PH)—asked if this lot restricted in any way that would make it so a 4th bedroom wouldn't be allowed. AVH-there are no restrictions on the lot. DB-doesn't think there is criteria for failure with this report and believes it should be a 4-bedroom home. Motion: Characterize this property as a 4 bedroom and accept the septic inspection report that says "needs further review"with the caveat that the Board has done a review and made the decision based on the fact that the permit was issued for the connection from the detached building to the septic system, thereby creating the 4th bedroom. Motion: David Bennett Second: Penny Holeman (for discussion) Motion:Amend the original motion to include notifying the Assessors that the Board is stating this is a 4 bedroom home Motion: David Bennett Second: Penny Holeman Vote: 3-1 Action: Motion carried 5. Variance Request—38 Captain Baker Road,300'setback to Pond AVH told the Board that this request is stemming from a Real Estate Transfer Inspection. The septic is 238' to the pond. It is an existing 2002 Title 5 with 3 trenches running parallel to the pond. The inspection report did pass apart from the SAS being to close to the pond. The entire lot is within 300'. There is a 12' separation between the water and the bottom of the trenches. It is upgradient of Long Pond. John O'Reilly (JO) stated that there was no way to get a new system further away from the pond because of a drinking water well across the street. DB-spoke about the potential new regulations coming down from Department of Environmental Protection (DEP) and that this lot may be effected and this information should be made known to the buyers. Motion: Approve variance as requested. Motion: Penny Holeman Second: Casey D. Chatelain Vote:4-0 Action: Motion carried 6. Request for extension to BOH variance approval (expires 115123)at 89 Byfield Cartway AVH-the BOH approved this variance on January 5, 2022. Variances are good for 1 year. Because of a delay in the Building Permit approval,the septic system will not be done before the variances expire. Chris Childs- stated that his company is trying to get the home weather tight before winter sets in. He will get the system in ASAP and would be good with a 6-month extension. AVH-the septic permit is good through August 12, 2023. DB-asked if the Conservation approval was still valid and was told it is. Motion: Extend the variance for one(1) year. Consent Agenda In-House approval—58 Pilots Way AVH-stated that this was a small lot and the request was for a setback from the SAS to the property line. Motion:Approve the consent agenda. Review and Approve BOH Minutes of 7/20/22,8/17/22, 9/21/22, 10/5/22 and 11/2/22 PH-asked for a grammatical change and that we write out the proper names and then use initials. Motion:Approve minutes with changes Motion: David Bennett Second: Casey D. Chatelain Vote:4-0 Action: Motion carried 9. Liaison Reports DB-talked about the Water Quality Advisory Committee meeting. They will be sending a written response re: logistics, funding and implementation 10. Matters not reasonably anticipated by the Chair None. 11. Items for next agenda DB-stated that he sent an I/A date flow diagram to AVH. That and the Pressure Dose letter to homeowners will be discussed at the February meetings. DB let the Board know that he will be attending meetings remotely until 2/16/23. 12. Next meeting:January 18, 2023 Informational items were noted. Meeting adjourned at 7:30PM
