ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON MISSOURI VACATING AND
DISCONTINUING THE CUL-DE-SAC LOCATED AT THE WESTERLY END OF TARA �
PLACE, AND RELINQUISHING THE UTILITY EASEMENT ADJACENT THERETO.
r rw WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that

the owners of land adjacent to and abutting upon right-of-way for the cul-de-sac located ;t
at the westerly end of the Tara Place right-of-way in the City, have petitioned the City .r.>
Council to vacate a right-of-way; and

WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of the right-of-way of the cul-de-sac located `` `
at the westerly end of the Tara Place right-of-way for public use as described in Section 1
of this Ordinance; and
WHEREAS by an easement recorded in Book 12 Page 74, of the Records of the
Cole County Missouri a general utility easement was granted to the City of Jefferson, a
Municipal Corporation, to excavate within, install, construct, maintain and repair structures t, ;,''
}.> for the routing and conveyance of general utilities in, under and through the lots, tracts or

parcels of land described in Section 2 of this Ordinance; '
WHEREAS, it has further been shown that it would not inconvenience the public orjt r , t
the citizens of the City to discontinue a general utility easement lying adjacent to the part gr7t r<,
of the Tara Place cul-de-sac right-of-way for public use as described in Section 'I of this

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF

Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue as aright-of--way a portion of the cul-de-
sac located at the westerly end of the 'Tara Place right-of-way and forever vacate the
j. following described cul-de-sac right-of-way in said City:

Part of right-of-way of Tara Place, a right-of-way dedicated as per the plat of
k record of "TARA PLACE" in Plat Book 12. Page 74, of the Cole County
Recorder's Office, said "TARA PLACE" being a subdivision of part of the
