AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH OMNIPOINT FOR
CELLULAR COMMUNICATIONS FACILITIES LOCATED AT FIRE STATION #3.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to execute
an agreement with OmniPoint for location and operation of cellular communications
facilities at-Fire Station #3. p
Section 2. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date <r
of its passage and approval.

exclusive easement for reasonable access thereto and to the appropriate,in the discretion of the Tenant,source

9.' Improvements.
Tenant may, at its expense,make such improvements on the Site as it deems necessary from time to time for
the operation of a PCS with prior notification of the City. No such improvements shall interfere with the
' normal use of City property. Tenant shall be responsible, at its sole expense, for all maintenance of the Site.
Tenant shall have the right to fence that portion of the Site which contains the ground based equipment. The
City agrees to cooperate with Tenant with respect to obtaining any required zoning approvals for the Site and
such improvements. Upon termination or expiration of this Agreement,Tenant shall remove its equipment and ;�,�;;��_"�t��};:•
improvements and will restore the Site to substantially the same condition existing on the Commencement
Date,except for ordinary wear and tear and casual loss provided

(60) days prior to termination, all title to the tower may be transferred to City and City shall henceforth
maintain and operate the tower. In the event of removal,all improvements shall be removed to a depth of four

Tenant will resolve technical interference problems with other equipment located at the Site oil the

Tenant shall verify all existing underground utility locations and shall be responsible for repair of any damage
caused by installation of the Site. Routing of all utilities shall be clearly marked and must be approved b the
