HomeMy Public PortalAboutOrdinance No. 926-02 03-11-2002 • ORDINANCE NO. 926-02 AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS ADOPTING A NEW EMPLOYEE MANUAL SUPERSEDING THE PREVIOUSLY ADOPTED PERSONNEL POLICIES MANUAL, PROVIDING FOR PROSPECTIVE APPLICATION FROM DATE OF ADOPTION; PROVIDING THAT THE CITY MANAGER SHALL BE AUTHORIZED TO AMEND SAID EMPLOYEE MANUAL AS NEEDED; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Richland Hills is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City has previously adopted a personnel policies manual dated March, 1990, and now wishes to update and supersede that manual to provide for more efficient municipal administration, better serve the employees of the City, and conform to the dictates of various state • and federal laws; and WHEREAS, Section 6.04 of the City Charter authorizes and empowers the City Manager to direct and supervise the administration of all departments, offices and agencies of the City, except as otherwise provided by law or the Charter; and WHEREAS, Section 6.04 of the City Charter further provides that the City Manager may perfoi-~n such other duties as may be provided by the City Council, not inconsistent with the provisions of the City Charter; and WHEREAS, the City Council believes that the City, its citizens and employees will be best served by granting the City Manager the authority and responsibility to amend the Employee Manual on such occasions and in such respects as the City Manager deems necessary to best serve the interests of the City, its citizens and employees; • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. Section 2-31 of Article I, Division 1 of Chapter 2 of the Richland Hills City Code is hereby amended to read as follows: The City Council hereby adopts the Employee Manual, version 4.1, dated as effective February 26, 2002, as the official personnel policies of the City. The City Council further authorizes the City Manager to amend said Employee Manual on such occasions and in such respects as the City Manager deems necessary to best serve the interests of the City, its citizens and employees. A copy of the Employee Manual is not included in this Code of Ordinances, but is available in the office of the City Secretary. SECTION 2. The new Employee Manual will be applied prospectively from date of adoption as to both substance and procedure. • SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event the conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance • of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall be in full force and effect from and after its passage, and it is so ordained. PASSED AND APPROVED ON THIS ~ ~ DAY OF ~ ~ GUC.
