AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE �>
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MISSOURI
AMERICAN WATER COMPANY FOR SEWER BILLING SERVICES. ,
NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1.The Mayor and City Clerk are hereby authorized to execute an agreement
with Missouri American Water Company for Sewer Billing Services.
Section 2. The agreement shall be substantially the same in form and content as -
that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

THIS AGREEMENT is made and entered into by and between the Jefferson City Water Works
Company,Inc,., a corporation organized under the laws of the State of Missouri, its successors and ,';''r'�t``'
assigns, hereinafter referred to as the "Water Company," and the City of Jefferson, Missouri, a xir rx.'fi'•,:;_:

{ WHEREAS, the Water Company is engaged in the business of providing water service to
the general public in the City and areas adjacent thereto; and
WHEREAS, the City operates a wastewater collection and treatment system in.the City and

;. charges its residents for such service; and
WHEREAS, the City has requested the Water Company to perform billing, collecting and ,
accounting for customers of the City receiving wastewater treatment service,and the Water °n'; f,h •',';
Company has agreed to provide such services to the City, all pursuant to the terms and
t. conditions contained herein; and,
WHEREAS, Section 393.015 RSMo permits City and the Water Company to enter into an ' 7`E.i` `i
agreement whereby Water Company may terminate water service to a premises to facilitate ,;;y,," °,;
collection of charges for wastewater treatment service. ,
NOW,THEREFORE, for and in consideration of the covenants contained herein,Water Company

1. A The City and the Water Company shall jointly, designate and cause to be
identified on the Water Company's billing records,each customer of the Water Company who is also
a wastewater treatment customer of the City the "Joint Accounts" The Water Company shall bill ',} '{ i
all Joint Accounts for wastewater treatment charges on behalf of the City, at the rates provided to t`
it by the City pursuant to Section 3 herein.
i 13 Upon receipt of a written request from the City,the Water Company shall bill
the City's wastewater treatment customers who are not Water Company's customers (the it3fh ',

billed at a rate pursuant to the City's regulations as they may exist,provided
the City furnishes any necessary water meter readings for such customers to
` the Water Company and requests that such customers be billed at the meteredt� 1.

2. The Water Company shall be responsible for the wastewater treatment
customer billing,collecting,and accounting service for onl those users of the wastewater treatments
system of the City identified pursuant to Section l above, and only during the term of this

3. The City hall, prior to the commencement of billin services b the Water

Company pursuant hereto, furnish the Water Company with an ordinance authorizing the rate or
rates to be charged for wastewater treatment services, and charges to be applied to delinquent
accounts,if any. The City shall notify the Water Company of any revisions to such rates sixty(60)
days prior to the billing cycle for which these rates become effective. All charges for wastewater
treatment fees billed by Water Company on behalf of City will not be subject to the Utility Gross '' tr
Receipts Tax levied by City against public utilities,unless City instructs Water Company in writing
to the contrary. , `` "j
4. The wastewater treatment customers to be billed by the Water Company

5. The Water Company shall administer the accounts of the City and prepare the

;i accordance with the regular and periodic billing procedures followed by the Water Company in the

7. The Water Company will (i) calculate, as set forth above, the applicable
wastewater treatment charges for each of the City's wastewater treatment customers identified
pursuant to Section 1; (ii) print both a wastewater treatment charge amount and a water charge t',^;,.'{`•t�yf;
amount for Joint Accounts or print a wastewater treatment charge amount for Wastewater Treatment

8. In the case of Joint Accounts,the City will take whatever action is authorized
to have wastewater treatment service and the liability therefore, placed in the same person as is the
water service for such account. An example of this requirement would be in the case of rental
property, where the landlord is billed instead of the tenant(s) or vice versa.

transfer into a bank account designated by the City, by the tenth 10" of each month such

City's wastewater treatment customers, including(monthly)open balance reports,daily transaction
reports,daily updating reports,(monthly)customer record reports,and(monthly)revenue summary

Company related to services rendered under this Agreement. Water Company will provide any such
forms and procedures.

14. At the City's request, the Water Company agrees to provide all computer

computer hardware and communication lines to be installed to provide such on-line access. City
agrees to purchase all required hardware and software and to pay for any communication line
