Developer, its successors and assigns shall provide all labor and machinery necessary to construct the street. B. Developer,its successors and assigns agrees to construct street improvements to the existin g street in accordance with all City standards and specifications. :fit 5. OBLIGATIONS OF CITY- FAIRWAY DRIVE CONNECTION A. The City shall acquire any needed right-of-way not within the developer's ownershipaG_� between that property and Fairway Drive at City's expense. si ' 6. CONTINGENT OBLIGATIONS OF DEVELOPER-FAIRWAY DRIVE CONNECTION A. This Agreement shall not be modified or amended except by a written instrument approved and signed by the parties hereto. 10. SEVERAB LITY. Any illegal or unenforceable provision of this Agreement will be severed here refromandwill not render invalid the remaining provisions of this Agreement. 11. LAW TO GOVERN. This agreement shall be construed according to laws of the State of Missouri.
