Section 1. The Mayor and City Clerk are hereby authorized to execute an
Amendment to the Agreement with Prost Builders for Solids Processing Improvements at
the Wastewater Treatment Facility. 2s ;
Section 2. The amendment shall be substantially the same in form and content as
that amendment attached hereto as "Exhibit A." '
Section 3. This Ordinance shall be in full force and effect from and after the date of `
its passage and approval.

WHEREAS, the Agreement authorized the Contractor to provide construction services for
r wastewater treatment plant improvements (the Project); and

WHEREAS, the City now wishes to authorize the Contractor to provide an extension of
construction and resident phase services because the construction contract duration has been �ry r

NOW THEREFORE,the terms and conditions of the Agreement are modified as specifically set R

out below. All parts of the amended Agreement not specifically amended by this Amendment

Acceptance by contractor of the amended contract price and payment thereunder shall constitute a

contractor remedy any defects due to, and pay any damage resulting from, such faulty materials or
work that shall appear within a period of one year from the date of acceptance by contractor of

work by city, shall constitute an acceptance of any work or materials not in accordance with this
