HomeMy Public PortalAboutOrdinance No. 921-01 12-11-2001 • ORDINANCE NO. 921-01; AN ORDINANCE OF THE CITY OF RICHLAND HILLS ADOPTING THE 2000 EDITION OF THE INTERNATIONAL RESIDENTIAL CODE, AND LOCAL AMENDMENTS; AMENDING SECTION 14-76 OF THE CITY CODE BY ADOPTING THE 1999 EDITION OF THE NATIONAL ELECTRICAL CODE, AMENDING SECTION 14-77 OF THE CITY CODE BY ADOPTING LOCAL AMENDMENTS TO THE 1999 EDITION OF THE NATIONAL ELECTRIC CODE; ADOPTING THE 2000 EDITION OF THE INTERNATIONAL ENERGY CONSERVATION CODE, AND LOCAL AMENDMENTS; PROVIDING FOR THE MODIFICATION OF THE CODES TO INCORPORATE LOCAL AMENDMENTS; PROVIDING FOR RECORDING OF THE CODES AS A PUBLIC' RECORD; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the • Local Government Code; and WHEREAS, the 2001 Texas Legislature in Senate Bill 365 amended Chapter 214 of the Local Government Code by adopting the International Residential Code and the National Electrical Code as the 1Vlunicipal Residential Building Code and Residential Electrical Construction Code in the State applying to all residential construction applications after January 1, 2002; and WHEREAS, the 2001 Texas Legislature in Senate Bill 5 adopted the International Energy Conservation Code as the Energy Code of the State after September 1, 2002; and WHEREAS, the City Council of the City of Richland Hills desires to adopt the International Residential Code, the National Electrical Code, and the International Energy Conservation Code in compliance with the legislative mandates referenced above; and WHEREAS, the City Council of the City of Richland Hills desires to provide a mechanism by which local modifications reflecting the unique needs of the City of Richland Hills may be made when deemed appropriate. • 'vV:'~Richland Hills\ordinances\Ordinance adopting L000 IRC, 1999 NEC a~~d 2000 [EC('.wnd Page 1 • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. Chapter 14 of the Richland Hills Code of Ordinances is amended by the addition of a new Article X, Section 14-400, which shall read as follows: "The 2000 Edition of the International Residential Code is hereby adopted as the official residential building code of the City of Richland Hills, Texas. This residential code is fully incorporated by reference as though copied into this Code in its entirety. The material contained in the International Residential Code shall not be included in the formal municipal codification of ordinances but shall be maintained as a public record in the office of the City Secretary and will be available for public inspection and copying during regular business hours." SECTION 2. Chapter 14 of the Richland Hills Code of Ordinances is amended by the addition of a new Article X, Section 14-401, which shall read as follows: "The 2000 Edition of the International Residential Code, as adopted herein is hereby amended. The amendments, although fully adopted and incorporated by • reference, shall not be included in the formal municipal codification of ordinances. The amendments shall instead by maintained as a public record in the office of the City Secretary and the Building inspector. These exhibits will be available for public inspection and copying during regular business hours." SECTION 3. A copy of the amendments to the 2000 Edition of the International Residential Code adopted by the City are attached hereto as Exhibit A. SECTION 4. Section 14-76 of Chapter 14 of the Richland Hills Code of Ordinances is amended to read as follows: "The 1999 Edition of the National Electrical Code is hereby adopted as the official electrical code of the City of Richland Hills, 'Texas. This electrical code is fully incorporated by reference as though copied into this ordinance in its entirety. The material contained in the National Electrical Code shall not be included in the formal municipal codification of ordinances but shall be maintained as a public record in the office of the City Secretary and will be available for public inspection and copying during regular business hours." • W:ARichland Hills\ordinances\Ordinance adopting 2000 IRC, 1999 NEC and 2000 [ECC.wpd Page 2 • SECTION 5. Section 14-77 of Chapter 14 of the Richland Hills Code of Ordinances is amended to read as follows: "The 1999 Edition of the National Electrical Code, as adopted herein is hereby amended. The amendments, although fully adopted and incorporated by reference, shall not be included in the formal municipal codification of ordinances. The amendments shall instead by maintained as a public record in the office of the City Secretary and the Building inspector. These exhibits will be available for public inspection and copying during regular business hours." SECTION 6. A copy of the amendments to the 1999 Edition of the National Electrical Code adopted by the City are attached hereto as Exhibit B. SECTION 7. Chapter 14 of the Richland Hills Code of Ordinances is amended by the addition of a new Article XI, Section 14-420, which shall read as follows: "The 2000 Edition of the International Energy Conservation Code is hereby • adopted as the official energy conservation code of the City of Richland Hills, Texas. This energy conservation code is fully incorporated by reference as though copied into this ordinance in its entirety. The material contained in the International Energy Conservation Code shall not be included in the formal municipal codification of ordinances but shall be maintained as a public record in the office of the City Secretary and will be available for public inspection and copying during regular business hours." SECTION 8. Chapter 14 of the Richland Hills Code of Ordinances is amended by the addition of a new Article XI, Section 14-420, which shall read as follows: "The 2000 Edition of the International Energy Conservation Code, adopted herein, is hereby amended. The amendments, although fully adopted and incorporated by reference, shall not be included in the formal municipal codification of ordinances. The amendments shall instead by maintained as a public record in the office of the City Secretary and the Building inspector. A copy of the