Section 1. The Mayor and City Clerk are hereby authorized and directed to execute
improvements

on Chestnut Street.
Section 2. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date

sidewalk improvements on the west side of Chestnut Street near the Lincoln University stadium;and

(c) Assignment. Neither party shall assign any interest in this contract nor transfer any

with the construction or to create any contractual or other relationship, express or
implied between the City and any material men, contractors, laborers suppliers or
others furnishing any work, labor or materials in connection with the construction of
the Development.

contractors, laborers, suppliers or others furnishing any work, labor or materials in

1.4 Prevailing Wages

subject to prevailing wage law,University shall cause the Contractor to pay a wage of no less
than the"prevail in hourly rate of wages" for work of a similar character in this locality, as
established by Department of Labor and Industrial Relations of the State of Missouri, and as
established by the Federal hourly rate of wages for this project. Contractor or University shall ?°s"'r .1-P,111,
obtain the prevailing hourly rate of wages from the contents of Annual Wage Order No.6 in " �' ''.`

which the rate of wages is set forth. The Contractor shall further agree with the work to be

OBLIGATIONS OF University
4.1. University,its successors and assigns shall install any and all other public improvements
required as part of or a pp licable to the development in accordance with all city standards and
specifications at the time that the land described above is developed through plat approval or site plan
approval.

and shall be subject to all lawful inspections and shall perform such other necessary acts as are
required by Chapters 3 1(Stormwater Management) and 32 (Streets and Sidewalks) of the Code. t: iA''✓`
4.3. University, its successors and assigns agrees to construct street improvements to the
existing street in accordance with all City standards and specifications.

TIMETABLE FOR CONSTRUCTION
6.1 Timetable for Construction.
(a) Upon execution of this Development Agreement by both parties, University shall
commence site preparation at the Development Site. Except as provided herein,
the site preparation shall be completed within months from the day it ''`s' '
begins, unless the day or time shall be extended by written agreement between the
parties; and then in such case on or before the extended day or time.
(b) The construction of the Development shall commence as soon as reasonably „
