WRI Amendment No. 3 to the Agreement with Black&Veatch for Engineering Services Related 3 ;

Section 2. The amendment shall be substantially the same in form and content as

AMENDMENT TO CONTRACT FOR PROFESSIONAL SERVICES
/ AMENDMENT NO. 3
'yTHIS AMENDMENT NO. 3 amends the Contract for Professional Services (Agreement) between the City of
Jefferson City, Missouri (City) and Black & Veatch (Consultant) dated July 25, 1996, as amended by 'ir7{,<<"'
Amendment No. 1 dated March 4, 1997 and Amendment No. 2 dated July 19, 1998. yai.2i' "r
WHEREAS, the Agreement authorized the Consultant to provide engineering services for wastewater treatment
plant improvements (the Project) as outlined in Attachment A to the original Agreement; and
WHEREAS,Amendment No. 1 authorized the Consultant to provide Phase III - Solids Facilities Improvements,
Detailed Design, Bidding, and Construction Services and Amendment No. 2 authorized additional design
services and full-time resident engineering services; }
WHEREAS, the City now wishes to authorize the Consultant to provide an extension of construction and
resident phase services because the construction contract duration has been extended
NOW THEREFORE the terms and conditions of the Agreement, Amendment No. 1 and Amendment No. 2
are modified as specifically set out below. All parts of the amended Agreement not specifically amended by this
Amendment No. 2 remain unchanged and in full force.
MODIFICATIONS
�s In Attachment A to Amendment No. 1, Construction Phase Services, Item A, second paragraph, change the
='� \ expected duration of the construction phase services from "365" days to "530" days because of the
construction contract will extend longer than originally planned.
2. Authorize the following Supplemental Service Item 1 from Attachment A to Amendment No. 1: ;;.}.<;:•..
3. "Prepare an operations manual for the sludge processing improvements, including the belt filter presses,
sludge stabilization system, and odor control systems.
it 4. Authorize the following Supplemental Service Item 2 from Attachment A to Amendment No. 1:

5. Provide on-site operations and maintenance training for the sludge processing improvements. Atotal of

Add the following to Item 7.1 added under Amendment No. 1.

AIVER OF CLAIMS
` Acceptance by consultant of the amended contract price and payment thereunder shall constitute a waiver of any `'Y
and all claims against City including any delay claims under the prior agreement, but such payment shall not E
relieve consultant/professional of responsibility for the work. No payment made to consultant, nor partial or
entire use or occupancy of the work by city, shall constitute an acceptance of any work not in accordance with A<:

All other sections of the Contract dated July 25, 1996 shall remain in effect as stated. ' ' `;
