the City Council of the City of Jefferson
' determined the long-term best interest of the City would be served by the acquisition of
residential and commercial property in north Jefferson City as a part of a Comprehensive
Hazard Mitigation Program;

WHEREAS, along with City funds, the City of Jefferson requested and received
� assistance through the Federal Emergency Management Agency 404 Buyout Program and
•;, the Community Development Block Grant Program for acquisition of flooded lands and

WHEREAS, conditions of assurance for the receipt and use of Federal financial
' assistance requires reuse of acquired properties consistent with sound flood plain land
management and use as defined in Title 44, Code of Federal Regulations Part 77
including perpetual dedication and public use for open space purposes including

f community parks, greenways, trail corridors, river access points picnic grounds, r���J�,�4r �.7� .
campgrounds, nature preserves, and community gardens, and
WHEREAS, the City of Jefferson successfully pursued the Flood Buyout Program
to the degree that acquisition is completed in north Jefferson City, and A4.

the Jefferson City Memorial Airport Clear-Zone Acquisition Program to the degree that
acquisition is substantially completed, and
WHEREAS, on December 1, 1997 by ordinance#12697, the City Council accepted
a gift of real estate from GreenCo Development Co. L.C. which remains unmaintained, ;; j.
undeveloped and unused and which is unsuitable for development other than for park and t •,r.
recreation purposes, and
WHEREAS, the Parks and Recreation Commission secured grant funding and has '
developed and informally and voluntarily maintained other city owned property for parks
and recreation purposes, and

NOWTHEREFORE BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,

MISSOURI, AS FOLLOWS:
Section 1. That real property acquired by the City through the Flood Buyout
a4 Program and related efforts located within an area bounded by Turkey Creek on the West,
U.S. Highway 63-54 on the North and East, and the Missouri River on the South and which ;,?<f{;; �1
was not previously designated for public park purposes by ordinance 12568 approved
January 7, 1997, be and hereby are designated for public park purposes. The boundaries
are shown on Exhibit A, attached hereto. The Council reserves the right to utilize any and
all parts for construction of the federal levee#142 project without obtaining further consent
of the Parks and Recreation Commission.
Section 2. That
t real property acquired by gift through ordinance #12697 and
!, owned land abutting and north of said gifted property to the southerly right-of-way line of :r1F
Edgewood Drive and extending westarly to the east right-of-way line of Wildwood Drive,
such area commonly known and maintained as a portion of the West Edgewood/Frog
Hollow Greenway, be and hereby are designated for public park purposes. The �tr � t':
boundaries are shown on Exhibit B, attached hereto.

Section 3. That the Mayor and Clerk are authorized to execute any documents
necessary to carry out the intent of this ordinance,
Section 4. That the properties within the boundaries set out in sections 1 and 2 are
hereby transferred to the Parks and Recreation Commission of the City of Jefferson which
is further charged with responsibility for their care in accordance with Article VI, Sectionys `y'r,
