HomeMy Public PortalAboutORD12828 i BILL NO. 98-94 t • SPONSOR Councilmen Jackson &Lan wehr _ v ORDINANCE NO. ll r' AN ORDINANCE CODIFYING AS PANT OF CHAPTER 25 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, HOUSING REHABILITATION GRANT GUIDELINES UNDER THE CITY'S STATE COMMUNITY DEVELOPMENT BLOCK GRANTS AS ADOPTED BY ORDINANCES 12530 AND 12531, AND AMENDING CHAPTER 25 TO REFLECT 1998 GRANT E CHANGES. i BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,AS FOLLOWS: I i 1 The provisions of Ordinances 12530 and 12531 shall be codified as part of Sectio n . p Chapter 25 of the Code of the City of Jefferson, Missouri, as fbllows: ARTICLE IV.HOUSING REHABILITATION GRANT GUIDELINES Section 25-81.Purpose. The purpose of the rehabilitation program is to correct code violations,overcrowded +F :. or unsanitary conditions,to improve the housing and living environment for persons of low to moderate income levels living in the City of Jefferson,,Missouri. { Section 25-82.General Objectives. T A. The program is devised to conserve the City's present housing stock. ;. B. Low to moderate income families,as defined in approved grants,will receive rehabilitation work. C. A quarterly review of the program shall be conducted to determine if changes ;l or refinements are needed. .S •� D. City codes will be followed in all work performed and in the installation of all materials. F. ,i <y „ E. Section 25-8325-83.Functions,Duties and Authority of Grant Coordinator. , " The Grant Coordinator shall have the following functions,duties and,authority: 1. Serve as an advisor for Community Development Applications to the.State CDBG program. 2. Receive and process applications for'housing rehabilitation grants. }'u 3. Receive bids and award contracts for housing rehabilitation. ; 4. Approve final inspections of housing rehabilitation work and recommend payments to be made to the contractor by the City. °s 5. Establish policy where not otherwise specified. b 6. Recommend changes in program guidelines to the City Council. i . , h 7. Authorize change orders to work in progress. j ` 8. Have decision-making authority concerning repair of existing housing., +' l�s w , Section,25-84.Housing Rehabilitation Appeals Boar . 3y' d Created There is hereby created and established a.Housing Rehabilitation Appeals Board r (hereinafter called the"Board"). 1a Section 25-85.Membership and Vacancies. The Board shall consist of three(3)members to be appointed by the Mayor with the r. ` `• consent of the Council. The members of the Board shall be:the Director of the Depart ment of { „ Public Works, the Director of the Department of Parks and Recreation and the Director of f Finance. Any vacancies which occur may be filled by appointment by. the Mayor with the consent of the Council. All members of the Board shall serve without pay. rte,?y• , ,� d.- Section 25-86.Functions,Duties and Authority. The Board shall have the following functions,duties,and authority: is 1. The owner of any house who,disputes any decision made by the Grant �ro Coordinator may appeal such decision to the Board if such appeal is made in writing and filed with the City Clerk within ten (10) days after the,Grant t Coordinator's decision is made. Upon receipt of such notice of,appeal,the. e T k w° Board shall set a time and place for a hearing on the appeal and shall live said . tt F. owner written notice thereof. The only decisions which v shall be subject to appeal by any owned shall be those decisions made by the f Grant Coordinator concerning repair of existing housing; or program (� eligibility. 1 f Section 25-87.Officers. ` The Board shall annually elect a Chairman and Vice-Chairman. t r Section 25-88.Meetings and Records. .t' The Board shall determine meeting times and planes. Special meetings may be held on call of the Chairman. A Majority of the Board shall constitute a quorum for the transaction x, of business. The Board shall cause a proper record to be-kept of its proceedings. y jj Section 25-89.Process 1 , r ' :i A. All interested persons must make application for participation before airy ' action can be taken. All applications shall be processed. Participation in 4h e" F program is voluntary. Eligible applicants shall be assessed as to their need for supportive services. r B. Applicants who qualify will be taken on a first-come,first-served Basis with owner-occupants given priority over owner renters. Emergency situations will.' ' receive immediate attention. C. A complete house inspection will be made by the Program H ousing Inspector. A deficiency list will be prepared and submitted to the property o+vner. A ' work write-up will be prepared, as well as a cost estimate. All decisions ' concerning repairs to be made to the structure will be made by the Grant Coordinator with the right of appeal by the owner to the Board. D. All items on the work write-up,as well as other pertinent information,will be s discussed with the owner, Grant Coordinator, and Contractor'before a contract is signed. !t Section 25-90.Qualifications. xY, A.