amendments to the 2000 Edition of the International Energy Conservation Code adopted by the City are attached hereto as Exhibit C. SECTION 10. The material contained in Exhibits A through C to this ordinance, although fully adopted and incorporated by reference, shall not be included in the formal municipal codification of ordinances. The material contained in Exhibits A through C shall instead by maintained as a public record in the office of the City Secretary and the Building inspector. These exhibits will be available for public inspection and copying during regular business hours. The purpose of maintaining these records separate and apart from the municipal codification is to avoid the inclusion of detailed technical construction materials, subject to frequent change, which would unreasonably lengthen the code. SECTION 11. The City of Richland Hills may from time to time determine that additional local modifications to the codes adopted herein are necessary and appropriate to meet the unique building needs of the City of Richland Hills. To effectuate modifications, the city council may enact individual ordinances amending this ordinance fully setting forth the change to be made in the specific code. Such subsequent amendments shall be consolidated as an exhibit to this ordinance, and shall be maintained as a public record in the office of the city secretary. • SECTION 12. This Ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 13. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining, phrase, clauses, sentences, paragraphs or sections of this Ordinance since the same would have been enacted by the City Council without incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 14. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined no more • than Two Thousand Dollars ($2,000.00) for all violations involving zoning, fire safety or public W:ARichland Hills\ordinances\Ordinance adopting 2000 IRC, 1999 NEC and 2000 [ECGwpd Page 4 health and sanitation, including dumping or refuse, and shall be fined not more than Five Hundred • Dollars ($500.00) for all other violations of this Ordinance. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 15. All rights and remedies of the City of Richland Hills, Texas, are expressly saved as to any and all violations of the provisions of the Building Code, Electrical Code, Energy Code or any other ordinances affecting such codes which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances same shall not be affected by this Ordinance but maybe prosecuted until final disposition by the courts. SECTION 16. The City Secretary of the City of Richland Hills is directed to publish the caption, penalty clause, publication clause and effective date of this Ordinance in one issue of the official city newspaper as authorized by Section 52.013 of the Local Government Code. SECTION 17. The City Secretary of the City of Richland Hills is hereby authorized to publish this ordinance and the exhibits to this ordinance in book or pamphlet form for general distribution among the public, and the operative provisions of this ordinance and the exhibits to this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof. SECTION 18. This Ordinance shall be in full force and effect form and after its passage and publication as provided by law, and it is so ordained. The codes when specifically adopted, and standards referenced in this code shall be considered part of the requirements of this code to the prescribed extent of each such reference. Enclosed accessible space under stairs shall have walls, under stair surface and any soffits protected on the enclosed side with 5/8-inch (15.8 mm) fire-rated ' ~~-~-T rte-) gypsum board or one-hour fire-resistive construction. In all framed walls, floors and roof/ceilings comprising elements of the building thermal envelope, a vapor retarders when installed, shall be installed in a manner so as to not trap moisture (delete the exceptions) (Reason: This eliminates the requirement of a vapor retarder throughout the NCTCOG region, while giving reasonable guidance if a vapor retarder is installed. When ties are placed on studs 16" o.c., they shall be spaced no further apart than 29" vertically starting approximately 15" from the foundation. 2. When ties are placed on studs 24" o.c., they shall be spaced no further apart than 19" vertically starting approximately 10" from the foundation. (Reason: Provide easy to install and inspect dimensions for clarity.) '`'`Section R703.7.4.2; add a second paragraph to read as follows: When using ties that will flex when pushed, spot bedding of cement mortar shall be installed on all ties. The exterior air intake shall be capable of providing all combustion air from the exterior of the dwelling or from spaces within the dwelling ventilated with outside air such as crawl-er attic spaces. (Reason: Problems have arisen with using crawl space ventilation.) • North Central Texas 4 February 2001 2000 IRC amendments • **Section N1101.2; amend as follows: N1101.2.1 Residential Buildings, Type A-1. Compliance shall be demonstrated by-ei#f~er one of the following: 1. Meeting the requirements of this chapter for buildings with a glazing area that does not exceed 15 percent of the gross area of exterior walls; er 2. Meeting the requirements of this chapter for buildings with a glazing area that is greater than 15 percent but not exceeding 20 percent of the gross area of exterior walls and air conditioning equipment rated 12 SEER or higher; 3. Meeting the requirements of this chapter for buildings with a glazing area that is greater than 20 percent but not exceeding 25 percent of the gross area of exterior walls and air conditioning equipment rated 14 SEER or higher; or 4. Meeting the requirements of the International Energy Conservation Code for residential buildings, Type A-1. (Reason: This amendment would increase the number of builders who could use this "simplified prescriptive" approach of the IRC. It accommodates particularly the move-up and luxury homes with large glazing areas. The trade-off with air-conditioning is an option under the IECC systems analysis or MECcheck approach, and is brought into this format for convenience only. Other IECC trade-offs would also remain available. The intent is to maintain compatibility with the IECC. The intent would include adjustment of this provision at such future date that the minimum federal equipment standards are raised to achieve equivalent increases in energy savings.) **Add Section N1101.3.4 to read as follows: • N1101.3.4 Exterior basement or slab insulation. When susceptibility to termite damage is classified as "very heavy" according to Table R301.2(1) designs employing basement or slab exterior insulation capable of harboring termites shall not be utilized. (Reason: Usage of exterior insulation provides access for termites. This amendment does not preclude the use of insulating coatings that do not provide termite access or shelter.) **Section N1102.1 amend as follows: N1102.1 Thermal performance criteria. The minimum required insulation R-value or maximum required U-factor for each element in the building thermal envelope (fenestration, roof/ceiling, opaque wall, floor, slab edge, crawl space wall and basement wall) shall be in accordance with the criteria in Table . N1102.1. Residential building, Type A-1, with greater than 45-25-percent glazing area; residential buildings, Type A-2, with greater than 25-percent glazing area; and any building in climates with HDD equal to or greater than 13,000; shall determine compliance using the building envelope requirements of the International Energy Conservation Code. (Reason: This amendment corrects a printing error in the IRC and avoids confusion over the intent to • maintain consistency with requirements of the IECC.) **Add Section M1304.2 to read as follows: M1304.2 Minimum burial depth. Underground fuel piping systems shall be installed a minimum depth of 18 inches (458 mm) below grade. (Reason: To provide increased protection to piping systems.) **Section M1305.1.3; change to read as follows: M1305.1.3 Appliances in attics. Attics containing appliances requiring access shall be provided . {bulk of paragraph unchanged} ...sides of the appliance where access is required. The clear access opening dimensions shall be a minimum of 20 inches by 30 inches (508 mm by 762 mm), or larger where such dimensions are not large enough to allow removal of the largest appliance. As a minimum, access to the attic space shall be provided by one of the following: 1. A permanent stair. 2. A pull down stair. 3. An access door from an upper floor level. Exception: The passageway and level service space are not required where the appliance is capable of being serviced and removed through the required opening. • (Reason: To provide a safe means of accessibility to appliances in attics.) North Central Texas 6 February 2001 2000 IRC amendments • **Add Section M1305.1.5, M1305.1.5.1 to read as follows: M1305.1.5 Water heaters above ground or floor. When the mezzanine or platform in which a water heater is installed is more than eight (8) feet (2438 mm) above the ground or floor level, it shall be made accessible by a stairway or permanent ladder fastened to the building. M1305.1.5.1 Whenever the mezzanine or platform is not adequately lighted or access to a receptacle outlet is not obtainable from the main level, lighting and a receptacle outlet shall be provided in accordance with Section M1305.1.3.1. (Reason: To provide safe access to water heaters and to provide lighting and receptacle for maintenance of equipment.) **Section M1305.1.3.1; add a sentence to read as follows: Low voltage wiring of 50 Volts or less shall be installed in a manner to prevent physical damage. (Reason: To call attention to the need for care while installing lighting wiring in attic.) **Section M1305.1.4.1; change to read as follows: M1305.1.4.1 Ground clearance. Appliances supported from the ground shall be level and firmly supported on a concrete slab or other approved material extending above the adjoining grade a minimum of 3 inches (76 mm). Appliances suspended from the floor shall have a clearance of not less than 6 inches (152 mm) above the ground. • (Reason: Consistent with current local practice.) **Section M1305.1.4.3; add a sentence to read as follows: Low voltage wiring of 50 Volts or less shall be installed in a manner to prevent physical damage. (Reason: To call attention to the need for care while installing lighting wiring under floors.) **Section M1307.3.1; delete. (Reason: This provision does not reflect standard practice in this area.) **Section M1501.2; change to read as follows: M1501.2 Exhaust duct size. The minimum diameter of the exhaust duct shall be as recommended by the manufacturer ar~d shall be at least the diameter of the appliance outlet and shall be a minimum nominal size of 4 inches (102 mm) in diameter. The size of duct shall not be reduced along its developed length nor at the point of termination. (Reason: To clarify the size requirement.) • North Central Texas 7 February 2001 2000 IRC amendments . "*Section M1501.3; change to read as follows: M1501.3 Length limitation. The maximum length of a clothes dryer exhaust duct shall not exceed 25 feet (7620 mm) from the dryer location to the wall or roof termination with not more than two bends. When extra bends are installed, the maximum length of the duct shall be reduced 2.5 feet (762 mm) for each 45-degree (0.79 rad) bend and 5 feet (1524 mm) for each 90-degree (1.6 rad) bend that occur after the first two bends, measuring in the direction of airflow. The maximum length of the exhaust duct does not include the transition duct. {Exception is unchanged} (Reason: To make more consistent with regional practice. Dryer technology has improved to the point where they should be capable of handling this.) ""Section M1601.3.4, item #1; change to read as follows: 1. Duct insulation shall conform to the requirements of Table M1601.3.4 and Section N1101.2. Should there be any conflicts between this section and the energy efficiency provisions, the energy efficiency provisions shall take precedence.
